<p>SAN FRANCISCO — A cruise ship that docked in San Francisco on Thursday is under observation by the US Centers for Disease Control and Prevention after a dozen vaccinated passengers tested positive for coronavirus.</p>
<p>The results followed a random testing of 25% of the passengers aboard the 10-day cruise to Mexico and the affected individuals are either asymptomatic or experiencing mild symptoms, the Port of San Francisco said in a statement.</p>
<p>The news came as the omicron variant drives extremely high infection levels in the cruise industry, prompting the CDC to investigate and place nearly 100 vessels under observation.  Cruise ships are required to notify the CDC of suspected or confirmed positive cases on board, and any vessel with 0.10% of passenger cases meet the criteria for investigation.</p>
<p>Cruise ships returned to San Francisco in October after a 19-month hiatus.  The pause was sparked in March 2020 when the Grand Princess carried people infected with the coronavirus, sending thousands of passengers to quarantine in their cabins as the ship idled off the California coast.  The ill-fated cruise captured the world&#8217;s attention and made the coronavirus real to millions in the United States.</p>
<p>When business resumed, most cruise lines required adult passengers to show proof of vaccination against COVID-19.</p>
<p>To date 22 cruises that have docked in San Francisco have reported COVID-19 positive passengers or crew.  All have complied with CDC and San Francisco Department of Public Health rules and protocols.  No reported cases have required hospitalization or medical care.</p>
<p>Due to the surge, San Francisco is also asking cruise ships to test passengers who have not received their second doses or booster shots before letting them come ashore.</p>
<p>&#8220;This requirement is stricter than federal and state guidelines and is intended to protect the people of San Francisco,&#8221; port officials said.</p>
<p>A spokeswoman for Princess Cruises said the vaccination rate among guests and crews aboard the ships was “approaching 100%.”  The passengers who tested positive will either go home or be taken to hotels for quarantine, Negin Kamali said.</p>
<p>Another Ruby Princess cruise ship is set to depart from San Francisco Thursday afternoon for another 10-day cruise to Mexico, she said.</p>

<p>SACRAMENTO (AP) &#8212; California&#8217;s coronavirus death toll has surpassed 80,000, and another 3,000 people are expected to die by the end of the month, even as infections, hospitalizations and ICU cases fall nearly as fast as they did during the rapid-fire Omicron -wave of the pandemic have risen .</p>

<p>That&#8217;s the highest in the US, but the country&#8217;s most populous state has a per capita death rate that&#8217;s among the lowest at 38.  Texas has just a few hundred fewer deaths than California, but has 10 million fewer residents and therefore a higher per capita rate.</p>
<p>Another 220 deaths in California were reported Thursday, and the state&#8217;s forecast models show the death toll will top 83,600 by the end of February.  Despite the dismal record, other indicators showed that California has clearly passed the peak of the latest and most contagious wave.</p>
<p>The state&#8217;s hospital admissions have fallen by more than 3,300 from a peak of 15,435 two weeks ago, well below the all-time high of nearly 22,000 in January 2021.</p>
<p>There were fewer than 2,300 intensive care patients, 300 fewer cases than 10 days ago and less than half the number in January 2021.</p>
<p>&#8220;We&#8217;ve definitely peaked and are seeing a downward trend in the numbers, but we&#8217;re not over the hill yet,&#8221; said Dr.  Olivia Kasirye, Sacramento County Health Officer.</p>
<p>Hospitalization rates in the state&#8217;s capital region and many other regions remain high, and waves of infection continue in places, including Sacramento County&#8217;s two jails.  Nearly 5,000 of the California state penitentiary&#8217;s 97,000 inmates are infected, along with 2,900 correctional workers.</p>
<p>However, the state&#8217;s case rate and positivity rates have fallen from their highs in early January, and models predict the number of those infected will continue to decline across geographies.</p>
<p>The hopeful trends mean Los Angeles is among counties moving toward relaxing mask mandates.  New cases in the country&#8217;s most populous county on Thursday accounted for about a quarter of the daily record number of cases set a few weeks ago.</p>
<p>About 3,200 people infected remained in the Los Angeles County hospital Thursday, but the number has fallen and Public Health Director Dr.  Barbara Ferrer said the winter surge will be considered over if it falls below 2,500 for seven days in a row.</p>

