The San Francisco Examiner reported Thursday that locals can now receive text messages warning them if their car is about to be impounded, making San Francisco the first city in the country with such a service.

The program, naturally called Text Before Tow, will send San Francisco drivers who opt in a text when their car may be towed for 72-hour parking, blocking driveways or parking in construction zones or temporary no-parking zones.

“It’s a very expensive city to live in, and it’s a tough city in many ways, so what’s a way we can make things a little easier in our town?” San Francisco Municipal Transportation Agency board director Manny Yekutiel told the Examiner.

The program still doesn’t stop drivers from getting ticketed for these offenses but will cut down costs drastically. After all, getting towed is expensive — with fees for towing a vehicle reaching upwards of $500 with only minimal cuts for low-income people.

The aforementioned offenses, Yekutiel told the Examiner, are relatively harmless but constituted 27% of all cars towed in 2020.

“It makes sense to start in these categories to give people a little more grace,” he said.

San Franciscans may soon want to pay more attention to text messages from unknown numbers. Starting this week, an annoying notification could alert them that their vehicle is about to be towed.

The San Francisco Municipal Transportation Agency (SFMTA) has launched an initiative that will send a text message to customers whose vehicles are to be towed for one of four parking violations: parked more than 72 hours; block driveways; building zones; Temporary no-parking zones, such as B. Special events or moving trucks.

Together, these categories accounted for 12,500 vehicle towings, or 27% of towed cars, in 2020.

Typically, a full-price first-time tow costs a whopping $500 to retrieve the vehicle, although there are a number of discount programs for eligible individuals. Recovering the car also requires the owner to pay any outstanding ticket debt.

“It touched me because it’s a fundamental quality of life issue,” said SFMTA Board Director Manny Yekutiel, who spearheaded the initiative. “It’s a very expensive city to live in, and it’s a difficult city in many ways, so how can we make things a little easier in our city?”

The idea for a text-before-tow program came from a chance encounter with a generous neighbor.

As Yekutiel tells the story, the battery on his Vespa scooter was dead in Bernal Heights when a guy stuck his head out the window, offered to drop jumper cables, and invited Yekutiel upstairs for a beer. They struck up a conversation, and the neighbor told Yekutiel about an idea he once had for a text-to-tow program.

It seems so simple, but San Francisco will be the first major city in the country to offer this type of service.

The goal of SFMTA is not to make life easier for drivers at the expense of transit. Director Jeffrey Tumlin has made it clear that towing is a necessary tool to ensure pedestrian safety, the proper operation of Muni service, and to prevent misconduct by car owners.

Vehicles will still be towed without a prior text warning if they are parked in, for example, rush hour tow lanes, drive-thru lanes and other curb areas where parking is clearly prohibited.

But the four types of violations selected by the Department of Transportation for this program represent those more likely to be the result of a benign error, forgetfulness, or a misunderstanding of ever-changing road signs in transient events.

“It is quite reasonable that you accidentally parked here,” said Yekutiel, who mentioned that he had been towed many times. “It makes sense to start in those categories to give people a little more grace.”

SFMTA hopes these warnings will shift at least some of the burden of road clearance from the traffic agency to motorists themselves.

“We hate having to tow cars to make the transit go smoothly,” Tumlin said in a statement. “We can clear the streets faster and serve our customers better just by sending a text message so motorists can move their cars.”

The SFMTA’s towing policy has come under scrutiny during the pandemic for the disproportionate impact it has had on people of color, people living in their cars and low-income earners.

Though the city has struggled to provide discounts and extended notice periods to eligible individuals, this program could give some of the most vulnerable residents another opportunity to avoid the costly and often disastrous experience of having their vehicle towed.

To receive an SMS, residents must fill out a short online form to register their license plate number and phone number. Notifications alert the person that a tow truck is approaching, but don’t include an estimated time of arrival. If the vehicle owner arrives before the tow truck, towing fees will be waived, but parking fees will still apply.

According to new paperwork filed in the Alameda County Superior Court last week, DoorDash should stop texting its drivers while they are moving and do more to limit distracted driving altogether.

Attorney Mark Webb has filed a wrongful death lawsuit seeking an injunction ordering DoorDash – a multi-billion dollar company calling itself the country’s leading delivery app – to change its practices following a fatal collision in Berkeley that killed a DoorDash driver and a pedestrian in July.

Webb said he believes his case will be the first lawsuit against DoorDash to seek injunctive relief.

“DOORDASH has so far failed to implement a technology that prevents Dasher from texting illegally while driving,” said Webb’s lawsuit. “It turns a blind eye when its drivers are statistically likely to cut in the name of profit.”

On July 26, Latitia Austin Ahmad, 54, was hit and fatally injured on Ashby Avenue by a DoorDash driver on her way to pick up a delivery. The driver, Helen Dale, also hit Ahmad’s daughter, 25-year-old Delvonnia Cooper, who survived but suffered serious injuries.

In August, Webb filed his accidental death lawsuit against Dale and DoorDash on behalf of Cooper and her brother Sharif Ahmad, citing DoorDash’s “speed-based” business model as an integral part of the problem.

On Thursday, Webb updated this paperwork to target DoorDash directly. (He dismissed Dale from the lawsuit on a separate insurance settlement.) In addition to receiving interim relief, he has sought damages from the court that go beyond simple indemnity and seek to punish a defendant for outrageous conduct.

When DoorDash approved Dale as a driver, it overlooked her history of relocation violations and her driver’s license outside of the state of Oregon, which court records said she had not updated even though she had moved to California months earlier.

DoorDash has not inspected Dale’s vehicle, interviewed her in person, or advised her to install a hands-free cell phone cradle, Webb wrote.

