By now, you know all about the supply chain mess wreaking havoc on the global economy. The onset of the pandemic was the last straw on the camel’s back that broke the global supply chain, and it may be a while until it’s fixed.

Building owners are undoubtedly feeling the ill effects of product shortages. But we’re here to say the supply-shortage consequence you should be most worried about is in regards to your building’s HVAC system.

HVAC contractors nationwide have been hampered by rising costs, a labor shortage, and the inability to get their hands on needed materials like microchips. All this is leading to delays in getting repairs done. And with winter coming soon, now’s the time building owners need to get started on what could be a lengthy HVAC procurement process.

The supply chain nightmare has given all of us a lesson in logistics and globalization we probably didn’t want. It’s essential for property owners to prioritize HVAC repairs now, be flexible with contractors, and build resilience into their supply chains.

The supply chain chaos

You may remember the supply chain problems all began right after the virus struck and caused a shortage in vital medical supplies and personal protection equipment (PPE). As lockdowns began, tremendous demand for N95 masks and other PPE outstripped supply. Consumer panic buying also caused some strange situations (toilet paper shortage).

Unfortunately, this was just the beginning. Factories in parts of the world with much of the global manufacturing capacity were hammered by the pandemic, leading to shutdowns. Shipping companies thought consumer demand would drop because of lockdowns, but they were terribly mistaken. With stay-at-home orders in place, consumers went on online buying sprees for everything from personal computers to home gym equipment. The increased demand overwhelmed supply chains and slowed down the transportation of goods.

All told, it was a perfect storm. And now, more than 18 months since this all started, just about anything that’s produced or manufactured is in short supply. As a result, almost every industry has been hit hard. In particular, the automotive industry has been significantly impacted, as a shortage of microchips has led to considerable decreases in car production and increased costs for consumers.

The microchip shortage is one problem that’s affecting HVAC contractors. Semiconductors are essential components of HVAC systems and they’re in very short global supply. Shortages for all sorts of other HVAC parts have also been reported, including compressors, motors, and raw materials like copper, steel, aluminum, and plastic.

Labor away

Shortages of HVAC components have caused significant price increases. Raiven HVAC supply chain research reveals that specialized equipment including semiconductors will likely see 10-30 percent price increases soon. Copper prices reached an all-time high in May 2021, jumping more than 130 percent from March 2020. The steel price nearly doubled in August 2021 compared to last year, according to a US government index tracking the price.

The US Pacific Northwest and Southwest just went through a historically hot summer, increasing demand for HVAC services. The HVAC industry is also no stranger to labor shortages, but the pandemic has made it worse. All these factors have combined to cause the highest HVAC distributor lead times since 1987, according to Raiven research.

Karl Pomeroy, GM and President of Motili, a nationwide HVAC service provider, said many of the HVAC industry’s supply-chain problems have also been caused by very close to “all-time highs in terms of business growth” for the industry.

The HVAC industry’s labor shortage has had a significant impact, too, Pomeroy said. “As our industry gets more technically advanced, I think the labor shortage is more pronounced,” Pomeroy told us. “It takes a higher level of skill to service some of these pieces of equipment. The industry is also feeling a rising inflationary cost for labor because so many of these companies have to attract and retain top employees, and they’re paying more. So, not only are we paying more for finished goods and parts and pieces, but we’re also feeling the pinch of more expensive labor.”

Pomeroy added that for the typical building owner, they’ve seen fairly dramatic rising costs throughout the past 18 months, and “there’s really no end in sight.”

Stay ahead of the seasons

So, yes, it’s all rather messy right now. But while it seems like an apocalyptic scenario, it’s not all doom and gloom. By taking the proper steps, building owners can do many things to alleviate the pain. Undoubtedly, you’ve already been dealing with increased HVAC service prices and lead times for more than the past year, so you’ve probably come up with some solutions. But as this supply chain mess drags on, it’s imperative to keep a laser-like focus on your HVAC system—especially as winter approaches.