<p>Once that threshold is met, Los Angeles County will end mask requirements for large outdoor events such as concerts and sporting events, as well as for outdoor spaces in schools and childcare facilities.</p>
<p>The indoor mask requirements will remain in effect until the county has two consecutive weeks at or below a &#8220;moderate&#8221; rate of 50 new cases per 100,000 residents and no reports of a new, troubling variant circulate, Ferrer said.  The fall rate is now almost three times above the threshold.</p>
<p>&#8220;Post surge doesn&#8217;t mean the pandemic is over, or that transmission is low, or that there won&#8217;t be unpredictable waves of surges in the future,&#8221; Ferrer warned.</p>
<p>California&#8217;s statewide mask mandate expires on February 15, although local governments can still maintain their own mandates.</p>
<p>California&#8217;s confirmed number of coronavirus cases has now surpassed 8 million, but the 37,000 new cases reported Thursday are dramatically below the seven-day average of nearly 120,000 in early January.</p>
<p>The state&#8217;s models predict hospital admissions will fall by two-thirds to about 4,200 in another month, while intensive care unit cases will fall to less than 500, a fifth of what they are now.</p>
<p>The Omicron variant spreads even more easily than other strains of coronavirus and more easily infects those who have been vaccinated or previously infected with earlier versions of the virus.</p>
<p>However, early studies show that omicron is less likely to cause serious illness than the previous Delta variant, and vaccination and booster shots still offer strong protection against serious illness, hospitalization, and death.</p>
<p>Officials said unvaccinated Californians are 30 times more likely to die than people who got their booster shots;  nearly 15 times more likely to be hospitalized;  and are 7.5 times more likely to contract COVID-19.</p>

<p>SAN FRANCISCO (KRON) &#8212; The COVID-19 surge in San Francisco&#8217;s Omicron variant is finally coming down, according to the city&#8217;s top health official.  It has also taught city leaders to change their goals when dealing with COVID. </p>

<p>The surge caused San Francisco&#8217;s COVID-19 cases to hit a record high &#8212; more cases than the city has simultaneously reported in the entire two-year pandemic. </p>
<p>&#8220;Data shows that cases peaked on Jan. 9 with a 7-day average of 2,164 cases per day and have steadily declined each day since to 1,076 cases per day on Jan. 12,&#8221; according to the San Francisco Department of Public Health.</p>
<p>		COVID is now an &#8220;endemic,&#8221; not a &#8220;pandemic,&#8221; San Francisco doctors say	</p>
<p>Hospital admissions are expected to peak this week, with no concerns the local hospital may be reaching capacity, the department adds. </p>
<p>However, cases are still &#8220;extremely high&#8221;.  The department is recommending that San Francisco residents remain cautious about their activities and wear the right face masks over the next few weeks. </p>
<p>&#8220;We&#8217;ve seen how COVID has evolved over the last two years and as a city we&#8217;ve evolved with it,&#8221; said Mayor of London Breed.  &#8220;We know this virus will be with us for the foreseeable future, but we have the tools and experience in dealing with COVID not to be able to completely turn our lives upside down.&#8221; </p>

<p>Despite the record number of cases, most people in San Francisco reported mild or asymptomatic infections in the recent surge. </p>
<p>&#8220;Omicron changed the game &#8211; it&#8217;s extremely contagious and also less severe and often mild for those who have been vaccinated and boosted.  Our goal is no longer to prevent every case of COVID,&#8221; said Dr.  Director of Health, Dr.  Grant Colfax.  “Instead, our aim is to prevent the worst consequences of the disease, such as hospitalizations and deaths, and to do so while essential services such as schools and hospitals remain open.  We do this by doubling down on what we know works &#8211; get vaccinated and boosted.  And during times of high transmission, we need to be extra vigilant and strengthen our defenses to prevent spread to those most at risk and to our frontline workers who must support the city&#8217;s core services.&#8221;   </p>
<p>The city reports that 82% of its population is vaccinated and 61% of the eligible population has received an additional booster shot.</p>
<p>		San Francisco is expanding recovery program to provide financial assistance to people affected by COVID	</p>
<p>Across the Bay Area, most counties are beginning to reduce the number of reported cases, but hospitalizations are still increasing. </p>
<p>“Like most counties in the Bay Area, we are now seeing our case numbers going down.  We&#8217;re really more confident that this is a reliable trend,&#8221; said Dr.  Matt Willis, the Marin County public health officer.</p>
<p>In Santa Clara County, they use wastewater monitoring to supplement their public health data.  It measures the amount of virus in wastewater and accounts for those who are asymptomatic, don&#8217;t test, or do a home test. </p>
<p>Department of Health Deputy Director Michael Balliet says they are seeing a similar trend. </p>
<p>&#8220;Some leveling off or maybe even a slight drop in virus concentrations in wastewater,&#8221; Balliet said.  &#8220;We are cautiously optimistic that our clinical cases will show the same kind of reduction.&#8221;</p>
<p>But dr  Willis says it&#8217;s not time to let go of your vigilance yet.</p>
<p>&#8220;I think the other concern is that our hospitalizations are not going down at the moment.  In fact, they keep increasing,” said Dr.  willis </p>
<p>At John Muir Health in Contra Costa County, Chief Medical Officer Dr.  Russell Rodriguez his concern.</p>
<p>&#8220;The number of impatient patients is approaching our highest ever recorded figure for our healthcare system,&#8221; said Dr.  Rodriguez. </p>
<p>He says hospitalization lags behind case positivity, often peaking a week or two after cases have peaked.  Both doctors are confident that hospitalizations will soon decrease.</p>
<p>dr  Rodriguez says hospitals are still busy and asks people not to go to the emergency room for a COVID test or for very mild and manageable symptoms.</p>

