<p>SAN FRANCISCO (AP) — San Francisco officials said Thursday they have filed a lawsuit against the federal government over its decision to cut funding to a nursing home run by the city and the tight deadline it set to move all patients out of the facility that state and federal officials deemed was providing “substandard care.”</p>
<p>San Francisco City Attorney David Chiu said the order by the federal government to transfer or discharge all patients out of Laguna Honda Hospital by Sept. 13 has denied the city due process and put patients at risk.  He said at least nine patients have died days or weeks after being transferred or discharged and at least three ended up in homeless shelters.</p>
<p>&#8220;We&#8217;re asking the federal government to exert compassion and common sense,&#8221; Chiu said.  &#8220;Between the huge shortage of skilled nursing facility beds, we see potentially very negative consequences&#8221; if the facility closes.  “Individuals will become homeless.  These people have nowhere to go.&#8221;</p>
<p>The city&#8217;s lawsuit filed Wednesday against the US Department of Health and Human Services and Health and Human Services Secretary Xavier Becerra alleges the Centers for Medicare and Medicaid Services, or CMS, imposed an arbitrary closure, requiring the facility to shut down before San Francisco&#8217;s administrative appeals can be decided.</p>
<p>Former City Attorney Louise Renne also filed a class action lawsuit against the state and federal government on behalf of Laguna Honda patients and families.</p>
<p>Last week, federal regulators agreed to pause the transfers after several patients died within days or weeks of being moved from the hospital and rehabilitation center but the deadline to shut down the hospital remains.</p>
<p>CMS terminated its payments to Laguna Honda in April after two patients had nonfatal overdoses at the facility in 2021, and inspectors with the California Department of Public Health declared it to be “in a state of substandard care.”</p>
<p>The federal agency, which pays for care for the majority of the nursing home&#8217;s 700 patients, also ordered the facility to start discharging or transferring its patients ahead of a mid-September mandated closure.</p>
<p>Founded in 1866, the sprawling facility serves people who need long-term care but can&#8217;t afford private nursing homes.  Many of the patients have dementia, drug addiction and other complex medical needs.</p>

<p>SAN FRANCISCO — A nursing home run by the city of San Francisco will stop discharging patients as part of a federally-mandated closure plan after at least four patients died within days or weeks of being moved from Laguna Honda Hospital, officials said.</p>
<p>In April, the federal Centers for Medicare and Medicaid Services terminated its payments to Laguna Honda after two patients had nonfatal overdoses at the facility in 2021, and inspectors with the California Department of Public Health declared it to be “in a state of substandard care. ”</p>
<p>The federal agency, which pays for care for the majority of the nursing home&#8217;s 700 patients, also ordered the facility to start discharging or transferring its patients ahead of a mid-September mandated closure.</p>
<p>On Thursday, regulators agreed to pause the transfers, San Francisco&#8217;s Department of Public Health said in a statement.</p>
<p>San Francisco Department of Public Health is working to get the nursing home recertified ahead of a Sept. 13 closure deadline but it is still required to transfer or discharge all patients according to a closure plan.</p>
<p>The city, supported by San Francisco representatives in Washington, including Sen. Diane Feinstein, asked the federal Medicare and Medicaid agency to pause all transfers from Laguna Honda Hospital, saying it has been a challenge to find places that can care for the patients&#8217; complex health care needs.</p>
<p>Until Thursday, Laguna Honda had transferred or discharged 57 patients, including a few to homeless shelters.  At least four patients died within days or weeks of being moved from Laguna Honda, the San Francisco Chronicle reported.</p>
<p>The transfers and discharges will be paused “while an assessment occurs over the coming weeks,” US Centers for Medicare and Medicaid Services Administrator Chiquita Brooks-LaSure told the newspaper, adding that the agency posted a representative there on Tuesday.</p>
<p>Founded in 1866, the sprawling facility serves people who need long-term care but can&#8217;t afford private nursing homes.  Many of the patients have dementia, drug addiction and other complex medical needs.</p>
<p>&#8220;Laguna Honda has served San Francisco&#8217;s most vulnerable residents for 150 years and we plan to do so for another 150 years,&#8221; Roland Pickens, Laguna Honda&#8217;s interim CEO, said in a statement.</p>
<p>Sen. Diane Feinstein in May called on Health and Human Services Secretary Xavier Becerra to reverse the federal agency&#8217;s decision to terminate Laguna Honda Hospital&#8217;s participation in Medicare and Medicaid programs and force the relocation of its vulnerable patients.</p>
<p>Feinstein said Friday that the hospital provides services for many patients who have no other options and that she hopes the federal agency works with the city of San Francisco to make the necessary improvements at the hospital so it can rejoin the Medicare and Medicaid programs.</p>
<p>&#8220;If (Centers for Medicare and Medicaid Services) does not reverse its decision, these patients would again be put at risk as they&#8217;re transferred to other facilities,&#8221; she said in a statement sent to homeless shelters ill-equipped to provide the necessary medical services.”</p>
<p>Pickens wrote in a letter to patients and their families that it&#8217;s not clear how long the transferring and discharging of patients will be suspended.</p>
<p>“We know the uncertainty is challenging but we hope this pause provides our community with relief,” he wrote.</p>