HVAC systems are one of the most expensive and vital pieces of equipment in commercial buildings, and breakdowns can be catastrophic. Get a fall inspection on your HVAC now, especially if it’s acting up. If there are needed fixes that require parts, lead times may be longer. Be proactive and patient with contractors, and get repairs done before the cold weather sets in.

Preventive maintenance of HVAC systems is more critical than ever right now. Check and change air filters on a monthly basis, keep the unit clean, and check heating-specific parts like gas/oil connections, burner combustion, and heat exchangers. This type of maintenance extends the unit’s lifespan and helps avoid significant problems during the heating season.

So see

“Tenant satisfaction is a huge factor affected by HVAC systems,” Pomeroy said. “A lot of our clients are moving into a model where they’re looking at their total portfolio of (HVAC) products, looking at the age of those products, and doing preventive maintenance to keep them in peak operating condition. Our clients are also more proactive when their systems starts to approach its age of replacement and putting it on a planned replacement strategy.”

Back up a system

A second and equally important thing building owners can do right now is build resilience into their supply chains. And this doesn’t just go for HVAC repairs and contractors. Take a look at all your vendors and suppliers and motto ways to make your supply chain stronger during these unpredictable times.

Beware of being stuck in a sole supplier situation. Establish secondary vendors and contractors for essential services (like HVAC), and don’t hesitate to reach out to them if their lead times are shorter or in emergency cases. Consider using supply chain management software, as well. Common programs from Blue Yonder, Infor, Oracle, and SAP help building owners gain better visibility into their vendors and supply chains and they also greatly benefit planning.

Perhaps the worst part of the supply chain nightmare is no one’s quite sure when it will end. Major exporters in Southeast Asia of critical components like semiconductors are still struggling to contain COVID-19, and global port and shipping congestion may last well into 2022.

The Biden administration has taken steps to alleviate the problems, such as urging the Port of Los Angeles to operate 24/7. But as General Motors CEO Mary Barra and other business leaders have indicated, the shortages and rising costs have forced many companies to re-think supply chain management altogether.

Pomeroy said building owners have to be “proactive instead of reactive” with their HVAC systems. Property managers need to focus on their HVAC units and ensure their mechanical components are in good working order. If they’re not focused on HVAC right now, he said, “they’re setting themselves up for a very difficult period of time.”

“I don’t believe this is a case where, in two to three months, all these supply chain and labor shortage issues affecting HVAC go away,” Pomeroy said. “I think we all came into 2021 thinking, well, it’s going to be better. In some cases, it has been better. But in some cases, it hasn’t been. The demands on the HVAC industry have been high. For those clients who are sitting back and waiting, they’re running the risk of the day they decide to do something, they’re going to find themselves not being able to find a labor source or not being able to find the materials.”

Lead times for HVAC repairs may be longer, and costs may be higher, so be proactive about this situation and keep a close watch on it. Get fall HVAC maintenance done as early as possible, and also think about other essential supplies and parts that may be affected. Resiliency, flexibility, and planning skills are the key attributes for surviving this supply chain turmoil. You likely already know about the supply chain issue, don’t wait until it leaves you out in the cold.

Julie Levitch wasn’t arrested until a sweaty evening in August 2020 when a neighbor heard broken glass and called the police.

Levitch, a 52-year-old mother of two, had gone to her boyfriend’s house to return his phone. The doorbell was broken, so she knocked on the window. It had cracked, and when she tapped the glass, her hand broke right through, leaving a bloody wound, she said. When the Phoenix police arrived, the couple stated there was nothing wrong – but officers arrested Levitch and charged her with criminal harm through misdemeanor.

She spent the night in jail, where she says she was sexually molested, the cave was searched and put in solitary confinement for 16 hours. Three months later, prosecutors agreed to drop the charges.

Now Levitch is suing – not for her arrest and detention, but because the county jail posted her mug shot online. Like many law enforcement agencies, the Maricopa County Sheriff’s Office routinely releases photos of people admitted to the local detention center, potentially permanently devastating their lives before they were convicted.

