<p>SAN FRANCISCO (CBS SF / AP) &#8211; Foiled by a federal court backlash, Governor Gavin Newsom ordered staff to use Texas’s successful legal arguments in the Supreme Court to defend its ban on abortion to draft law that it would prohibit possession of assault weapons in California.</p>
<p>In a statement released Saturday night, Newsom expressed outrage over the Supreme Court&#8217;s decision on the Texas case.</p>

<p>“I am outraged by yesterday&#8217;s Supreme Court ruling allowing the ban on most abortion services in Texas to be upheld, and I broadly support Texas’s plan to amend its Roe v. Basic Protection Act.  Isolate Wade, ”he said.  &#8220;But if states can now protect their laws from scrutiny by federal courts that liken assault weapons to Swiss Army knives, then California will use that authority to protect people&#8217;s lives while Texas has used them to put women at risk. &#8220;</p>
<p>&#8220;I have directed my associates to work with the Legislature and Attorney General on a bill that will create a right of action that allows individuals to seek injunctive relief and legal damages of at least $ 10,000 per violation, plus costs and attorney&#8217;s fees assert anyone. ”Who manufactures, distributes or sells an assault weapon or ghost gun kit or parts thereof in the US state of California.  If the most efficient way to keep these devastating weapons off our streets is to add the threat of private lawsuits, that&#8217;s exactly what we should be doing. &#8220;</p>
<p>California has banned the manufacture and sale of many assault weapons for decades.  A federal judge lifted the ban in June, ruling it unconstitutional and drew the wrath of the state&#8217;s democratic leaders by comparing the popular AR-15 rifle to a Swiss Army knife as &#8220;good for home and combat&#8221;. </p>
<p>The state ban remained in place while the verdict is being appealed.</p>
<p>Meanwhile, Republican lawmakers in Texas passed law earlier this year banning abortion after a fetal heartbeat is detected, which usually occurs about six weeks after pregnancy.  Texas law allows private individuals to enforce the ban and gives them the power to sue abortion clinics and anyone else who “helps and assists” with the process.</p>
<p>On Friday, the US Supreme Court allowed Texas law to remain in effect while abortion clinics block it. </p>

<p>The Texas Abortion Act litigation has centered on its unusual structure and whether it inappropriately limits the ability to challenge the law in court.  Texan lawmakers left responsibility for enforcing the law to private individuals, not state officials.</p>
<p>The case raised a complex set of questions about who, if any, can sue in federal court, the typical avenue for contesting abortion restrictions.</p>
<p>Newsom&#8217;s gun proposal would have to pass California lawmakers before it could become law.  The legislature is currently not in session and is due to meet again in January.  It usually takes around eight months for new bills to pass through lawmakers, unless there are special circumstances.</p>
<p>Senator Brian Dahle, a Republican from Bieber, would oppose the plan but predicted it could likely pass California&#8217;s Democrat-dominated legislature.  He said the proposal was most likely a stunt for Newsom to attract its progressive electorate ahead of a possible future presidential run.</p>
<p>“The right to bear arms is different from the right to have an abortion.  The right to abortion is not a constitutional change.  So I think he&#8217;s far from the base, ”said Dahle.  &#8220;I think he&#8217;s just using it as an opportunity to be in the stands.&#8221;</p>
<p>But Newsom&#8217;s Saturday night statement is a fulfilled prophecy for some gun rights groups who had predicted that progressive states would try to use Texas&#8217; abortion law to restrict access to guns.  Because of this, the Firearms Policy Coalition, a nonprofit group that campaigns for gun rights, has filed a lawsuit against Texas law in the US Supreme Court.</p>

<p>&#8220;If Texas is successful in its move here, New York, California, New Jersey and others will not be far behind making equally aggressive moves to not only deter but to freeze the right to keep and carry weapons,&#8221; Lawyer Erik Jaffe wrote on behalf of the Arms Policy Coalition.</p>