<p>LARKSPUR (BCN / CBS SF) &#8211; A former qualified care facility in Larkspur is being viewed as a potential new project home key location for housing the currently homeless.</p>
<p>City officials are working with Marin County and Episcopal Community Services on a grant application under the state&#8217;s Project Homekey program to convert the 1251 S. Eliseo Drive facility into 43 “permanent supportive housing” units for single adults in the county are homeless.  According to a joint statement released on Tuesday.</p>

<p>“This development is a win-win situation.  It is revitalizing an unused property and providing much-needed housing for some of Marin’s most vulnerable people, ”said Kevin Haroff, Larkspur Mayor.</p>
<p>In addition to housing, the location would offer a range of services including case management, mental health, educational and career programs.</p>
<p>Episcopal Community Services is currently negotiating the purchase of the building, which is located on an idyllic stretch of Corte Madera Creek and will also serve as operator of the facility.</p>
<p>Officials plan to submit the grant application in early October.</p>

<p>The project is undergoing an &#8220;exhaustive review process&#8221; during which organizers will seek public opinion, according to Tuesday&#8217;s announcement.</p>
<p>Should the state funding come through, the Episcopal Community Services, the city and the district plan to form an advisory group in which representatives of all three organizations as well as actors from the neighborhood and people “who have lived homelessness” are represented.</p>
<p>While cost estimates are still in the early stages and could change, the total price is estimated at around $ 20.5 million, with the county bringing in about $ 8 million and the remainder coming from the state, according to ECS spokesman Alex Tourk.</p>
<p>If all goes well, the new enclosures could be operational by the end of 2022, Tourk said.</p>

										<content:encoded><![CDATA[<p>SAN FRANCISCO (KGO) &#8211; San Francisco&#8217;s Laguna Honda Hospital, the largest qualified nursing home in the state, continues to report the lowest COVID-19 death rate in the Bay Area for a facility of its size.</p>
<p>&#8220;The city made the decision very early on to take aggressive action against the pandemic,&#8221; said Michael Phillips, CEO of Laguna Honda.</p>
<p>Phillips is promoting the San Francisco Public Health Department&#8217;s early and aggressive approach to protecting the 715 residents of Laguna Honda in the Twin Peaks neighborhood.</p>
<p>Laguna Honda serves the city&#8217;s most vulnerable residents who cannot afford private care.  The facility was hit by a COVID-19 outbreak in late March and immediately quarantined.  Within a few weeks, CDC nurses, doctors, and epidemiologists came to infection control to help.</p>

<p>&#8220;It was so important to ask for that help, not just to ask it, but to get it,&#8221; said Phillips.</p>
<p>The hospital reported 11 new cases of COVID from this recent surge of 309 active cases in long-term care facilities across San Francisco County, according to Phillips.</p>
<p>&#8220;Although we saw the number of employees increase during the surges, we haven&#8217;t seen an increase in the number of residents,&#8221; said Phillips.</p>

<p>Of the 715 residents of Laguna Honda, only 5% or 33 residents have tested positive since March.</p>
<p>In total, there are more than 1,700 healthcare workers in the hospital, approximately 6% or 103 employees have tested positive for COVID-19.</p>
<p>&#8220;One of the answers from the nursing home industry is that it&#8217;s just not possible for facilities to defend themselves against the virus. It&#8217;s too expensive, it&#8217;s just not possible, people are going to die,&#8221; said Mike Dark, an attorney in California for the reform of the nursing home.  &#8220;We know from Laguna Honda&#8217;s experience that this is not true.&#8221;</p>

<p>Cal Hospital Compare, working with UCSF, found that the number of patients in California nursing homes who are sick or dying from COVID-19 more than doubled between May and August.</p>
<p>The analysis of 800 facilities found that the size of the nursing home and the number of patients played a role in the mortality rate.  But that didn&#8217;t happen at Laguna Honda.</p>
<p>The hospital reported it wasn&#8217;t death until December 11, ten months after the pandemic.  To put it in perspective, this is one of the 100 or so nursing home deaths reported across San Francisco County.</p>
<p>&#8220;It is possible, like Laguna Honda, to get on early and do a lot of hand washing training to ensure staff understand how to prevent the virus,&#8221; said Dark.  &#8220;If that happens, they can be effective in preventing people from dying.&#8221;</p>
<p>According to Phillips, trust in his employees played a big part in their success in taking extra precautions outside of the hospital to keep everyone safe.</p>

