<p>While the SFPD has apparently accelerated the pace of its years of reform efforts after the state&#8217;s criticism of its slow progress, the last stragglers on the list of 272 reform recommendations by the Ministry of Justice can take up to four years to implement, according to the SFPD&#8217;s monthly update to the police commission from Wednesday.</p>
<p>The Police Commission appears to have taken a more laissez-faire approach to holding the SFPD accountable for the reforms first unveiled in 2016, but this timeline, while not surprising, is as problematic as ever, according to former ACLU Police Practice Attorney John Crew. </p>
<p>&#8220;The big picture is that SFPD appears to be much more intent on doing major police reform than actually doing the most important parts of it,&#8221; Crew said of the department&#8217;s update. </p>
<p>The Collaborative Reform Initiative includes 272 recommendations to the SFPD in a 2016 report by the US Department of Justice. Supervision of the department&#8217;s progress was transferred to the California Department of Justice after the Federal Department of Justice withdrew from the program under then-President Trump. </p>
<p>In the past year, over 120 reforms achieved &#8220;substantial implementation&#8221; and the total number implemented and implemented rose to 193 this summer &#8211; progress was announced in front of the Police Commission on Wednesday evening.  Another 60 are waiting for external approval.  The reforms cover five categories: violence, bias, citizen police, accountability and recruitment, recruitment and retention. </p>
</p>
<p>&#8220;The work really rests on our collaborative reform partners right now,&#8221; said Catherine McGuire, executive director of the SFPD&#8217;s Strategic Management Bureau, referring to the 59 reforms awaiting external validation by and from the California Department of Justice.  Hillard Heintze will be checked before moving to CAL DOJ.  &#8220;In May there were eleven recommendations for broad compliance and in June six recommendations.&#8221; </p>
<p>However, not all of the work rests with the partners.  Nineteen of the recommendations remain &#8220;in progress&#8221; (not implemented) on the SFPD&#8217;s schedule, according to yesterday evening&#8217;s presentation. </p>
<p>The period of one to four years gives the impression that some critical recommendations, such as regular employee reviews and the obligation to &#8220;review and understand the reasons for the different uses of lethal force&#8221;, will not be implemented anytime soon.  And the timetable for the reforms has already been postponed several times, so that these estimates by the SFPD are uncertain. </p>
<p>Recommendation 27.5 suggested that &#8220;all officials and supervisors should receive full bias and cultural literacy training within 18 months of the publication of this report.&#8221;  That reform was essentially implemented in March, almost five years later.  Recommendation 39.4 encouraged the SFPD to analyze its training needs and develop a training plan within 9 months of the original report in 2016.  Today this reform still needs external validation. </p>
<p>The police, Crew said, show no sense of urgency to complete all reforms.  &#8220;It&#8217;s all decontextualized how an unreformed police agency actually affects the people on the street, affects communities, and affects generations of San Franciscans.&#8221;</p>
<p>The three reforms expected to take the longest all fall into one category: Over the next three to four years, the SFPD expects to address the finding 20 that “the SFPD does not have enough data on arrests and Use of violence recorded to have strong scientific analysis. &#8220;In other words, it is difficult to assess whether incidents of violence are more common among racial minorities.</p>
<p>When asked why it will take so long to implement the remaining reforms, McGuire said, &#8220;This planning process has to happen first, then there is a procurement process, and then there is an implementation process.&#8221;  She stressed the need to ensure that the system &#8220;is really well implemented and takes into account the needs of our department and other departments that we know our systems are integrated with&#8221;.</p>
<p>&#8220;This whole idea that you need perfect data before you can respond to the problem of disparities is just a pretext for not acting at all,&#8221; said Crew. </p>
<p>All three recommendations for finding 79 also appear in the timeline as one and a half years not yet completed.  It says: &#8220;The evaluation of employee performance is not an institutionalized practice in the SFPD.&#8221;  The reform ideas in this area are not new: the reforms require staff reviews around twice a year and the use of performance reviews as a factor in promotions. </p>
<p>Calling the employee assessment reforms “both fundamental and extremely significant”, Crew said, “The culture of this department is not to see these as problems, not to intervene… when [employee evaluations were] a priority, it wouldn&#8217;t be 2021 and it&#8217;s on the to-do list. &#8221; </p>
<p>When the reform initiative was launched in 2016, Crew and others, including then-defender Jeff Adachi, warned that collaborative reform would not work in San Francisco, and instead pushed for a &#8220;model or practice&#8221; federal or state agency that would The department could remain legally responsible for changes </p>
<p>This type of intervention may be imminent in San Francisco while reforms have been slow, but the Trump administration has &#8220;stamped out&#8221; the practice.  Now it is up to the city and its officials to push for change. </p>
<p>Last month, three recommendations in the &#8220;bias&#8221; category achieved broad agreement and 23 are awaiting validation by the CAL DOJ, making it the second post-recruitment category with no pending action on the part of the SFPD.  Meanwhile, the violence, policing, and accountability categories each have a handful of recommendations. </p>

