<p id="speakable-summary">DoorDash is facing a lawsuit from San Francisco District Attorney Chesa Boudin for &#8220;illegally misclassifying employees as independent contractors,&#8221; Boudin tweeted today.  In the complaint, Boudin argues that DoorDash misclassified its employees and thereby engaged in unfair labor practices.</p>
<p>“Misclassification of workers results in the deprivation of the employment protections to which they are entitled by depriving workers of, among other things, minimum wage and overtime pay, unemployment insurance and protection from discrimination,” Boudin said in a press release.  “[…] Now more than ever, given the COVID pandemic, we need to protect our workers, especially the essential workers who deliver food to us every day.”</p>
<p>In a statement to TechCrunch, DoorDash noted how it has supported its employees during the pandemic by providing them with safety equipment, telemedicine and more.</p>
<p>“Today’s action aims to disrupt Dashers’ essential services, deprive hundreds of thousands of students, teachers, parents, retirees and other Californians of valuable job opportunities, deprive local restaurants of much-needed revenue, and make it harder for consumers to prepare “Food, groceries and other essentials are safe and reliable,” said Max Rettig, global head of public policy at DoorDash, in a statement.  “We will fight to continue to offer Dashers the flexible earning opportunities they want during these challenging times.”</p>
<p>This lawsuit comes at a time when gig worker rights groups have called on companies like DoorDash, Uber, Lyft and Instacart to comply with AB 5.  AB 5, which went into effect earlier this year, determines what type of workers can and cannot be classified as independent contractors.</p>
<p>The law codifies the ruling in Dynamex Operations West, Inc. v. Superior Court of Los Angeles.  In this case, the court applied the ABC test and held that Dynamex misclassified its employees as independent contractors.</p>
<p>Under the ABC test, for a hiring company to legally classify a worker as an independent contractor, it must demonstrate that the worker is not subject to the hiring company&#39;s control and direction, performs work outside the scope of the company&#39;s business, and does so on a regular basis independently founded business or a similar company.  In the lawsuit, Boudin describes DoorDash as failing to meet the standards of the ABC test.</p>
<p>“DoorDash’s misclassification of its Dashers was not a mistake, but rather a calculated decision to reduce the cost of doing business at the expense of the workers who provide the company’s core service of delivering goods from merchant to customer,” the lawsuit says Conditions.</p>
<p>The lawsuit seeks to have DoorDash stop classifying its employees as independent contractors and be fined up to $2,500 for each violation and up to $2,500 for each violation involving a senior or disabled person.</p>
<p>DoorDash, Uber, Lyft, Postmates and Instacart are sponsoring a ballot measure aimed at allowing them to classify workers as independent contractors.  Meanwhile, Uber and Lyft face a misclassification lawsuit from California Attorney General Xavier Becerra and city attorneys from Los Angeles, San Diego and San Francisco.</p>
<p>This lawsuit argues that Uber and Lyft deprive workers of the right to minimum wage, overtime, access to paid sick leave, disability insurance, and unemployment insurance.  The lawsuit, filed in San Francisco Superior Court, seeks a $2,500 penalty for each violation, possibly per driver, under California&#39;s unfair competition law and an additional $2,500 for violations involving seniors or people with disabilities.</p>

