HOUSTON — Authorities say newly tested DNA evidence helped them make an arrest in the killings more than eight years ago of a family, including two boys, who were shot in their suburban Houston home.

Feng Lu, 58, who had long been considered a suspect in the case, was arrested on Sunday by police in San Francisco after his arrival from China, according to Harris County Sheriff Ed Gonzalez.

Lu has been charged with capital murder in the deaths of Maoye Sun and his wife Mei Xie and the couple’s two sons, 7-year-old Titus and 9-year-old Timothy, the sheriff said in a tweet on Tuesday.

Lu was being held Wednesday at a jail in San Mateo County, California, pending extradition to Texas. Court records did not list an attorney for Lu who could speak on his behalf.

The bodies of all four family members were found on Jan. 30, 2014, in their home in the Houston suburb of Cypress. All had been shot in the head. Investigators said Sun was last seen alive leaving work on Jan. 24.

Lu was linked to the killings after new forensic testing done in January on samples that previously were not able to be identified showed that Lu’s DNA was found on a purse that belonged to Xie, according to a probable cause affidavit.

The DNA testing contradicted statements Lu had made previously to investigators in which he had said he did not know Xie or her children and didn’t know where the family lived, according to the affidavit.

Authorities have not disclosed a motive for the killings, but according to the affidavit, Lu had unsuccessfully tried to get Sun’s help with a promotion at work. Both had worked at Cameron International, which provides products and services to oil and gas companies.

Lu “stated he believed that (Sun) made derogatory comments about him to fellow co-workers … which may have been the reason he did not get the promotion,” according to the affidavit.

Investigators say Lu had bought a handgun a week before the killings and then returned it five days after the killings without the weapon’s barrel. Authorities allege Lu gave inconsistent stories about what happened to the gun’s barrel. Investigators also allege that bullets Lu had bought with the gun had likely been manufactured on the same machine as the bullet that killed one of the boys, Titus.

SAN FRANCISCO — A man convicted of murdering his friend in San Francisco more than 30 years ago has been exonerated in a case that authorities said highlighted many issues within the criminal justice system, such as the lengthy amount of time it takes to undo a wrongful conviction , as well as problems associated with using incentivized testimony and the unreliability of cross-racial identifications.

Joaquin Ciria, now 61, was convicted of murder in 1991 in the shooting death a year prior of Felix Bastarrica. At the time, San Francisco police investigators honed in on Ciria as the shooter based on street rumors, questionable witness accounts and statements by the teen getaway driver, George Varela, who knew Ciria and tested — in exchange for immunity — that he drove Ciria to and from the scene.

But Ciria maintained his innocence from the beginning, and no physical evidence linked him to the crime, prosecutors now say. Furthermore, jurors heard no evidence of an alternate suspect and no evidence that Ciria had an alibi, even though two witnesses were willing to testify that he had an alibi.

After an exhaustive review by the San Francisco district attorney’s newly created Innocence Commission, prosecutors on Monday said new evidence presented by Ciria’s attorneys provided what they called “convincing proof” that Ciria was wrongly convicted based on false testimony. It was the first case reviewed by the Innocence Commission since its formation.

“Our office is proud of and grateful for the work of the Innocence Commission in rectifying the wrongful conviction of Mr. Ciria,” Chesa Boudin, the San Francisco district attorney, said in a statement. “Wrongful convictions continue to plague our justice system at great cost to the families, victims, and suspected persons whose lives are devastated when the wrong person is convicted of a crime.”

Boudin thanked the court for correcting what he called a “miscarriage of justice.”

At his trial, jurors heard three eyewitnesses identify Ciria as the shooter. But two witnesses were strangers who made what prosecutors called “cross-racial identifications” at long distances with poor lighting during the late-night shooting.

Furthermore, police placed extreme pressure on the teen getaway driver, a key witness in the case, to identify Ciria as the shooter or face charges himself, authorities said.

Another eyewitness, who was the victim’s best friend and knew all the parties involved, also saw the shooting and identified a different shooter. That witness didn’t testify at Ciria’s trial.

Other witnesses confirmed details that support the new eyewitness’s story, including descriptions of the shooter initially provided by the stranger eyewitnesses that more closely match the alternate suspect than Ciria did.

The driver’s sister and a close family friend said Varela has since admitted Ciria was not the shooter and that he lied at the trial.

Lara Bazelon, chair of the Innocence Commission, said in a statement that the district attorney has a duty to correct what she called intolerable violations when a conviction is a “perversion of justice.”

After the conviction was vacated Monday — 32 years after Ciria’s arrest — prosecutors dismissed the case and Ciria was freed.

Since the National Registry of Exonerations began tracking wrongful convictions in 1989, there have been more than 270 known wrongful convictions in California, prosecutors said. Studies show key contributing factors to these wrongful convictions include mistaken eyewitness identification, false testimony and official misconduct.

Paige Kaneb, supervising attorney at the Northern California Innocence Project, who represented Ciria, said his case — which contained all three contributing factors — highlighted many issues with the criminal justice system and was an example of how people of color aren’t afforded the presumption of innocence.

“Joaquin highlights the indominable nature of the human spirit–32 years were stolen from him and yet he has kept his big heart and easy smile and is full of joy as he looks forward to starting his life again,” she said.

SAN FRANCISCO (CBS SF) — A female suspect slammed into several cars including a California Highway Patrol vehicle while at the wheel of a stolen Toyota Camry before being arrested after a foot pursuit, authorities said.