<p>Nick Shoman has been with Charlie&#8217;s Pharmacy since he was 12 when his parents bought the storefront on Fillmore Street and Golden Gate Avenue.  He started helping out on the floor and quickly got to know the names of the customers.</p>
<p>Almost 35 years later, Shoman now runs the business with his brother, and the family-owned drugstore has become an integral part of the neighborhood.</p>
<p>Shoman knows his regular customers and their families and calls his pharmacist Hank Chen the “best in San Francisco” because he takes time for each customer to look after and advise them individually.  Charlie&#8217;s Pharmacy works with nearby nonprofits to offer delivery and bulk orders.  Shoman will occasionally agree to refill prescriptions on credit for customers in financial distress.</p>
<p>Shoman says that&#8217;s a far cry from Walgreens, which recently announced plans to close five San Francisco locations.</p>
<p>“In a chain of stores, customers are just numbers,” he said.</p>
<p>Walgreens blamed uncontrolled retail theft for the recent wave of closings.</p>

<p>Yet even San Francisco &#8211; which is known to be particularly tough on retail chains &#8211; has relatively little leverage over Walgreens or other corporate retailers when it comes to closing stores.  This reality has left officials vying for recourse and struggling to find a way forward to prevent something similar from happening again.</p>
<p>Independent drugstores could be a way to fill the void left by corporate outlets in some communities.</p>
<p>Owners can live well, and the stores offer customers bespoke services and attention that they may not find in chain competitors, according to David Valencia, manager at Reliable Rexall Sunset Pharmacy.</p>
<p>&#8220;I think you will see more independents emerge,&#8221; he said.</p>

<p>Any control the city has over the flow of business in and out of the market is done through the permitting process overseen by the planning commission.</p>
<p>For example, San Francisco&#8217;s formula retail ban prevents businesses with more than 11 locations from opening in certain business districts such as Hayes Valley, North Beach, and Chinatown, although exemptions may be granted.</p>
<p>Chains like Walgreens are required to obtain conditional use permits to operate in most other locations &#8211; which requires a thorough review by the planning committee to determine the impact on the surrounding neighborhood &#8211; and sometimes the applicant requires mitigating measures.</p>
<p>Supervisor Aaron Peskin even proposed legislation in July that would make it difficult for a new business to replace a laundromat.  The aim is to protect laundromat owners from predatory landlords and to prevent these dwindling businesses from closing further.</p>
<p>However, none of these measures force a company to stay open or to encourage a certain type of storefront &#8211; like a pharmacy &#8211; to take up a vacancy.</p>
<p>Valencia, who has over 40 years of experience in the pharmaceutical industry, including his time with several large chains, wants to make it known that independent drugstores can compete with their chain counterparts.</p>
<p>Rexall was once a widespread national chain, but it was phased out in the 1970s after being sold to private investors.  Some franchise locations, such as the one on Ninth Avenue and Irving Street, were allowed to continue using the name but have no connection with the former Behometh and are now independently operated.</p>
<p>At Rexall, Valencia offers personalized customer advice, supplies products to elderly residents in the neighborhood, carries special health products and promotes wellness coaching opportunities.  He says the store has established itself in the community by developing meaningful, lasting relationships with returning customers.</p>
<p>&#8220;Walgreens isn&#8217;t really a competition,&#8221; he said.  &#8220;We can offer special products that most chains don&#8217;t have, and we&#8217;re more agile.&#8221;</p>