<p>San Francisco city officials said Tuesday they had decided to cancel the city&#8217;s annual New Year&#8217;s Eve fireworks display over concerns about COVID-19 as cases continue to rise nationwide.</p>
<p>With the Omicron variant contributing to the exploding cases, city officials said they are canceling the famous fireworks display over the bay for the second year in a row.</p>
<p>Thousands of residents and guests usually pack along the Embarcadero to see the show, but last year people were told to stay home to prevent large gatherings and limit the spread of the virus.</p>
<p>Once again, city officials remain warnings.</p>
<p>&#8220;While we are all understandably eager to ring in a New Year with San Francisco&#8217;s usual New Year&#8217;s Eve fireworks, we must remain vigilant and do everything in our power to stop the spread of the COVID-19 variant of Omicron,&#8221; Mayor London told Breed in a statement.  &#8220;By canceling the New Year&#8217;s Eve fireworks show, we are reducing everyone&#8217;s exposure to COVID-19 while ensuring the continuity of city-wide public safety measures.&#8221;</p>
<p>In addition, isolation and quarantine protocols are reducing the workforce for public safety agencies due to the recent surge, city officials said.</p>
<p>&#8220;Minimizing unnecessary exposure among our officials and professional staff is key to maintaining the police force expected by San Franciscans, and it is important that we all do our part as San Franciscans to reduce the transmission of the ward across the city.&#8221; said Police Chief Bill Scott.</p>
<p>&#8220;We urge you to celebrate with your close family members and friends safely at home with all COVID security measures,&#8221; said fire chief Jeannine Nicholson.  &#8220;The cancellation of traditional fireworks will allow us to focus our resources on emergency services and day-to-day operations without adding large crowds and the potential incidents that result from such crowds.&#8221;</p>
<p>As of last week, the city was recording an average of 305 new COVID-19 cases per day, compared to an average of just 91 cases the week before.</p>

										<content:encoded><![CDATA[<p>SAN FRANCISCO (KGO) &#8211; A bill aimed at putting pressure on the San Francisco police and the San Francisco prosecutors to release more data on domestic violence cases was tabled in committee Thursday.</p>
<p>&#8220;I urge prosecutors to release what we have requested and more,&#8221; San Francisco Regulatory Authority Catherine Stefani said during a public safety and neighborhood services committee hearing.</p>
<p>ACTION: Get help with violence, assault, and abuse at home</p>
<p>Stefani says there is evidence that victims of domestic violence are kept short in the criminal justice system.  It introduced a law in May that, if passed, would require the SFPD and the prosecutor&#8217;s office to provide quarterly reports on domestic violence cases to the board of directors, the mayor and other city departments.</p>
<p>&#8220;Reporting requires how many calls to 911 are made that are related to domestic violence and how many of those calls involve a child or a gun,&#8221; Stefani said.</p>

<p>Legislation would also require that the number of domestic violence cases submitted to prosecutors be disclosed along with the charges filed and the outcome of those cases.</p>
<p>The bill&#8217;s hearing follows a report recently released by the Family Violence Council that found that 79 percent of people fleeing abuse and / or seeking protection were turned away during the pandemic due to capacity constraints and increased demand.</p>
<p>&#8220;It is very difficult for domestic violence survivors to leave the country,&#8221; said Jenny Pearlman, who works with Safe and Sound, a children&#8217;s aid organization.  &#8220;If a family that has experienced violence has no shelter, the family will most likely have to return to the home where the abuse takes place.&#8221;</p>

<p>There were 131 arrests for domestic violence crimes in San Francisco in the fourth quarter of 2020, according to SFPD.  86 percent of these cases were dismissed, only nine percent were charged.</p>
<p>ABC7 reached out to the prosecutor&#8217;s office and asked for a larger sample of this data to see how many domestic violence cases were indicted throughout the year.  Our team did not receive this information before our deadline, but received the following statement:</p>
<p>“Numbers declined during the pandemic, especially during detention periods, which particularly affected cases of domestic violence.  As a result, our office has also allocated significant resources to expanding support for domestic violence victims to provide shelter and transportation during the pandemic.  &#8221; </p>

<p>The prosecutor&#8217;s office also told ABC7 that filing and fee rates for domestic violence cases in San Francisco rose from 24 percent in 2020 to 31 percent this year.  By comparison, over the past five years, the highest fee rate reported for this type of case was 35 percent in 2018.</p>
<p>&#8220;I just think we have to do better,&#8221; said Stefani.</p>
<p>The draft law will be presented to the Supervisory Board for the first full vote in two weeks.</p>