“That photo will be out there forever,” Levitch told me, worrying about how it would affect everything from job openings in her job as a technical writer to new friendships. “We live in a society where you’re supposed to be innocent until proven guilty, but I was found guilty the minute the mug shot showed up.”

The Maricopa County Sheriff’s Office has not yet responded to Levitch’s lawsuit, and a spokeswoman declined to comment on pending litigation.

In the digital age, those images of people’s worst days lurk forever as internet clickbait. Many news outlets have stopped posting mug photos – or at least so many of the photos – but some states and cities are starting to grapple with a more fundamental problem: Why are police posting mug photos – and should they be allowed to?

“If you see a mug shot, you are suspecting crime,” said Imani Gandy, a law and court journalist and a vocal critic of the representation of colored people in the news media.

In Oregon, after January 1, law enforcement officials may only release booking photos under certain circumstances, such as trying to find a fugitive.

***

The first time I saw my own mug shot was the day after I was jailed in New York state for heroin. It was December 2010, and I was still on the high of drugs, when the other women in the cell block woke me up to point out my frowning face on the evening news.

With scabby cheeks and a red nose, I looked worse in this photo than any other I’d ever seen of myself. I had no idea then how stubbornly it would follow me. Long after I stopped getting high, articles about my arrest – with that “faces of meth” -like picture attached – were the first results when I typed my name into Google, like a digital ball and a chain to me connects with a previous life.

Still, I was fortunate and privileged to be given a second chance, unlike so many others. When I started working as a reporter, it was part of my job to add mug shots to dozens of local news and crime stories. Media has long been posting the images that drive web traffic and, with it, advertising money.

It wasn’t until some editorial offices began to abandon this practice that I began to wonder why we had ever done this and urged my own editorial team to stop. (The Oregonian / OregonLive has severely restricted the use of mug shots in recent years.)

***

It was only recently that I began to ask why the police had to publish mug shots in the first place.

Some law enforcement agencies are asking themselves this question as well. The Justice Department has repeatedly refused to post mug shots, arguing in a federal appeals court that there is no public safety interest in posting images that represent a “permanent picture of one of the most difficult episodes in a person’s life.”

Last year the San Francisco Police Department also suspended their release.

“The widespread publication of police posting photos in the news and on social media creates an illusory correlation for viewers that encourages racial prejudice and vastly overestimates the propensity of black and brown men to commit criminal behavior,” said Chief Bill Scott at the time.

Now the department only publishes arrest photos if they have a clear law enforcement purpose – such as finding a suspect or missing person. Last month, Newark, New Jersey police announced a similar policy change.

At least three states have gone a step further and have banned some mug shots from being published. In 2019, New York changed its Open Records Act to prohibit posting of mug shots unless it helps law enforcement. That year, California banned police from posting the pictures on social media, and Utah banned mug shots from posting until after the conviction.

The changes generated some resistance, particularly from civil rights groups and journalists. At a February hearing, Salt Lake City investigative reporter Nate Carlisle asked lawmakers to reject Utah law, pointing out that mug shots are sometimes the only evidence of police brutality during an arrest.

“I just don’t think it’s good public policy to hand out fewer government documents,” he told me a few weeks ago. “Whether journalists should publish them is another discussion.”

Since mug shots are often viewed as public records rather than criminal records – the latter of which are considered too personal in many states to release – it’s hard to win a lawsuit like Levitch’s.

“These lawsuits are usually dismissed because the agency says, ‘It’s a public record and we have the right to publish it,'” said Sarah Lageson, a Rutgers sociologist who studies mug shots.

There are a few exceptions, she said. A 2016 court ruling allowed the Department of Justice to withhold mug shots, and in a Pennsylvania case, ex-prisoners were awarded cash damages when a federal jury ruled that releasing mug shots was against the Open Records Act.

“It should be a change in the law and then we wouldn’t have to rely on judicial interpretation of what is publicly available in the digital age,” said Lageson.

Some law enforcement say that posting mug shots can encourage other victims to come forward, and others claim – without evidence – that threating a mug shot can help deter crime.