<p>However, these outstanding qualities can only be offered when business is up and running.  This is an expensive and time consuming process that has historically given many larger retailers an advantage over smaller ones.</p>
<p>In the wake of the pandemic, San Francisco has already taken steps to relieve local traders: Proposition H streamlines the approval process and increases flexibility for new small businesses.  Shared spaces enable companies to operate more easily in parts of public space.  And Mayor London Breed backed a bill that provides $ 5 million in fee waivers, reliefs and deferrals.</p>
<p>Valencia and Shoman would like more support.  In addition to helping individual traders, they say it reinvigorates entire trade corridors by preventing vacancies and increasing pedestrian traffic &#8211; which itself could act as a deterrent to the type of retail crime that Walgreens cited as the reason for its departure.</p>
<p>&#8220;There are a lot of stores that have closed during the pandemic and it affects me because I used to have some of that pedestrian traffic,&#8221; Shoman said.  &#8220;If I have free business around me, it does not help me and is of no use to anyone.&#8221;</p>
<p>In the name of economic recovery, other potential solutions have focused more on enforcement.</p>
<p>Supervisor Ahsha Safai, whose district is about to close one of five Walgreens locations in Excelsior, passed a law in September that allows sheriff&#8217;s deputies to work off-duty as security guards in private companies.</p>
<p>This option is already made available to officers in the San Francisco Police Department, so the program would only extend the option to law enforcement in the sheriff&#8217;s office.</p>
<p>&#8220;If we don&#8217;t take care &#8230; we&#8217;re not going to make people feel safe going back to The City,&#8221; said Safai.  “We have to take care of it.  I definitely don&#8217;t want to go back to the time of over-incarceration, but this has to stop. &#8220;</p>
<p>As for the fixes, however, doubling enforcement isn&#8217;t seen as the best way forward by everyone, even those who acknowledge that organized retail theft continues to haunt the city.</p>
<p>&#8220;That&#8217;s why it&#8217;s so important to understand why they&#8217;re actually closing, and not just take their representations at face value,&#8221; said District Five Supervisor Dean Preston.  &#8220;It&#8217;s hard to come up with a solution to this or other stores closing without information on why they are closing.&#8221;</p>
<p>Residents and elected officials alike expressed frustration with Walgreens over the wave of closings.  They phrased the decision as a decision for the drugstore to leave the community and leave seniors, families and other individuals who rely on pharmacies near their homes without warning.</p>
<p>“It&#8217;s a neighborhood where residents, especially the elderly and other vulnerable community members, depend on having a pharmacy nearby,” Preston said of the 300 Gough St site closure Local community.&#8221;</p>
<p>In contrast, independent drug stores are typically close partners in the community.</p>
<p>&#8220;We don&#8217;t care about the lower dollar,&#8221; Shoman said.  &#8220;We&#8217;re pretty empathetic when it comes to our customers.&#8221;</p>

<p>CONCORD (CBS SF) &#8211; After months of drought conditions, Mother Nature has thrown open the storm door and piled rain-laden cold fronts far into the Pacific, promising much-needed rainfall in the parched northern California hills.</p>
<p>The first of the fronts swept the area with light showers on Sunday night.</p>
<p>&#8220;These showers brought from a few hundredths of an inch of rain on parts of our coasts and bays to nearly a quarter of an inch of rain on some of the highest peaks along the North Bay coastline,&#8221; the National Weather Service said.</p>

<p>Among those who dodged raindrops was John Mohamedi.</p>
<p>&#8220;It was dry, you know, the plants, the people,&#8221; he said.  “We need something else.  The world is going crazy somehow, we need a little adjustment. &#8220;</p>
<p>Casey Caster from Concord agreed.</p>
<p>&#8220;All we had is fire for fire, for fire,&#8221; he said over the tinder-dry hills.  “In addition, all reservoirs are drying up.  We have nothing.  There is hope, praise God, we have hope. &#8220;</p>
<p>But the showers also brought slippery roads and triggered power outages in the Bay Area that saw thousands woke up in homes without power on Monday morning.</p>
<p>The moisture from the showers combined with layers of dust accumulated over several months has short-circuited dozens of power transformers and electrical lines.</p>
<p>&#8220;After a long time without rain, dust, dirt, salt and other substances collect on power lines,&#8221; said a statement from the energy provider.  “When the first fog or rain comes after a long period of drought, this mixture turns into mud that conducts electricity.  This can damage electrical equipment and possibly lead to so-called electrical flashovers or tracking (electricity finds another path or another path instead of the cable) and can therefore lead to power outages. &#8220;</p>
<p>“Other causes of weather-related damage are electric arcs.  If there is enough dust and particles in the air near power lines, an electric arc and electrical flashover can occur. &#8220;</p>
<p>At 7 a.m., around 11,000 households were still without electricity.  There were 6,214 without power in the East Bay and 5,123 in the peninsula.</p>
<p>The storm front also brought a blanket of snow into the Sierra, with up to 8 inches falling at the higher elevations.  Chain requirements applied to the high passes on Highways 80 and 50.</p>