<p>And despite obvious progress, sustainability and accountability for the reforms implemented are still in the air, as Police Commission President Malia Cohen said on Wednesday.  &#8220;Without sustainability, this is a kind of check-the-box exercise.&#8221; </p>
<p>Review and improvement loops are often part of the compliance measures for the various recommendations that can ensure improvements are made, and Cohen noted that &#8220;CAL DOJ advised it that there is not a really solid, thorough plan&#8221; for sustainability measures for the various reforms there. </p>
<p>When asked how progress on reforms would be tracked by the SFPD, McGuire said that an automated system that inventories and checks in all of these review loops is weeks away from being rolled out.  It is unclear to what extent this information will be made publicly available. </p>

<p>The Houston Texans&#8217; decision to sign veteran journeyman Tyrod Taylor earlier in the off-season was not necessarily seen as a harbinger of things to come.  The signing could have taken place under star quarterback Deshaun Watson, who asked for a deal.  But that&#8217;s pretty much the extent. </p>
<p>Fast forward a few months and that&#8217;s no longer the case.  After the first selection in the 2021 NFL Draft for former Stanford quarterback Davis Mills, it is firmly believed that the Texans are different from Mr. Watson. </p>
<p>“Teams I&#8217;ve spoken to in the league are finding that the Houston Texans are slowly departing from Deshaun Watson because they have their bridge quarterback in Tyrod Taylor and their development draft pick in Davis Mills, a quarterback I &#8216;.  I&#8217;ve said they get on really well with his instincts, intelligence and big arm, &#8220;ESPN&#8217;s Jeremy Fowler recently noted (h / t Bleacher Report). </p>
<p>All of this has an obvious background.  Rumors of Watson&#8217;s dissatisfaction with the Houston Texans gave way back in March to a more notable story in which the quarterback was accused of sexual assault.  Since then, women north of 20 have made similar allegations in civil cases. </p>
<p>While the legal situation has not yet been resolved in a civil court, the Houston Police Department has launched a criminal investigation into the allegations.  Meanwhile, Roger Goodell and the NFL have launched their own investigation under the guise of the Code of Conduct.</p>
<h2>Did the Houston Texans show their hand with Deshaun Watson? </h2>

<p>With no selection in either of the first two rounds of the 2021 NFL Draft, Houston surprised the crowds by putting Mills at the top of the third round.  While viewed as a project, don&#8217;t use that type of draft capital on a quarterback &#8211; they keep nothing but a backup. </p>
<p>These Texans not only added Taylor and Mills, but also traded for Ryan Finley from the fourth round of the Cincinnati Bengals.  That&#8217;s three new quarterbacks in the mix months after Houston new general manager Nick Caserio even resisted the possibility of trading with Watson.  Houston could be gearing up for some end of NFL action when it comes to Watson. </p>