<p>San Francisco will begin reopening more parts of its economy starting Wednesday, including indoor dining, movie theaters and gyms, an upbeat London Mayor announced when California gave seven counties the green light thanks to declining rates of coronavirus cases, hospitalizations and Deaths. </p>
<p>“This is the beginning of a great time in San Francisco, saving you money by not buying plane tickets to visit other places.  You can enjoy your city right here now, ”said Breed under the blue skies of Pier 39, a popular tourist area in picturesque Fisherman&#8217;s Wharf.</p>
<p>The announcement came almost a year after the San Francisco Bay Area imposed the country&#8217;s first lockdown, closing thousands of businesses and forcing residents inside.</p>
<p>San Francisco, with a pre-pandemic population of 900,000, has one of the lowest case and death rates in the country with more than 34,000 cases since the pandemic began and 422 deaths. </p>
<p>							San Francisco will begin reopening more parts of the economy starting Wednesday, including indoor dining, movie theaters and gyms, Mayor London Breed told Breed on Tuesday.  Pete Suratos reports.

<p>City financial analysts noted that residents have stayed home more than people in other California cities and even in other equally strict counties in the Bay Area, contributing to good public health but also a poor economy. </p>
<p>Most of the state is still limited to outdoor restaurants and museums, including the densely populated boroughs of Los Angeles, Orange, and San Diego to the south. </p>
<p>San Francisco, Santa Clara, and Napa counties in the Bay Area join four other counties that move out under the most restrictive rules in the state, including reopening indoor dining rooms and movie theaters with a capacity of 25% or up to 100 Open people and gyms and yoga studios with a capacity of 10%.  Museums, zoos and aquariums can be opened indoors with a capacity of 25%.</p>
<p>While some sectors were allowed to reopen after case numbers dropped in the summer, operations in San Francisco resumed in early December when the positivity rate rose across the country. </p>
<p>Outdoor dining, outdoor museums, and some indoor and outdoor personal services reopened in late January after the state canceled its regional stay-at-home order, but the economic toll has been grim.</p>
<p>Housing and commercial rents have plummeted as technicians who could work from anywhere fled to other parts of the state and county that were cheaper and had more leeway.  Downtown restaurants that once fed crowds of hungry office workers and tourists for lunch have struggled.</p>
<p>Tourism is also struggling, as airline ticket purchases to San Francisco in late October and November fell 80% year-over-year &#8211; much worse than the US average &#8211; the city&#8217;s financial analysts said in a January report. </p>
<p>Breed on Tuesday urged residents to continue to wear masks and maintain proper social distance, even as it encouraged them to explore the city and pump money into the local economy. </p>
<p>“When your waiter comes to your table, put on your mask.  When you go to the bathroom, put your mask on, ”she said.</p>
<p>Alcatraz Island, another top tourist attraction for the city, is slated to reopen in mid-March, said Julian Espinoza, spokesman for the Golden Gate National Recreation Area, which also includes Alcatraz.</p>
<p>Breed also announced on social media that another iconic San Francisco landmark will return sometime this year: the rattle of cable cars. </p>
<p>“Cable cars are part of the fabric of San Francisco.  They attract tourists, they help our economy, and I won&#8217;t just make them go away, &#8220;she said. </p>
<p>The districts of El Dorado, Lassen, Modoc and San Luis Obispo were also allowed to reopen on Tuesday.</p>
<p>As more things reopen, Governor Gavin Newsom urges his case to resume classroom learning and urges the state&#8217;s public schools to raise $ 2 billion in funding, part of one that he announced with lawmakers Reopening agreements are. </p>
<p>It provides additional funding for districts starting classroom reopening April 1, starting with the youngest classes and students with special needs. </p>
<p>The majority of California&#8217;s K-12 public school classes have been closed for a year, including San Francisco, which had to sue its own school district to begin talks about returning children to schools. </p>
<p>Though his plan wouldn&#8217;t tell districts to reopen schools, Newsom has urged schools to work harder to get kids back into the classroom as vaccinations spike and positivity rates remain low.  He said Tuesday the state&#8217;s 7-day positivity rate had dropped to just 2.3% &#8211; a record low, the health department said.  Nearly 52,500 people have died in the state of nearly 40 million. </p>
<p>&#8220;Try it out,&#8221; Newsom said Tuesday after a school tour.  &#8220;We can do the data that backs up science.&#8221; </p>
<p>The state&#8217;s two largest teacher unions have largely praised the deal, but teachers in Los Angeles called the plan an attempt to force schools to reopen, which would put still unvaccinated teachers at risk. </p>
<p>United Teachers Los Angeles, the union that represents California&#8217;s largest school district, said it was &#8220;a recipe for spreading structural racism&#8221;.</p>
<p>&#8220;If you make funding dependent on schools reopening, that money will only go to white and wealthier and healthier school communities,&#8221; union leader Cecily Myart-Cruz said in a statement.</p>