<p><span style="font-weight: 400;">San Francisco District Attorney Chesa Boudin today filed an unfair business practices lawsuit against food delivery service DoorDash, which has consistently classified its employees as independent contractors rather than employees, contrary to California law. </span></p>
<p><span style="font-weight: 400;">“I assure you that this is just the first step of many to fight for worker safety and equal enforcement of the laws,” Boudin said at the virtual press conference today.  This lawsuit is being led by Assistant District Attorney Scott Stillman&#39;s White Collar Crimes Against Employees Unit &#8211; &#8220;and I did not bring ADA Stillman into the office to file a single lawsuit,&#8221; Boudin continued.</span></p>
<p><span style="font-weight: 400;">No messages were returned for DoorDash as of press time. </span></p>
<p><span style="font-weight: 400;">Today&#39;s lawsuit was filed at </span><span style="font-weight: 400;">Section 17200 of the State Business and Professions Code</span><span style="font-weight: 400;">what applies to “</span><span style="font-weight: 400;">&#8220;Any unlawful, unfair or fraudulent commercial act.&#8221; Either a prosecutor or a prosecutor can take action under this code &#8211; and in fact, in May, Attorney General Dennis Herrera, along with colleagues in Los Angeles and San Diego, filed a lawsuit against Uber and Lyft for their Employees had allegedly miscategorized. </span><span style="font-weight: 400;"> </span></p>
<p><span style="font-weight: 400;">According to the California Supreme Court decision: “</span><span style="font-weight: 400;">Dynamex</span><span style="font-weight: 400;">” decision of April 2018, </span><span style="font-weight: 400;">a three-point test </span><span style="font-weight: 400;">was established to determine whether workers should be classified as employees or independent contractors. </span></p>
<p><span style="font-weight: 400;">No reasonable interpretation of this ruling could result in Doordash workers—or Uber and Lyft drivers, or many others—being classified as anything other than employees. </span></p>
<p><span style="font-weight: 400;">In April 2019, it was revealed that DoorDash was applying the tips DoorDash had given its employees to their base wages instead of serving as tips &#8211; which led to this </span><span style="font-weight: 400;">A complaint is filed against the company</span><span style="font-weight: 400;">    with the city&#39;s Office of Labor Standards and Enforcement.  </span></p>
<p><span style="font-weight: 400;">In September 2019, the “Dynamex” decision was essentially codified as law under AB5, authored by Rep. Lorena Gonzalez (D-San Diego). </span></p>
<p><span style="font-weight: 400;">“When you think of theft, you don’t often think of wage theft,” said Gonzalez, who took part in today’s virtual press conference.  “If an employee stole from his boss, he would go to prison.  But employers steal from their employees in large quantities every day.” </span></p>
<p><span style="font-weight: 400;">By misclassifying workers as independent contractors rather than employees, companies can avoid paying the minimum wage, providing mandatory breaks, and providing health care or sick days.  Workers in such conditions are subsidized by the social safety net, which in turn is subsidized by taxpayers and law-abiding corporations. </span></p>
<p><span style="font-weight: 400;">“DoorDash has a long history of being an exploitative employer,” Veena Dubal, a labor law professor at UC Hastings, told Mission Local.  “Like Uber, the company’s business model is based on the fiction that its employees are independent contractors.  This means that the people whose work led to the company’s sky-high valuation will not have access to a wage floor, workers’ compensation in the event of an injury, or unemployment insurance if they are fired through no fault of their own.”  </span></p>
<p><span style="font-weight: 400;">During the ongoing pandemic, Dubal continued, these workers have continued to be classified as “essential” and have “risked their lives to deliver food from restaurants to families in lockdown.”</span></p>
<p><span style="font-weight: 400;">“DoorDash has vigorously fought the employment claims of its delivery drivers,” Dubal said.  “This lawsuit today – filed by the San Francisco District Attorney – puts the state’s weight behind these allegations.”</span></p>

<p>San Francisco District Attorney Chesa Boudin is suing food delivery platform DoorDash for “unlawful and unfair business practices.”</p>
<p>According to the complaint filed by Mission Local reporter Joe Eskenazi, who first reported the news, the company continues to classify its delivery drivers as independent contractors rather than employees, in direct violation of a California law designed to prevent companies from doing just that to do. </p>
<p>The state&#39;s AB5 law went into effect in early January 2020 and aims to require companies not only to classify gig workers as employees, but also to pay local, state and federal taxes according to that classification, as Eater SF notes .  Boudin&#39;s civil lawsuit asks DoorDash to classify its delivery workers, known as &#8220;dashers,&#8221; as employees.</p>
<p>“Today’s action aims to disrupt Dashers’ essential services, deprive hundreds of thousands of students, teachers, parents, retirees and other Californians of valuable job opportunities, deprive local restaurants of much-needed revenue, and make it harder for consumers to be prepared “To transport groceries, groceries and other essentials safely and reliably,” said Max Rettig, Global Head of Public Policy at DoorDash, in an email to Business Insider.  “We will fight to continue to offer Dashers the flexible earning opportunities they want during these challenging times.”</p>
<p>San Francisco tech companies — including Uber, Postmates and Lyft — and their business models rely heavily on gig workers.  This allows them to avoid the higher costs associated with paying wages and benefits typically reserved for full-time employees.</p>
<p>DoorDash — which filed to go public in late February — isn&#39;t the only company that has aggressively pushed back on AB5.  The company and others like Lyft, Uber and Instacart have poured millions into a campaign supporting a California ballot measure that would undo the AB5 law.</p>
<p>The driving service provider Uber and the food delivery service Postmates also filed a lawsuit in December 2019 on the grounds that the law was unconstitutional.</p>
<p>But gig workers are also going to court. </p>
<p>As Business Insider&#39;s Tyler Sonnemaker reported, Uber and Lyft drivers in California filed lawsuits against the companies in mid-April.  The workers said they would be owed at least $630 million in back wages because their employers continued to classify them as independent contractors despite the passage of AB5.</p>