<p>It is more than likely that Watson will be put on the commissioner&#8217;s exception list later this summer in case the legal situation does not peak in the near future.  At this rate, there is no reason to believe that Watson&#8217;s legal team will reach an out-of-court settlement.  This will lead to a lengthy process. </p>
<p>Recent reports have shown that Watson is likely to be suspended from the NFL before the legal situation in the Houston area emerges.  The league reserves the right to suspend a player without charge in a criminal court or conviction.  That is another important setting. </p>
<p>Should Watson be cleared of these allegations in time for the start of the 2021 NFL season, there is now every reason to believe the Texans will have trade talks with teams.  That market could also be curtailed after interested teams from the San Francisco 49ers (Trey Lance), Chicago Bears (Justin Fields) and New England Patriots (Mac Jones) added quarterbacks to the first round of the 2021 NFL Draft. </p>

<p>The private schools in San Francisco are quickly reopening by the dozen, while the public schools in San Francisco are moving more cautiously towards reopening with a long checklist.</p>
<p>The Ministry of Health had granted a personal waiver to six of 83 interested schools on Wednesday, and another 12 schools were in the final stages of a pre-approval site assessment, according to a data tracker launched on Tuesday.</p>
<p>In contrast, the San Francisco Unified School District this week established a &#8220;decision tree&#8221; for several milestones and health plans that are required before it reopens.  Some of these are prepared, but they are unlikely to grow together in the near future.</p>
<p>&#8220;All of this is not sequential, but we must have all of this to resume personal operations,&#8221; SFUSD Superintendent Vincent Matthews said at a Board of Education meeting Tuesday.  &#8220;We don&#8217;t just want to open to shut down.&#8221;</p>
<p>In order for all students to return, The City must remain on the California coronavirus red stage for 14 consecutive days, changing the order of on-site placement, and re-ordering personal surgeries and instructions, which it currently does.</p>
<p>The first phase of the district&#8217;s hybrid reopening plans, known as Phase 2a, consists of small cohorts that prioritize students with moderate or severe disabilities, grades from pre-kindergarten through first grade, and early education in standalone locations.  That could be 500 to 1,000 students in about 15 locations.</p>
<p>Board chairman Mark Sanchez said he believed these groups could return by the winter break.</p>
<p>However, the city&#8217;s coronavirus testing capacity could limit the number of returning students and staff.  All employees must undergo staggered testing every two months as part of the plan where the district is reviewing an agreement with Kaiser Permanente.</p>
<p>&#8220;We&#8217;re currently unsure of how many tests there will be if The City has the capacity,&#8221; said Sanchez.  “That could limit the number of staff and students who can come back.</p>
<p>In Phase 2b, pupils with limited online engagement and the homeless would join and promote young people, which would expand personal learning from 2,500 to 15,000 pupils in around 60 locations.  SFUSD has approximately 57,000 students.</p>
<p>SFUSD also needs a plan to support students at increased risk of infection, assess classroom ventilation and reorganize classroom furniture, and a new memorandum of understanding with the unions.  The negotiations have started.</p>
<p>&#8220;We are ready and able to come to the negotiating table as often as necessary,&#8221; said Susan Solomon, president of United Educators of San Francisco, to the school board on Tuesday.  “Very, very few people prefer remote crisis learning.  We are not trying to avoid teaching in person &#8211; we prefer it very much &#8211; but we have to be safe and we need funds for our schools.  &#8220;</p>
<p>SFUSD also needs curricula such as a community health pledge, new doorbell plan, after-school activities, outdoor classes, and technology plans.  General health and safety requirements also include having students screened every morning, signage posted, meals served in smaller settings, and requiring facial covers for third grade students and above and more in a strict regime.</p>
<p>The district has a three month supply of personal protective equipment and cleaning supplies, desktop partitions, and a schedule for repeated closings.</p>
<p>Convent &#038; Stuart Hall, a Sacred Heart school with approximately 1,100 students enrolled in K-12 classes, just got the exemption on Wednesday but was ready with an improved HVAC system, UV disinfectant, and other precautions to start.</p>
<p>Many of the private schools also have no unions.  Sanchez, a third grade teacher in Daly City, said he was personally grateful to have a union that helps protect the safety of staff and students.</p>
<p>&#8220;It is clear that private schools outside of parishes have resources that public schools do not,&#8221; said Sanchez.  “You also have a smaller number of students.  In general, it is easier for them to manage a reopening than it is for a large complex district like SFUSD.  &#8220;</p>