<p>SAN FRANCISCO (KPIX) &#8211; As COVID cases increase, more people are realizing they need to get tested.  In fact, every Bay Area County health department is seeing significantly higher demand for testing, and officials don&#8217;t want community testing sites to be overwhelmed. </p>
<p>“We have already decided not to reduce some of the test sites that we were considering.  As demand changes, we will consider opening additional test sites, ”said Dr.  Chris Farnitano from Contra Costa Health Services.   </p>

<p>Sam Levin has been trying to get tested for days after being exposed to a close family member who tested positive. </p>
<p>&#8220;It&#8217;s hard to get tested now that it was at the real peak,&#8221; said Levin. </p>
<p>He finally got an appointment online but spent an hour one way just to get to this test site and isn&#8217;t sure how long it would have taken if he tried a walk-in.</p>
<p>“It&#8217;s not an easy process.  For me, I&#8217;ve never tried to stop by so I don&#8217;t really know, ”said Levin.  </p>

<p>Gone are the mass test sites and many of the walk-ins.  The majority of the remaining listed by the San Francisco Department of Health are by appointment only. </p>
<p>&#8220;We continue to test at full speed before we see an increase in test demand,&#8221; said Dr.  Naveena Bobba of the San Francisco Department of Health. </p>
<p>&#8220;We are also seeing increasing demand for testing in Marin County,&#8221; said Dr.  Lisa Santora of the Marin County Department of Health.   </p>
<p>Almost every Bay Area County Health Department is currently looking into expanding their opening hours and possibly opening additional locations. </p>
<p>&#8220;The city of Berkeley is also seeing an increasing demand for tests and we are working with our test partners,&#8221; said Dr.  Lisa Hernandez of Berkeley Public Health.</p>

<p>9 am<br />Bay Area County suspends prison visits</p>
<p>Direct visits to Santa Rita Prison have been suspended.  The Alameda County Sheriff&#8217;s Office said this was due to an increase in coronavirus cases.  Contactless expert appointments are still possible.  The San Francisco County Prison has also suspended direct visits.  A prison spokesman told ABC7 that the visit would resume once it was safe, but nothing was said about how quickly it could resume.</p>

<p>12:30 pm<br />Contra Costa Co. announces weekly vaccine and first aid testing requirements<br />Contra Costa Co. health officials have issued new health ordinances requiring first responders to have a full vaccination or weekly virus tests.</p>
<p>The order went into effect on September 17 and applies to police officers, firefighters and emergency medical personnel who can work or answer emergency calls in high-risk facilities such as hospitals, prisons, care facilities and collective medical facilities.  Applies to the person.  It also applies to rescue workers who are not responsible for emergencies and who carry out medical transports to such facilities.</p>
<p>10:30 am<br />CA supervisor discusses vaccines for children<br />State Overseer Tony Thurmond hosted a discussion on the importance of vaccines for children as schools across the state prepared for face-to-face learning.</p>
<p>7:20 a.m.<br />Contra Costa Health Services has a new program that pays residents $ 100 every time they convince someone to get a full vaccination to increase their immunization protection.  The Helping Hands referral program is available to anyone over the age of 14.  The person must not have previously been vaccinated against COVID-19.  They also need to make promises using the unique websites that you offer them.  A grand total of $ 100 will be paid as a check or gift card after each person providing assistance has been fully vaccinated.  You must register on the county medical service website.</p>

<p>The Chase Center, home of the Golden State Warriors, announced today on Twitter that it will adhere to city guidelines.  This policy requires attendees over the age of 12 to provide proof of vaccination at a venue with at least 1,000 people.  The next event at the Chase Center is September 15th.</p>

<p>1:00 pm<br />Facebook is postponing the return of employees to office until 2022<br />Facebook employees will not have to return to the office until January 2022, the company announced on Thursday.  A company spokesperson told ABC7 that COVID-19 case data and a variant of Delta are driving an approach for employees returning to the office. <p>&#8220;Vaccines are already protecting workers, customers and visitors, and reducing the risk of outbreaks,&#8221; said Dr.  Lisa Hernandez, Berkeley health officer.  “The increase in vaccinations in every workplace improves our ability to stay open and healthy with our employees.  Mandatory workplace vaccinations and verification of vaccination records are a best practice, I said.  Is recommended.  &#8220;</p>
<p>2:25 pm<br /> Los Angeles City Council approved a bill mandating vaccines in public indoor spaces<br />On Wednesday, Los Angeles City Council passed law requiring city lawyers to draft an ordinance requiring residents to provide proof of vaccination before entering public spaces such as restaurants, gyms and stadiums.  Officials said the law applies to restaurants, bars, retail stores, fitness centers and other indoor facilities.</p>