But for people who have publicly posted their mug shots, it seems like the practice also discourages rebuilding a life. Sometimes it’s hard to pinpoint the exact damage because when a would-be job or a landlord or date pops up after discovering a stigmatizing picture online, we usually never know. To Levitch, this seems to undermine the basic protections our justice system should have.

“Is it constitutional to publish mug shots that damage the reputation of people when they are still innocent?” Said Levite. “It just seems naturally unfair and not American to do this.”

Keri Blakinger is a salaried writer whose work has focused on prisons and prisons.

After New York City announced a nation’s first COVID-19 vaccination mandate that would require indoor businesses like restaurants, bars, and gyms to review customers’s vaccination status, San Francisco officials said they could potentially implement a similar policy.

“We’re investigating this,” said Dr. Grant Colfax, San Francisco Health Director, at a news conference Tuesday.

The last time city officials said they were considering a directive (inner masks for vaccinated people) it was enacted just days later. Supervisor Matt Haney told KGO (ABC7) that an indoor vaccine mandate “could happen this week”.

However, with many San Francisco restaurants and bars already requiring proof of vaccination for entry, the city might decide it doesn’t need to go beyond simple encouragement, Colfax said.

If San Francisco wants to go further, the New York Order, entitled “Key to NYC Pass,” goes beyond bars and restaurants and includes enforcement mechanisms. The policy requires all restaurants, bars, gyms, and indoor entertainment venues (such as movie theaters) to screen their guests for proof of vaccination or be fined.

The policy goes into effect on August 16, and the city plans to begin enforcement on September 13. Mayor Bill de Blasio said the city is still finalizing the details of the plan, including whether to expand the order to indoor shopping and how to treat children under 12 who are not eligible for the vaccine .

New Yorkers – or those visiting New York City – can show their Centers for Disease Control and Prevention vaccination cards, New York State electronic “Excelsior Pass,” or a new city-specific digital tool. If San Francisco copies the policy, the state of California will offer digital vaccination cards, although the introduction has been bumpy.

Mayor London Breed previously stated that the city is working with its lawyers to look into the legal feasibility of a full vaccine mandate.

While San Francisco ponders New York politics, the mayor of another heavily vaccinated city in a heavily democratic state explained why she wouldn’t consider a similar system. The incumbent Mayor of Boston Kim Janey pointed to potential issues with justice, compared a possible vaccine passport to slave papers, and asked Barack Obama to reveal his birth certificate to explain why her city would not consider it.

“There is a long history of people in this country having to show their papers,” she said. “During slavery, after slavery, as young as you know what the immigrants are going through here. We heard Trump with the birth certificate nonsense. Boston residents or disproportionately affect the Black, Indigenous and People of Color (BIPOC) communities. “

Black people are among the least vaccinated groups in San Francisco, New York, and Boston. In San Francisco, for a variety of reasons, including suspicion of the government and medical community over past abuses, the city has increased its outreach to black residents who are reluctant to get vaccinations.

On Monday, the United States Supreme Court announced that the courts will have to deal with our Pakdel v. San Francisco City and County case, which is challenging a San Francisco ordinance requiring landowners to grant tenants lifetime leases. The court found that they removed the barriers to bringing property rights cases to federal courts.

In 2009, Peyman Pakdel and his wife bought an apartment in San Francisco with the intent of making it their future home when they were ready to retire. The apartment was one of six units carved out of a former house, and all six owners had the title of “shared tenants”. Unlike some other owners, the couple decided to rent out their apartment until it was time for them to retire and make it their home.

When the Pakdels bought the unit, they along with the other owners agreed to convert the building into a condominium as soon as possible. But the Pakdels lost the ability to live in their own home because the city passed an ordinance that only allowed condominium conversion if owners offered a lifetime lease to each existing tenant renting the property.

Thanks to the new ordinance, the Pakdels’ much younger tenant could choose to stay for life, effectively stripping them of the couple’s property without compensation, in violation of the Fifth Amendment, and ruining their dreams of retirement.