<p>According to new paperwork filed in the Alameda County Superior Court last week, DoorDash should stop texting its drivers while they are moving and do more to limit distracted driving altogether.</p>
<p>Attorney Mark Webb has filed a wrongful death lawsuit seeking an injunction ordering DoorDash &#8211; a multi-billion dollar company calling itself the country&#8217;s leading delivery app &#8211; to change its practices following a fatal collision in Berkeley that killed a DoorDash driver and a pedestrian in July. </p>
<p>Webb said he believes his case will be the first lawsuit against DoorDash to seek injunctive relief.</p>
<p>&#8220;DOORDASH has so far failed to implement a technology that prevents Dasher from texting illegally while driving,&#8221; said Webb&#8217;s lawsuit.  &#8220;It turns a blind eye when its drivers are statistically likely to cut in the name of profit.&#8221;</p>

<p>On July 26, Latitia Austin Ahmad, 54, was hit and fatally injured on Ashby Avenue by a DoorDash driver on her way to pick up a delivery.  The driver, Helen Dale, also hit Ahmad&#8217;s daughter, 25-year-old Delvonnia Cooper, who survived but suffered serious injuries.</p>
<p>In August, Webb filed his accidental death lawsuit against Dale and DoorDash on behalf of Cooper and her brother Sharif Ahmad, citing DoorDash&#8217;s &#8220;speed-based&#8221; business model as an integral part of the problem. </p>
<p>On Thursday, Webb updated this paperwork to target DoorDash directly.  (He dismissed Dale from the lawsuit on a separate insurance settlement.) In addition to receiving interim relief, he has sought damages from the court that go beyond simple indemnity and seek to punish a defendant for outrageous conduct.  </p>
<p>When DoorDash approved Dale as a driver, it overlooked her history of relocation violations and her driver&#8217;s license outside of the state of Oregon, which court records said she had not updated even though she had moved to California months earlier.</p>
<p>DoorDash has not inspected Dale&#8217;s vehicle, interviewed her in person, or advised her to install a hands-free cell phone cradle, Webb wrote. </p>
<p>Dale said during a testimony that she had placed the phone she was using to navigate next to the gear stick next to the driver&#8217;s seat and that she didn&#8217;t see Ahmad until she hit her.  The video of the collision shows Dale hitting Ahmad at full speed.</p>
<p>&#8220;The fact that Dale did not stop or even slowed down indicates that she has completely taken her eyes off the road,&#8221; said the lawsuit.</p>
<p>DoorDash, Webb wrote, has a &#8220;duty of care&#8221; to properly train its drivers on road safety, regardless of whether they are viewed as employees or contractors.</p>
<p>“Nobody at DOORDASH told her that it was illegal to use an unmounted cell phone while driving, or advised her not to drive with an unmounted cell phone,” the lawsuit said.  “To the extent that DOORDASH purports to be the &#8216;last mile infrastructure for local commerce&#8217;, it has a duty to ensure that its &#8216;infrastructure&#8217; &#8230; has adequate security measures to prevent the illegal use of cell phones while driving or prevent. &#8220;</p>
<p>In the lawsuit, Webb says the DoorDash business model &#8220;will lead to increased rates of motor vehicle accidents, including accidents involving cars compared to pedestrians,&#8221; as drivers have incentives to &#8220;complete trips as quickly as possible&#8221;. </p>
<p>During their deliveries, DoorDash sends its drivers an SMS and sends mobile phone notifications through its app.  Webb says the app will make it clear when drivers are moving, and that is when DoorDash should stop sending notifications.</p>
<p>&#8220;It is our position that DoorDash is legally responsible for this accident,&#8221; said Webb in response to a query from Berkeleyside.  &#8220;If you don&#8217;t rethink your practice of texting drivers with unmounted cell phones while driving, there will be more accidents and tragedies.&#8221;</p>
<p>Webb has asked the court for a jury trial.  The case is due to be heard by a judge in February. </p>
<p>&#8220;You have the opportunity to lead the industry in transition,&#8221; said Webb.  &#8220;And I hope you do.&#8221;</p>