<p>Starting today, proof of vaccination is required to eat at John&#8217;s Grill in Union Square, San Francisco.  The restaurant says all staff are already vaccinated.</p>

<p>22 O `clock<br />Auckland Unified calls for vaccine from employees<br />The Unified School District of Auckland has announced that starting September 7th, all employees, contractors and volunteers will need to be vaccinated or tested for coronavirus on a weekly basis.  92 percent of the employees who reported their condition have already been vaccinated, the district announced.  Since August 16, the district has also been calling for outdoor masks on campus.</p>
<p>14 o&#8217;clock<br />The vaccine doses administered daily at CA continue to increase<br />The average number of vaccines administered daily in California has increased by about 1,500 since Monday.  The data shows that California receives an average of 73,868 total doses per day.  A total of 21,620,087 are fully vaccinated in the country, of which more than 3.3 million are partially vaccinated.</p>
<p>1:30 p.m.<br />San Francisco Unified School District requests vaccine from employees<br />All employees in the San Francisco Unified School District must be vaccinated against COVID-19.  The district announced on Tuesday afternoon.  The school district has about 10,000 employees, and after September 7th, all must be fully vaccinated or tested for virus weekly.</p>
<p>The school district will return to face-to-face teaching on August 16.  There are no vaccination regulations for students, the school district said.</p>
<p>5 am<br />Further vaccination requirements in the Bay Area<br />There are even more vaccination requirements in the Bay Area.  The town of Walnut Creek requires workers to be vaccinated or to undergo weekly tests by Monday.  Those who are not vaccinated must wear a mask outdoors.  Gilead, based in Foster City, requires all employees in the United States to be vaccinated.  Biotechnology companies have set a deadline of October 1st.</p>

<p>19 o&#8217;clock<br />Santa Cruz Co. reports the first COVID-related death in 2 months<br />Health officials in the Santa Cruz district announced Monday that two residents were killed in complications from COVID-19.  This is the first COVID-related death in the county in more than two months.</p>
<p>Two residents were unvaccinated in their 70s and infected with a hyperinfectious Delta variant of the virus.  According to the county, both victims died on August 2 in a local hospital.</p>
<p>Since the beginning of the pandemic, the district has now confirmed 209 deaths related to COVID.</p>
<p>10:55 am<br />Pentagon calls for COVID vaccine from all troops by September 15<br />The Pentagon requires U.S. military personnel to receive a COVID-19 vaccine by September 15, according to the memo received by the Associated Press.  If the vaccine receives final FDA approval or the infection rate continues to rise, the deadline can be postponed.</p>
<p>7:25 am<br />More warehouse workers have to wear masks<br />Nowadays, more warehouse workers have to wear masks.  Tesla requires employees at a battery factory near Reno to cover their faces regardless of their vaccination status.  The same goes for 900,000 Amazon Warehouse employees.<br />Both directives come into effect today.  This addresses the increase in COVID and concerns about delta variants.</p>

<p>3:30 p.m.<br />Data shows that more than 21.5 million people have been vaccinated in California<br />A total of 21,572,282 Californians have been fully vaccinated against COVID-19, according to the latest state data.  The state averaged 72,412 doses a day, an increase from about 500 yesterday.  Over 3 million Californians have been partially vaccinated.</p>

<p>5:35 am<br />Public schools in Auckland will begin classroom teaching on Monday<br />Auckland public schools start face-to-face classes on Mondays and do not require any vaccination from teachers or staff.  The district says it will take its clues from the counties and states.  Alameda County supports vaccine selection.  However, Mayor Libby Schaaf says he stands behind his mission to all officials and teachers.  She says unvaccinated people should have a weekly COVID test.</p>

<p>17 o&#8217;clock<br />Napa County enforces indoor masking requirements at midnight<br />Napa County has joined most of the Bay Area by demanding face masks from indoor public spaces, the county said Thursday.  The order takes effect at midnight.  According to Napa health officials, the COVID-19 Delta variant now makes up 85% of the California variants.  Solano County is currently the only county in the Bay Area that does not require the use of indoor masks.</p>
<p>7:15 a.m.<br />Buses are being tested for COVID-19 across Santa Clara County.  We offer over 300 free tests in different locations every day.  Today it takes place from 10 a.m. to 6 p.m. at the Valley Water Headquarters.  Reservation is recommended.  Walk-ups are also allowed.</p>