The CHP said the incident began early Friday morning when officers were ending a pursuit of a DUI suspect on southbound Highway 101 near Cesar Chavez St.

As CHP officers were conducting a traffic break, the Camry speeded past both the slow moving traffic and the patrol vehicles on the right shoulder.

The officers immediately initiated a pursuit after the driver failed to pull over and stop. The Camry continued south and exited at Silver Ave., where it collided with the rear of a Nissan Maxima which was stopped at the top of the off-ramp for a red light.

The driver of the Camry then threw the vehicle in reverse and struck the front of the CHP vehicle before taking off again.

The pursuit continued down Silver Ave. towards Mission St. After circling around several blocks, the Camry collided with a Jaguar near Silver Ave. and Mission St., causing the Camry to be disabled in the road.

The female driver of the Camry attempted to flee on foot but was quickly detained without incident.

Once she was in custody, the officers learned soon that she recently had been released from custody for similar offenses and was out on supervised probation with an ankle monitor.

Investigators also determined the Camry was an unreported stolen vehicle.

The driver of the Nissan involved in the initial collision on the Silver Ave. off-ramp was determined to be under the influence and subsequently arrested for DUI.

The driver of the Jaguar was uninjured and there were no injuries to the CHP officers.

PLEASANT HILL (CBS SF / BCN) – Pleasant Hill police arrested two teens Wednesday in connection with a grass fire near Diablo Valley College, believed to have been caused by illegal fireworks.

Two 16-year-olds allegedly threw an explosive tennis ball-sized mortar from a moving vehicle on Golf Club Road. The resulting fire burned a quarter of an acre of grass and trees before firefighters put it out.

The device was designed to be detonated in a special launch tube, although without the tube it exploded on the ground, spraying sparks in all directions. Contra Costa County Fire Protection District officials said the fire could have spread to nearby homes in less favorable weather conditions.

A witness saw the youths fleeing from the scene near Contra Costa Boulevard and Doray Drive and called the police. The officers arrested the two 16-year-old residents of Pleasant Hill, who were interviewed and later released into the care of their parents.

Fire investigators said they would refer the case to prosecutors on likely charges of unlawful fire and possession of fireworks. The suspects are likely to be referred to the fire department’s youth fire department program.

The incident follows another fire that allegedly started last week in the Vine Hill neighborhood and was also caused by teenagers.

Fire district officials say they want to remind the public that fireworks, including those labeled “safe and healthy”, are dangerous and illegal in Contra Costa County. Anyone who sees people using fireworks can anonymously call the department’s arson hotline at (866) 50-ARSON (27766).

SAN FRANCISCO – Am 4.

Vielen Dank.”

SAN FRANCISCO (CBS SF) – Authorities announced that a San Francisco man was arrested in connection with a break-in last month at the recently closed Cliff House restaurant, which is home to historical memorabilia.

On Wednesday, a National Park Service spokesman announced KPIX 5 that the US Park Police, assisted by the San Francisco Police Department and park rangers, had issued search and arrest warrants in a house in Outer Richmond on February 12. The spokesman said a man had been arrested and charged in connection with the break-in.

The man’s identity is currently withheld. The police did not say whether they were looking for other suspects.

A surveillance photo of the break-in showed two people breaking into the historic building overlooking Ocean Beach on the morning of January 26. Items stolen included a bathing suit from the old Sutro bathhouse from the early 1900s.

During a search of the man’s home, authorities said they found several items that had been stolen from the restaurant. U.S. parking police said they found additional items on Feb.19.

Items recovered include swimsuits and artwork by Sutro Baths, according to Park Service.

Authorities said the recovered items have since been returned to the Hountalas family, who operated the restaurant for 47 years. The restaurant was closed late last year due to the COVID-19 pandemic and a dispute between the park service and the restaurant operators.

Items from the Cliff House are scheduled for auction on March 4th and 5th.

SAN FRANCISCO (CBS SF) – San Francisco police arrested two people on suspicion of murder in connection with a fatal shootout in the Bayview neighborhood last year.

According to investigators in the murder, the victim was found shot dead near Keith Street and Thomas Avenue on October 24, 2020 at around 3:50 p.m. Officials and paramedics helped the victim, but he died on the scene.

CONTINUE READING: The crews set off a 2-alarm fire in the floor shop in the San Leandro Mall

The San Francisco coroner’s office identified the victim as Mourice Green, 41, of Antioch.

Investigators identified two people as suspects in Green’s death and received search warrants issued earlier this month in two homes in San Francisco.

CONTINUE READING: Second suspect arrested in fatal attack in Oakland, robbery of 75-year-old Asian man

On March 4, officers arrested 50-year-old Willie Woodson on 3rd Street and Oakdale Avenue. The following day, officials arrested Denise Lasha Johnson, 29, from a house on the 2500 block of Arelious Walker Drive.

Both Woodson and Johnson have been booked for murder in San Francisco. You carried a loaded gun with the intent to commit a crime and you were a prohibited person carrying a gun in public. Johnson is also charged with conspiracy.

Police said while searching Johnson’s home, investigators found another person at the residence and developed a likely reason for arresting him on firearms charges. This suspect, identified as 29-year-old Romony Wilson, was detained in the county jail on suspicion of being a convicted criminal in possession of firearms, possession of assault weapons, possession of a large capacity magazine, and endangering children.