The Ninth District had ruled that the Pakdels could not even challenge the law in court for failing to appeal the order in the Rube Goldberg-style process preferred by the city of San Francisco. Strangely enough, this process no longer exists

The recent Supreme Court ruling is a huge win for property owners and builds on the previous victory by the Pacific Legal Foundation in Knick against the Township of Scott, Pennsylvania, which removed hurdles that made it nearly impossible to bring property claims in federal court do.

Prior to the 2019 Knick ruling, the Supreme Court held the Williamson County Regional Planning Comm’n v. Hamilton Bank of Johnson City set a precedent generally forbidding landowners from getting their day in federal court unless they first exhausted all other state remedies.

The Williamson County’s ruling stated that “a property owner whose property has been taken over by a local government has not suffered a violation of his rights under the Fifth Amendment – and therefore cannot bring a federal lawsuit in federal court – until a state court dismissed his claim Has”. for fair compensation under state law. “

In essence, Williamson County granted other constitutional rights property rights “second class status”.

But the Knick case, which raised the question of whether Rose Knick could bring her property rights case to federal court without a year-long ordeal of jumping through state courts, reversed Williamson County. Knick also restored the importance of property rights, reiterating that these guarantees were equally important for all other constitutional rights.

Pakdel specified and expanded the kink. The court said: “Given that the Fifth Amendment enjoys’ full constitutional status’, the Ninth District had no basis to classify petitioners’ entitlement to ‘poor relative status’ under the provisions of the Bill of Rights.”

This is not the only recent Fifth Amendment win for PLF. The court also recommended the lower courts to consider the Pakdels’ claims in light of last week’s victory in our Cedar Point Nursery v Hassid case, where the right to exclusion is a fundamental characteristic of property and that the government cannot do that right without compensation path.

It seems that the Court is paying close attention to our property rights cases.

The Pakdel report unceremoniously reversed the ninth circle on the matter without additional briefing or oral argument. It was issued “per curiam”, an unsigned statement on behalf of all judges. This is a rarely used practice and sometimes controversial as the court does not say when it is used and the parties have no further opportunity to submit pleadings or argue. The opinion included a “Grant, Release and Investigation Order” (GVR) ordering the Ninth Ward to overturn its previous decision to continue the Pakdels’ case and examine the merits of their case in light of Cedar Point.

In our petition asking the Supreme Court to hear our case, the court was specifically asked to issue a summary order because the Ninth Ward’s decision was so blatantly at odds with Knick. The summary order of the court achieved exactly this result.

Property rights are one of the most important constitutional rights we have, but since the New Deal the courts have limited their protection.

Fortunately, the Knick ruling has raised the standard when it comes to giving property owners access to federal courts to protect their property, Cedar Point reaffirmed the importance of the right of exclusion, and the Pakdel statement extends the protection of the fifth amendment even further.

Anything can happen in the next month before the Jets are on the clock in the first round of the NFL draft. However, with two blockbuster deals on Friday, it appears New York is positioning itself to bring in number 2 BYU quarterback Zach Wilson.

By early Friday afternoon, it was revealed that the 49ers had traded 3rd and sent a ton of picks to the Dolphins as Miami returned to 12th overall. The trade as first reported by Adam Schefter from ESPN contains two future first-round picks.

It’s the type of trade you make to level up and get a quarterback. Even if the 49ers are supposedly staying with Jimmy GaroppoloThe expectation is that this year’s quarterback class will get off the board early and often. This puts San Francisco in the middle of this process.

Given the connections between the 49ers and the Jets, namely New York’s new head coach Robert Saleh, imagine San Francisco trying to call Jets general manager Joe Douglas to become the second overall winner.

As much as that would make sense, it turns out that San Francisco never contacted the Jets about the number 2.

Maybe San Francisco already knows what New York is up to? The 49ers were likely one of the teams that reached out to the Jets to inquire about Sam Darnold’s availability. Maybe the number 2 was already excluded in the off-season?