<p>On Monday, the United States Supreme Court announced that the courts will have to deal with our Pakdel v. San Francisco City and County case, which is challenging a San Francisco ordinance requiring landowners to grant tenants lifetime leases.  The court found that they removed the barriers to bringing property rights cases to federal courts.</p>
<p>In 2009, Peyman Pakdel and his wife bought an apartment in San Francisco with the intent of making it their future home when they were ready to retire.  The apartment was one of six units carved out of a former house, and all six owners had the title of &#8220;shared tenants&#8221;.  Unlike some other owners, the couple decided to rent out their apartment until it was time for them to retire and make it their home.</p>
<p>When the Pakdels bought the unit, they along with the other owners agreed to convert the building into a condominium as soon as possible.  But the Pakdels lost the ability to live in their own home because the city passed an ordinance that only allowed condominium conversion if owners offered a lifetime lease to each existing tenant renting the property.</p>
<p>Thanks to the new ordinance, the Pakdels&#8217; much younger tenant could choose to stay for life, effectively stripping them of the couple&#8217;s property without compensation, in violation of the Fifth Amendment, and ruining their dreams of retirement.</p>
<p>The Ninth District had ruled that the Pakdels could not even challenge the law in court for failing to appeal the order in the Rube Goldberg-style process preferred by the city of San Francisco.  Strangely enough, this process no longer exists</p>
<p>The recent Supreme Court ruling is a huge win for property owners and builds on the previous victory by the Pacific Legal Foundation in Knick against the Township of Scott, Pennsylvania, which removed hurdles that made it nearly impossible to bring property claims in federal court do.</p>
<p>Prior to the 2019 Knick ruling, the Supreme Court held the Williamson County Regional Planning Comm&#8217;n v.  Hamilton Bank of Johnson City set a precedent generally forbidding landowners from getting their day in federal court unless they first exhausted all other state remedies.</p>
<p>The Williamson County&#8217;s ruling stated that &#8220;a property owner whose property has been taken over by a local government has not suffered a violation of his rights under the Fifth Amendment &#8211; and therefore cannot bring a federal lawsuit in federal court &#8211; until a state court dismissed his claim Has&#8221;.  for fair compensation under state law. &#8220;</p>
<p>In essence, Williamson County granted other constitutional rights property rights &#8220;second class status&#8221;.</p>
<p>But the Knick case, which raised the question of whether Rose Knick could bring her property rights case to federal court without a year-long ordeal of jumping through state courts, reversed Williamson County.  Knick also restored the importance of property rights, reiterating that these guarantees were equally important for all other constitutional rights.</p>
<p>Pakdel specified and expanded the kink.  The court said: &#8220;Given that the Fifth Amendment enjoys&#8217; full constitutional status&#8217;, the Ninth District had no basis to classify petitioners&#8217; entitlement to &#8216;poor relative status&#8217; under the provisions of the Bill of Rights.&#8221;</p>
<p>This is not the only recent Fifth Amendment win for PLF.  The court also recommended the lower courts to consider the Pakdels&#8217; claims in light of last week&#8217;s victory in our Cedar Point Nursery v Hassid case, where the right to exclusion is a fundamental characteristic of property and that the government cannot do that right without compensation path.</p>
<p>It seems that the Court is paying close attention to our property rights cases.</p>
<p>The Pakdel report unceremoniously reversed the ninth circle on the matter without additional briefing or oral argument.  It was issued “per curiam”, an unsigned statement on behalf of all judges.  This is a rarely used practice and sometimes controversial as the court does not say when it is used and the parties have no further opportunity to submit pleadings or argue.  The opinion included a &#8220;Grant, Release and Investigation Order&#8221; (GVR) ordering the Ninth Ward to overturn its previous decision to continue the Pakdels&#8217; case and examine the merits of their case in light of Cedar Point.</p>
<p>In our petition asking the Supreme Court to hear our case, the court was specifically asked to issue a summary order because the Ninth Ward&#8217;s decision was so blatantly at odds with Knick.  The summary order of the court achieved exactly this result.</p>
<p>Property rights are one of the most important constitutional rights we have, but since the New Deal the courts have limited their protection.</p>
<p>Fortunately, the Knick ruling has raised the standard when it comes to giving property owners access to federal courts to protect their property, Cedar Point reaffirmed the importance of the right of exclusion, and the Pakdel statement extends the protection of the fifth amendment even further.</p>