Dale said during a testimony that she had placed the phone she was using to navigate next to the gear stick next to the driver’s seat and that she didn’t see Ahmad until she hit her. The video of the collision shows Dale hitting Ahmad at full speed.

“The fact that Dale did not stop or even slowed down indicates that she has completely taken her eyes off the road,” said the lawsuit.

DoorDash, Webb wrote, has a “duty of care” to properly train its drivers on road safety, regardless of whether they are viewed as employees or contractors.

“Nobody at DOORDASH told her that it was illegal to use an unmounted cell phone while driving, or advised her not to drive with an unmounted cell phone,” the lawsuit said. “To the extent that DOORDASH purports to be the ‘last mile infrastructure for local commerce’, it has a duty to ensure that its ‘infrastructure’ … has adequate security measures to prevent the illegal use of cell phones while driving or prevent. “

In the lawsuit, Webb says the DoorDash business model “will lead to increased rates of motor vehicle accidents, including accidents involving cars compared to pedestrians,” as drivers have incentives to “complete trips as quickly as possible”.

During their deliveries, DoorDash sends its drivers an SMS and sends mobile phone notifications through its app. Webb says the app will make it clear when drivers are moving, and that is when DoorDash should stop sending notifications.

“It is our position that DoorDash is legally responsible for this accident,” said Webb in response to a query from Berkeleyside. “If you don’t rethink your practice of texting drivers with unmounted cell phones while driving, there will be more accidents and tragedies.”

Webb has asked the court for a jury trial. The case is due to be heard by a judge in February.

DoorDash told Berkeleyside that the company believes driver safety is important.

“We take Dasher’s safety very seriously,” said Briana Megid, a company spokeswoman, “that’s why we invest in products, policies, and partnerships that allow us to lead the industry while better serving all members of our community.”

Not long after buying a Tesla Model 3 that summer, Vince Patton saw a YouTube clip highlighting a feature that surprised him: three video games that can be played on the large touchscreen in front of the dash – while driving down the street .

“I thought this couldn’t be right,” said Patton, a retiree in Lake Oswego, Oregon.

But he tried it in a parking lot and was able to play a solitaire game on the Model 3 while driving. “I only did it for about five seconds and then turned it off,” he said. “I’m amazed. It just seems inherently dangerous to me.”

The automaker added the games in an over-the-air software update sent to most of its cars this summer. They can be played by a driver or a passenger in full sight of the driver, raising new questions as to whether Tesla compromises safety as it quickly adds new technology and features to its cars.

“It’s a big problem, of course, when it comes to driver concerns,” said Jonathan Adkins, executive director of the Governors Highway Safety Association, which coordinates government efforts to promote safe driving.

Tesla’s autopilot system, which can independently steer, slow down and accelerate a car, has been criticized by safety experts for several years because it allows drivers to take their hands off the steering wheel for long periods of time, even though this is not intended. And there is no effective means of ensuring that the driver can keep an eye on the road.

The combination of hands-free driving and drivers looking away from the road has been linked to at least 12 deaths in Tesla cars that were operated in autopilot mode since 2016, according to the National Highway Traffic Safety Administration. Tesla and its CEO, Elon Musk, did not respond to several emails asking about the new video games and whether they might pose a threat to security.

Distracted driving is a major contributor to the rising number of road deaths in the United States. According to estimates by the Ministry of Transport, 20,160 people died in road accidents in the first six months of this year. That was 18.4% more than in the first half of 2020 and the highest value since 2006.

Driver inattentiveness is officially cited as the cause of about 10% of road deaths, said Steve Kiefer, an executive at General Motors who also runs a foundation dedicated to combating distracted driving. However, he and other safety experts believe the actual number is much higher, as crash investigations often overlook the distraction and identify other causes such as reckless driving.

“I think the number is closer to 50%,” said Kiefer.

The Kiefer Foundation is dedicated to his son Mitchel, who was killed in 2016 at the age of 18 when a distracted driver broke into his car on a Michigan freeway.

Distracted driving arises from activities in which the driver takes his hands off the steering wheel, averts his gaze from the road or distracts his attention from the driving task. It’s often associated with smartphone use, such as texting or emailing behind the wheel, but drivers sometimes read books or put on make-up. Some states prohibit the use of cell phones while driving. Automakers, Apple, and Google have developed in-car software that makes it easier to use voice commands to send text messages and make calls, so you can keep your hands free on the go.

Automakers have also added mechanisms to reduce potential windscreen distractions. Stellantis – formerly Fiat Chrysler – offers an entertainment system that can play DVDs on a front screen, but it gets dark when the car is pushed out of parking position. Many navigation systems do not allow manual entry of addresses while driving. Mazda vehicles prohibit most use of the dashboard screen while driving.

GM’s Super Cruise system, which can steer, brake and allow the driver to take their hands off the steering wheel, has an infrared camera to track the driver’s eyes. If they deviate from the road, Super Cruise issues a warning or switches off and returns control to the driver.

“We believe that these functions can be implemented quite safely with driver and eye monitoring,” said Kiefer, who heads GM’s international activities.

Some Tesla cars have simpler cameras that look at a driver’s face, but the cameras see less in the dark and don’t track the eyes precisely. Four years ago, after investigating a fatal autopilot crash, the National Transportation Safety Board recommended Tesla add an infrared camera to improve driver monitoring, but the company didn’t do it.

“It’s incredibly frustrating,” said Jennifer Homendy, chair of the security committee. “We’re trying to warn the public and tell Tesla, ‘Hey, you need to take some safety precautions.’ But they don’t have that. “

The Safety Committee investigates traffic accidents and can recommend measures to improve safety, but has no power to force companies to take action. NHTSA fulfills this role.
