AUSTIN (KXAN) — The owners of Oilcan Harry’s, STS Warehouse, LLC, filed a lawsuit Wednesday against their new landlord, claiming they have not been given access to their new location at 219 W. Fourth St. (down the block from their current location) and that an HVAC system has not been installed in the building.

The move precedes a redevelopment of Fourth Street. A residential building will be built at Oilcan Harry’s current location.

Oilcan Harry’s finds temporary space before move into new downtown tower

STS signed its new lease on May 18. In it, the landlord was to install an HVAC system by July 1 and secure a change of use for the property to operate as a bar/nightclub. STS began hiring architects and consultants to design the new space.

However, the move has stalled.

According to the lawsuit, landlord Thomas C. Calhoon refused to give STS access. Allegedly, Calhoon told STS on Oct. 4 He has a pending sale of the land to LV Company, an Austin-based real estate investment firm, and he could not allow STS to do anything without LV’s approval.

In response, STS sent a formal demand letter on Oct. 11.

“Defendant refused to act and told Plaintiff that he will not approve anything requests related to the Lease Property unless David Kanne approves the request on behalf of LV Company,” the lawsuit reads.

LV responded to STS on Oct. 14

“Counsel for LV Company asserted that Plaintiff is required to obtain approval prior to submitting a permit request but did not reference where the obligation in the lease such obligation is,” the lawsuit reads.

KXAN reached out to Calhoon and LV Company for comment. LV responded, but Calhoon has not yet. We will update this story when we hear back.

LV responded with the following statement:

LV Collective does not currently own the space that Oil Can Harry’s occupies and can’t accommodate specific requests. We plan to purchase the property, are excited for the bar to occupy the space and fully intend to honor the lease.

True Point Communications, on behalf of LV Collective

STS had asked LV to meet with counsel on Oct. 14, which LV asked to reschedule to Oct. 25. On Monday, LV allegedly told STS it would need another week to review. Both parties’ legal teams have not yet met.

“Despite several requests, neither Defendant nor LV Company has agreed to provide access to the Leased Property so that Plaintiff can fulfill its obligations under the Lease,” the lawsuit reads.

You can download the full lawsuit below.

The lawsuit, filed in Travis County Civil Court, accuses Calhoon of breaching the contract. It asks for the court to compel action and monetary relief of $1,000,000 for lost income and legal fees.

BOWLING GREEN, Ky. (WBKO) – “I want the public to know that there’s always two sides to every story,” said Liz Nelson, owner of Providence Homes.

In August of 2021, the Q Group, owners of Q Coffee Emporium filed legal action against their landlords, Steve and Liz Nelson, for what they call an “inadequate HVAC system.”

Providence spoke exclusively with WBKO news.

“We too had a part in Q’s dream. We were invested very heavily both physically, mentally, and spiritually with the family and we had a big financial part in this location that they were in,” said Liz Nelson.

WBKO uncovered legal actions filed last summer. Court documents indicate Providence did not push them out of the building. The court said the landlords needed to take the *steps* necessary to upgrade to the HVAC system.

“We were deeply disheartened by the choices that they chose to make. We tried to work with Q regarding the HVAC and the water leaks. We believed we were on a good plan through the courts to follow, to be able to get everything taken care of,” Nelson said.

Q coffee emporium recently made a post on Facebook that went viral. They stated they were pushed out of the building. They also claim those same landlords then made plans to open their own coffee shop in the same building.

lawsuit(Allie Hennard)

“The last thing we ever wanted was for Q to abandon the building. They left us in a devastating financial situation,” Nelson. “The building was built and equipped to be a coffee shop for Q. Our only option was an attempt to put it back as a coffee shop. Renovating again to make it a different business would have only added more cost.”

They say they’ve taken every step to assure the HVAC system is fixed and stop water leaks, but their Q decided to vacate the property in January.

“I want the public to know that there is a lot of emotion in this because of the relationship and how long we were friends, but that emotion should not effect our business and it should still be very professional,” Nelson said.

The lawsuit is still pending

Nelson says she holds no animosity towards Q and wishes them the best of luck in the future.

“In fact, we encourage the public, if you enjoy their products to please enjoy their product. It’s been extremely stressful, it’s been a lot of heartache, but we feel like we’ve put all that behind us and we’re just moving forward,” said Nelson.

Providence Coffee House and Marketplace is now open on 3031 Nashville road from 5AM-5PM.

Providence’s Full Statement is attached below.

A 24-year-old Iowa City man was arrested and charged with multiple shootings of his landlord.

According to a criminal complaint, the landlord of a property on the 400 block of East Fairchild Street in Iowa City arrived at the residence around 9:45 a.m. on Tuesday morning, December 21, to work on a plumbing problem. The landlord had already taken care of the work at this point.

After doing some work on the main level of the building, the landlord went upstairs and knocked on a bedroom door for access to additional plumbing. Shots rang out as he knocked on the bedroom door. Authorities say Carter Wolf, who was in another bedroom in the home, shot through the door of the bedroom he was in, towards the door.

The criminal complaint states that Carter “shot the victim through his bedroom door at least 6 or 7 times… The suspect admits he never saw the victim because his bedroom door was closed.” The suspect admits shooting through his closed door in the victim’s direction.”

The landlord was beaten multiple times and required immediate surgery and was hospitalized after the incident. The name of the landlord and the current condition were not disclosed.

Wolf was checked into the Johnson County Jail in Iowa City on Monday evening, January 3. He was charged with reckless use of a lighter resulting in grievous injury, a Class C felony. Wolf remains in the Johnson County Jail on $25,000 cash bail.

SAN FRANCISCO – A San Francisco landlord who was once described as an “unscrupulous predator” who allegedly tried to evict tenants from a rented apartment pays them $ 2.7 million, a state appeals court ruled.

The court upheld the award last month in a 2015 lawsuit filed by Dale Duncan and Marta Munoz Mendoza, who lived in the building with their daughter.

The lawsuit alleged that a company controlled by Anne Kihagi harassed her for more than a year to force her out of her apartment in order to attract higher-paying tenants.

They were eventually forced to vacate the building when the landlord filed an “owner eviction,” which allows eviction if an owner will be living in the building. Kihagi claimed that a family member who also had an interest in the homeowners company was moving in, which the family lawyer said never happened.

The family moved into a two-bedroom home on rent that was almost three times what they paid for the apartment, according to their lawsuit.

In 2017, a jury awarded them more than $ 3.5 million, which reduced a pre-trial court to $ 2.7 million.

In its 3-0 ruling confirming this award, the First District Court of Appeals said landlords “ignored or delayed responses to maintenance and servicing issues, were uncommunicative and uncooperative, and became increasingly hostile.”

The decision included removing recycling bins, refusing to repair a leaky water heater, blocking access to a laundry room, and turning off electricity.

Messages requesting comments from a lawyer representing Kihagi were not immediately returned.

It is the latest of many legal disputes between Kihagi, who once owned nearly a dozen apartment buildings in San Francisco.

City Attorney Dennis Herrera once described Kihagi as “a ruthless predator who targets tenants in rent-controlled homes for harassment and eviction, and weed out seniors and people with disabilities for particularly despicable abuse.”

In 2017, Kihagi was fined $ 5.5 million in a city attorney’s lawsuit.

A judge said Kihagi and her co-defendants exhibited “an ongoing pattern of bad faith harassment, retaliation and fraud” directed against tenants.

The properties were ordered by a court and some of them were sold.