<p>DoorDash told Berkeleyside that the company believes driver safety is important.</p>
<p>&#8220;We take Dasher&#8217;s safety very seriously,&#8221; said Briana Megid, a company spokeswoman, &#8220;that&#8217;s why we invest in products, policies, and partnerships that allow us to lead the industry while better serving all members of our community.&#8221;</p>
<p>However, most of his safety tips seem to be aimed at keeping drivers safe from crime.  Berkeleyside could not find any mention of driver requirements or guidance regarding hands-free cell phone mounts in DoorDash&#8217;s online materials.</p>
<p>Berkeleyside has requested this information from DoorDash and will update this story when it is provided.</p>
<p>As a result of Proposition 22 approved in November 2020, DoorDash requires all California dashboards to pass a safety clearance that covers “safe driving and food handling”.  More detailed information on this screening was not available at the time of publication.</p>
<p>Alameda County Superior Court records, previously reviewed by Berkeleyside, showed that DoorDash was named twice as a defendant in alleged injury lawsuits over the past year: once in connection with a collision between a driver and a cyclist in Oakland and once in connection with a collision with a driver and a man on a motorcycle in an unincorporated area of ​​the district.  These cases are ongoing, but DoorDash has denied liability citing a number of laws.</p>
<p>Lawsuits against the company for wrongful death appear to be even rarer.  However, in August, the children of a Louisiana woman who was reportedly killed when a DoorDash driver hit her in her front yard filed an unjustified homicide lawsuit citing DoorDash as a party to the case.</p>
<p>The grocery delivery service, which was founded by several Stanford students in 2013, also faced allegations of inflating customers, engaging in fraudulent business practices and taking tips from drivers.  The company has denied many of the claims.  However, last year DoorDash agreed to a $ 2.5 million settlement related to tip theft allegations.</p>
<p>But the company, now valued at more than $ 30 billion, has also had tremendous success.  The company went public last year and turned its founders into &#8220;overnight billionaires.&#8221;</p>

<p>Grubhub and DoorDash have filed a lawsuit against San Francisco after capping delivery fees to 15% last month. </p>
<p>On Friday, the two food suppliers filed a lawsuit in the U.S. District Court for the Northern District of California arguing that the maximum fees are in violation of both the U.S. and California constitution.  Court documents show that DoorDash and Grubhub argued that the cap could potentially lead to higher prices for consumers and affect delivery couriers, among other things.</p>
<p>&#8220;The City of San Francisco has passed hasty, adverse and unconstitutional price controls that leave us no choice but to resolve this matter in court,&#8221; a DoorDash spokesman said in a statement shared with SFGATE.  “Constant price controls are not only against the US and California constitutions, but will likely harm the restaurants the city claims to support.  The introduction of permanent price controls is an unprecedented and dangerous exaggeration by the government and will limit the ways small businesses rely on to compete in an increasingly competitive marketplace. &#8220;</p>
<p>The delivery companies also said that the 15% fee cap could affect business as it would entail renegotiating or terminating existing contracts with local restaurants.  Part of their reasoning was based on marketing and other services that DoorDash and Grubhub said were unable to cover the costs.  </p>
<p>Supervisor Aaron Peskin, who co-sponsored the law in June, condemned both grocery companies in a tweet Friday following the complaint.  He wrote that he was not surprised at the lawsuit.</p>
<p>&#8220;Hardly surprising of giant corporations that have just spent over $ 200 million to deprive their own workers of basic services,&#8221; wrote Peskin on Twitter.  &#8220;I stand by small businesses and my legislation to stop the rampant exploitation of the San Francisco restaurant industry.&#8221;</p>

<p>Last April, Mayor London Breed announced a temporary fee cap to prevent grocery delivery apps from charging restaurants more than 15% to help local businesses stay afloat during the coronavirus pandemic.  At the time, it was said that the provisional order should remain in place until the remainder of the local emergency or until restaurants can reopen for dine-in service.</p>
<p>Court documents argue that with the advent of vaccinations, the local emergency has been &#8220;mitigated&#8221;.  San Francisco was summoned to court on Monday.</p>