<p>LOS ANGELES &#8211; When Angeleno Wine Co. reopened its tasting room, co-owner Amy Luftig Viste was torn as old friends reunited for the first time since the pandemic closed so many stores that big cities looked like ghost towns.</p>
<p>Even with limited capacity, lively conversations flowed from the tables between the casks of aging wine and echoed off the brick walls of the winery, tucked away in an industrial area on the edge of downtown Los Angeles.</p>
<p>&#8220;It felt like the winery had come back to life,&#8221; Luftig Viste said on Sunday, the day after it reopened after being closed for but two weeks for the past 13 months.</p>
<p>The noise in a small space is expected to get louder if capacity is allowed to double to 50% as Los Angeles and San Francisco lead the way for California operations to reopen more widely.</p>
<p>The state&#8217;s major cities are likely to be the only major urban areas in the state that have met virus case thresholds for the least restrictive level as of Tuesday.  This allows indoor bars to reopen, allows larger crowds to cheer for Major League Baseball Dodgers and Giants, and expand capacity in restaurants, cinemas, amusement parks, gyms, and other facilities.</p>
<p>It&#8217;s a notable turnaround considering that California was the epicenter of the US virus outbreak just a few months ago.</p>
<p>The two cities weathered the pandemic differently, but appear in the same spot after a nationwide shutdown in March 2020.  Streets, shutters and restaurants have been closed and office buildings have been darkened.</p>
<p>While San Francisco largely defeated coronavirus by avoiding it, Los Angeles was nearly beaten during the winter flood.  In the worst case scenario, more than 500 people died daily in California, and hospitals in the LA area were barely able to handle the overwhelming influx of patients.</p>
<p>San Francisco briefly hit the Least Restrictive Yellow Level for a brief period in October, the only urban area to do so before an alarming spike forced a withdrawal in some cases.  LA only emerged from the most restrictive tier in March.</p>
<p>Now California has the lowest case rate in the country.  Los Angeles County, home to a quarter of the state&#8217;s nearly 40 million residents and a disproportionately large number of the state&#8217;s 60,000 deaths, did not record a single COVID-19 death on Sunday or Monday.</p>
<p>As the spring warms up, the highways are congested, workers are returning to offices, and people are going to restaurants and breweries.</p>
<p>On Sunday, drivers in the Arts District in downtown LA circled the block looking for parking.  The guests filled the sidewalk tables in the sausage kitchen, ate sausages and drank Belgian and German beer.  A line of people waiting to be seated at Angel City Brewery stretched down the street.</p>
<p>Chris Sammons said he felt a civic obligation to get out and support businesses.</p>
<p>&#8220;It almost feels like a chore to be involved with the city,&#8221; said Sammons.  &#8220;We have to bring LA back to life.&#8221;</p>
<p>It was the first time for his friend Stephen Tyler to say he was excited after crouching and vaccinating himself for so long.</p>
<p>&#8220;It&#8217;s just good to be back in town, to be with people,&#8221; said Tyler.</p>
<p>In San Francisco, business has picked up in Mixt, a popular lunch spot for salad lovers in the financial district.  But it&#8217;s not pre-pandemic levels when lines spill outdoors, said Leslie Silverglide, the chain&#8217;s co-founder and CEO.  She plans to open two more stores in the city center in the coming weeks.</p>
<p>&#8220;It seems like people are coming back,&#8221; she said.  &#8220;They look forward to having lunch with colleagues again.&#8221;</p>
<p>Fear of contracting the virus resulted in a huge drop in the number of local transport drivers.  Jason Alderman said he felt like a kid on his first day of school riding a local train to San Francisco.  He works for the online payment start-up Fast, which will reopen its headquarters as soon as San Francisco allows it at the end of March.</p>
<p>&#8220;Instead of feeling like a hollowed-out ghost town that people were quick to leave, it felt like there were green shoots of life,&#8221; he said.  &#8220;I felt a stab of energy that was there earlier.&#8221;</p>
<p>When the lockdown was issued in March 2020, an estimated 137,500 employees at companies in San Francisco, including Google, Facebook and Uber, appeared to have disappeared overnight.</p>
<p>Moving trucks being moved from households to more spacious suburban homes and younger folks just packed up their cars and left as they could work from anywhere.  Apartment rents have gone down, but now they&#8217;re increasing.</p>
<p>The vacancy rate in San Francisco is 18% compared to 10% last year, said John Chang, senior vice president at Marcus &#038; Millichap, a commercial real estate finance and advisory firm.  In Los Angeles the vacancy rate is 17.5% compared to 13.5% in the previous year.</p>
<p>Perhaps more tellingly, only 14% of key cards are used to access offices in San Francisco, compared to 24% in LA.  At the other end of the spectrum is Dallas, where data showed that 41% of the cards were used, reflecting the different approaches to the virus across the two states.</p>
<p>Chang said workers suddenly left San Francisco when the original shutdown order went into effect.  He expects the return to be gradual.</p>
<p>Lisa Elder, a paralegal who has been with her office since July, said that even with some restaurants and cafes that recently reopened, the area is a shadow of their former selves.</p>
<p>“Before COVID filled this place, there were tons of people eating in the alley, and now it&#8217;s like quiet.  It&#8217;s crazy, ”she said.</p>
<p>At Angeleno Wine, Luftig Viste said most of their customers had been vaccinated and they were all looking forward to being back outside.</p>
<p>&#8220;It&#8217;s just a great honor to be where people come to break the seal when we get out,&#8221; she said.</p>