<p>SAN FRANCISCO, CA &#8211; As health facilities continue to battle the coronavirus, several nursing homes in San Francisco were recently recognized for their excellent care in the months leading up to the pandemic.  This comes from a new ranking by US News &#038; World Report. </p>
<p>The list of Best Nursing Homes for 2020-21 features more than 15,000 nursing homes serving 1.3 million people in the United States. </p>
<p>The purpose of the annual list of the best nursing homes, according to US News, is to help Americans better understand their options when choosing a nursing home for themselves or a family member. </p>
<p>This year&#8217;s list rated 13 facilities in San Francisco and a total of 1,193 in California.</p>
<p>To create rankings, US News analyzed public data available through the Centers for Medicare &#038; Medicaid Services.  The researchers examined statistics on care, health inspections and staffing levels for COVID-19 outbreaks, vaccination rates for flu and pneumonia, infection control violations, and more. </p>
<p>The data used in this year&#8217;s ranking represented periods between 2017 and 2019. The complaint rate was the only measure that used data from the first three months of 2020. </p>

<p>Each facility was then rated on the quality of long-term and short-term care.  The ratings range from high performance to below average.  Facilities also received an overall rating on a scale of 1 to 5, with 5 being the highest rating. </p>
<p>Out of more than 13,400 nursing homes rated for long-term care, 1,139 were rated as performing.  More than 14,100 facilities received a short-term rating, of which 2,362 apartments received a high-performance rating. </p>

<p>This year, California has the highest number of top-ranked nursing homes on the list.  A total of 215 nursing homes in California received a high-performing short-term rehabilitation rating and 135 facilities were rated high-performing long-term care.</p>
<p>Florida, Illinois, and New Jersey follow California for the highest number of nursing homes with the highest ranking. </p>
<p>To help Americans evaluate their best long-term and short-term care options, the U.S. News also added a patient safety summary to each facility&#8217;s profile this year, including self-reported COVID-19 cases, safety measures taken and other related guidance includes the pandemic. </p>
<p>In addition to this year&#8217;s rankings, the U.S. News also released companion studies that focused on the safety of nursing home patients during COVID-19 and what to expect when nursing homes resume their personal visits. </p>

<p>SACRAMENTO (CBS SF / AP) &#8211; State and local officials, including Attorney General Xavier Becerra, filed a lawsuit against the country&#8217;s largest operator of retirement homes on Monday.</p>
<p>The suit focuses on Brookdale Senior Living Inc.&#8217;s 10 qualified care facilities in California.</p>

<p>The company put the health of &#8220;tens of thousands&#8221; of patients at risk, forcing families to find new homes quickly by not giving at least 30 days&#8217; notice of misses or layoffs required by skilled care facilities.  It is also said that the company did not adequately prepare patients for discharge or transfer.</p>
<p>One was an 80-year-old man with Alzheimer&#8217;s disease, heart failure and five other conditions who was released without proper notice or discharge plan, the lawsuit said.  He was hospitalized within a week.</p>
<p>A 78-year-old man who suffered from heart and kidney disease, had difficulty walking and was recovering from pneumonia was also released without notice or plan.  A catheter was used to administer drugs that were still in his body.  His family was not told how to give his medication or oxygen.</p>
<p>&#8220;Brookdale is doing this so it can fill its beds with residents who are making more money,&#8221; the suit claims.  It said the company will fire patients when their Medicare coverage ends &#8220;regardless of care and treatment needs&#8221; instead of keeping them and receiving lower reimbursement rates.</p>
<p>The company released the following statement in response on Monday afternoon.  &#8220;</p>
<p>“We are aware of this lawsuit filed by the State of California against Brookdale today and similar lawsuits filed or threatened against other qualified care providers.</p>
<p>We categorically deny that Brookdale committed willful or fraudulent behavior.  We are disappointed with the allegations against the skilled care industry.  Posting unproven allegations is ruthless and undermines public confidence in a service necessary to care for the elderly, especially during the COVID-19 pandemic.</p>
<p>Brookdale is committed to providing high quality care to our residents and patients, and we take seriously our mission to enrich the lives of those we serve.  &#8220;</p>