As if that were enough breaking news for the day, Miami returned to the top 10 a moment later, trading a selection of picks with the Eagles in another blockbuster.

The Eagles also wanted to trade all the way to number 3, according to the NFL Network’s Ian Rapoport, but Philadelphia pulled back because they didn’t think Zach Wilson would be available.

Rapoport later made it clear that this had more to do with Philadelphia’s rebuilding and internal assessments of whether it would be worth trading that high on this year’s draft.

In either case, the big advantage is that other teams act on the assumption that Wilson will no longer be available after the second choice. Any team looking to design a quarterback under Choice # 2 would work with Justin Fields of Ohio, Trey Lance of North Dakota, or Mac Jones of Alabama.

New York could have been busy on Friday if they wanted to swap number 2 away. Sure, the full story about the Jets’ involvement in negotiations and possible proposals is unclear at this point, but this was a perfect opportunity to secure a lot of value if the plan was to stick with Darnold. That opportunity came and went.

Few teams left – possibly the Denver Broncos or Carolina Panthers – could be in the market to trade in for a quarterback. Would you blow Douglas and his team away with an offer New York can’t refuse? Sounds like it has to be more than Miami got from San Francisco.

Even then, the jets couldn’t accept it.

Mayor London Breed announced Tuesday that San Francisco is transitioning from the most restrictive purple to the milder red.

In the red row, California allows new business areas to be reopened and some indoor activities to expand such as restaurants, museums, cinemas, and fitness with restrictions.

With a few exceptions, the reopening of the city is what the state allows.

From Wednesday 8:00 a.m., the city will start operating:

– Eating al fresco with three households of up to six people
– Personal services that require the removal of masks both outdoors and indoors, with specific health and safety measures in place
– Indoor dining (including full catering bars, food courts, hotel restaurants) with a capacity of 25%, but limited to four people from a household, with indoor dinner ending until 10:00 p.m. and other safety requirements being met
– Indoor gyms and fitness centers with a capacity of 10%
– Indoor museums, zoos and aquariums with a capacity of 25%
– Indoor cinemas with a capacity of 25% without concessions
– Standalone outdoor amusement park rides such as ferris wheels, carousels, and train rides
– Restricted use of indoor pools

The city is also lifting nighttime restrictions on gatherings and non-essential business activities between 10 p.m. and 5 a.m.

In the red row, middle and high schools that have not yet opened can resume opening with a COVID-19 safety plan approved by the San Francisco Health Officer. According to the mayor’s office, all other schools may already be open with an approved security plan.

While the state allows indoor retailers to increase capacity in the red to 50%, SF will cap the cap at 25%. The state also allows indoor gatherings for up to three households with restrictions; The city will continue to restrict this, the statement said.

“Now I know it doesn’t sound like being in the red, but it’s great compared to where we are,” Breed said at a press conference streamed live by KPIX. “That means this is just the beginning.” This is the beginning of a new day for San Francisco. “

The mayor said at the press conference that the city could jump into the orange row within three weeks and allow for even more openings.

In the Bay Area, counties of Napa and Santa Clara also switched from the purple to the red layer, according to the state dashboard that is tracking the pandemic across all of California’s 58 counties. Marin and San Mateo were in the red last week.

The color-coded framework for reopening the state determines which businesses can be opened. The assignment of the levels of a county is mainly based on two metrics: the case rate (the number of new cases per 100,000 population adjusted based on the test volume) and the 7-day positivity rate (the percentage of people who test positive for the virus were) all persons who will be tested). In order for a district to switch to the red category, it has to report an average of four to seven cases per 100,000 inhabitants and a test positivity of 5% to 8% on 14 consecutive days.

There is also a third metric, the health equity metric, which the state considers for larger counties. Its purpose is to encourage counties to test for COVID-19 in deprived neighborhoods and to ensure that positivity rates in those neighborhoods do not lag far behind the districts overall quota.

It’s been more than a month since Governor Gavin Newsom canceled the regional home-stay order, allowing the Bay Area counties to reopen several areas of business, including outdoor dining and some indoor personal services like haircuts.