<p>&#8220;The next in a string of potentially wetter storms will hit the region late Tuesday through Wednesday,&#8221; the Reno National Weather Services office said in a statement.  &#8220;More active and wetter weather patterns will continue into the weekend.&#8221;</p>

<p>EL DORADO NATIONAL FOREST (CBS SF) &#8211; The Caldor Fire, burning in the Sierra Nevada, has become the country&#8217;s top fire fighting priority, and the chief of Cal Fire acknowledged the potential threat to the Lake Tahoe area on Monday afternoon.</p>
<p>The wildfire has burned 106,562 acres, or nearly 170 square miles, in the El Dorado National Forest since it began east of Omo Ranch and south of Grizzly Flats parish on Aug. 14.  A five percent containment was reported on Monday.</p>

<p>Cal-Fire Thom Porter told reporters at a news conference Monday that Caldor Fire is a top priority in fire-fighting resource allocation because of its proximity to Tahoe.</p>
<p>“It&#8217;s so important,” he said.  “There is a knock on the door to the Lake Tahoe Basin.  We have made every effort to keep it out of the pool, but we also need to be aware that it is possible because of the way the fires burned. &#8220;</p>

<p>After a week of no containment, fire officials reported five percent containment on Monday, and further containment is expected later in the day, particularly along the south edge of the fire.</p>
<p>At a press conference for the California governor&#8217;s Office of Emergency Services Monday afternoon, officials announced that two Galt police officers were seriously injured in a head-on collision on Highway 99 early Sunday morning while trying to help in the Caldor Fire.  Two other civilians were injured in the fire last week.</p>
<p>As of Monday, at least 403 homes had been destroyed by the fire and more than 17,000 homes and other buildings were threatened.  Six commercial properties were destroyed along with 148 other smaller structures, Cal Fire said.  The cause has not yet been clarified.</p>
<p>Downhill winds, low temperatures, and moderate overnight humidity helped slow the fire from spreading.</p>
<p>Operations chief Tim Ernst said Monday the toughest area of ​​the fire continues to be around where it originated, with the flames continuing to storm towards Grizzly Flats, where dozens of homes were burned in the wildfire last week.</p>
<p>&#8220;To solve this problem, we are installing a lot of emergency lines and bulldozers, and last night we did a long fire operation to remove some of the fuel from the fire,&#8221; said Ernst.  &#8220;But the fire continues to challenge us in this area.&#8221;</p>

<p>After jumping on US Highway 50 over the weekend, Ernst said there was no extensive fire growth past Highway 50 overnight and the crews on the northern edge of the fire were busy with extensive building defense and preparation.</p>
<p>On the western edge, a significant amount of work has been done around the Jenkinson Reservoir and Sly Park area to connect the existing fire lines, Ernst said.  The eastern tip of the fire continues to be a challenge, as daily winds from the southwest push the fire in an easterly direction.</p>

<p>More of the southern perimeter was expected to be contained later Monday.</p>
<p>Melissa Gustafson was among the residents of the area who were forced to flee their home.  She and her family of seven had to leave their room at the Best Western in Placerville that weekend and stay with relatives in the San Francisco Bay Area.</p>
<p>Her bill was several hundred dollars and it was paid by a good Samaritan.</p>
<p>&#8220;A lady behind me (in the checkout line) was (with) Cal Fire and told me she would take my bill for me,&#8221; said Gustafson, fighting back tears.  “I was just so happy!  We have nothing.  What do you do when you have nothing? &#8220;</p>

<li>East of Sly Park Road between Highway 50 and the Mormon Emigrant Trail to Ice House Road.  These include the Pacific House and Fresh Pond communities.</li>
<li>North of Highway 50, east of Forebay Road to Ice House Road.</li>
<li>Junction of Perry Creek and Hawk Haven, the east side of Fairplay Road from Perry Creek South to Cedarville Road.  These include Slug Gulch, Omo Ranch, and all roads away from Slug Gulch and Omo Ranch.</li>

<p>The Caldor Fire, along with other forest fires in Northern California, has caused the USDA Forest Service&#8217;s Pacific Southwest region to temporarily close nine National Forests.