<p>The Tennessee-based company operates in 43 states.  It is said there are 726 independent residential, assisted living, memory, and retirement communities capable of serving approximately 64,000 residents.</p>
<p>The lawsuit alleges that Brookdale has also provided the Centers for Medicare &#038; Medicaid with false information that is used to assign “star ratings” (a one to five star rating) to help consumers choose a quality facility.  Each facility receives an overall rating and a rating for inspections, staff, and quality of care.</p>
<p>The company overrated its nursing staff hours and received unjustified four- and five-star ratings, the lawsuit said.  It is alleged that the practice violated both the Unfair Competition Act and the False Advertising Act.</p>
<p>&#8220;We blame Brookdale for artificially increasing its profits by cutting back on the rendition or discharge of its patients,&#8221; said California Attorney General Xavier Becerra, who responded to Senate confirmation for the Secretary for Health and Human Services in the Biden Administration is waiting.  &#8220;It lured individuals into its facilities through false promises of the highest quality.&#8221;</p>
<p>The rating system was the subject of a long, critical story in the New York Times on Saturday.  According to the newspaper, nursing home companies misled the star rating system in a way that hid long-running problems and was not prepared for the coronavirus pandemic, which was widespread among their vulnerable elderly and sick populations, killing more than 130,000 residents.</p>
<p>The rating system was especially important for families during the pandemic when they often couldn&#8217;t visit facilities in person, the newspaper said.  One of the concerns cited is a lawsuit filed by a former resident of a facility in Brookdale, Kentucky.</p>
<p>The company has California care facilities in Bakersfield, Camarillo, Carlsbad, Northridge, Rancho Mirage, San Diego, San Dimas, San Juan Capistrano, Santa Rosa, and Yorba Linda.</p>
<p>The lawsuit was led by Kern County District Attorney Cynthia Zimmer, who said in a statement that when nursing home companies break the rules, “create environments where the most vulnerable among us are exposed to unnecessary victimization, stress and even physical harm are.&#8221;</p>
<p>She was joined by attorneys from Alameda, San Diego, and Santa Cruz counties, as well as Los Angeles attorney Mike Feuer.  The lawsuit seeks a permanent disposition that requires better practices as well as $ 2,500 civil penalties for each violation of the Business and Occupation Code identified in the lawsuit.</p>

<p>SAN RAFAEL (CBS SF) &#8211; After suffering a stroke in January, a 79-year-old grandmother was placed in the care of the Smith Ranch Skilled Nursing &#038; Rehabilitation Center in San Rafael. </p>
<p>The family says she was abused and neglected during her two week stay.  Photos and videos provided by the KPIX 5 family show bruising on one of the patient&#8217;s arms.</p>

<p>The family says it was in the hands of an employee who hit her grandmother with a call light button.</p>
<p>&#8220;It was extremely heartbreaking because I know my grandmother is paralyzed on the left side of her body and she cannot move on her own,&#8221; said granddaughter Virginie Huang.  &#8220;So she can&#8217;t defend herself if someone hits her.&#8221;</p>
<p>Huang says when her mother reported it to the facility, staff suggested that the patient may have caused her own injuries.</p>
<p>Her grandmother spoke in Cantonese on a cell phone video and told how the nurse hit her.  She suffered injuries to her only working arm, making it difficult for the family to believe that she had beaten herself. </p>
<p>Huang says there were other negligent incidents during her grandmother&#8217;s brief stay, including three falls from her bed. </p>
<p>&#8220;She crawled over to a closet and started beating it. She said &#8216;Help me, help me&#8217; and no one came for over an hour,&#8221; she said. </p>
<p>Huang added that her grandmother was also given boiling water to drink. </p>

<p>At the very least, the family wants an apology and the responsible staff to be held accountable.</p>
<p>&#8220;I just wish none of this had ever happened and people weren&#8217;t so angry,&#8221; said Huang.</p>
<p>A statement from the Smith Ranch Skilled Nursing &#038; Rehabilitation Center reads:</p>
<p>“The Smith Ranch Skilled Nursing &#038; Rehabilitation Center is dedicated to providing high quality care for the health, wellbeing and safety of all of its residents.  We do not tolerate any form of abuse.  All Smith Ranch employees are statutory reporters and receive ongoing training in abuse prevention, identification, and appropriate response to allegations of abuse.  All abuse allegations are thoroughly investigated and reported to the relevant authorities.  Due to data protection laws and respect for our residents and employees, we are unable to comment on specific allegations.  &#8220;</p>
<p>KPIX 5 also contacted the San Rafael Police Department.  Your statement reads: </p>
<p>“The San Rafael Police Department takes reports of this kind very seriously.  We have assigned a detective to this case to investigate all aspects of the case.  We will also work with Adult Protective Services and the Ombudsman to utilize all the resources available to us.  If we can determine that we have a likely cause for arrest in this case, it will happen.  &#8220;</p>
<p>&#8220;The reason people should care is because it can happen to anyone, any grandparent, any parent, or even you if you are older,&#8221; Huang said.  &#8220;And it&#8217;s a terrible, disgusting thing.&#8221;</p>

<p>The family says they have since moved their grandmother to a care facility in San Francisco.  So far, she&#8217;s doing better mentally and physically.</p>
