SAN FRANCISCO (CBS SF) — A man who police said assaulted and robbed an elderly man in San Francisco, and later that same day carjacked and partially ran over an elderly woman, has been taken into custody, police said Tuesday.

Both incidents happened on April 10, the first at about 10:26 am in the area of ​​Leavenworth and Eddy Streets in the city’s Tenderloin District. An 81-year-old man told officers he was walking on the sidewalk when he was aggressively approached by an unknown male who aggressively asked for money. After the victim declined, the suspect pushed him to the ground and robbed him of his belongings, police said.

The victim was treated for his injuries at a local hospital and released.

San Francisco’s district attorney said police used a database with DNA collected from victims of rape and sexual assault to connect some of them to crimes.

Dist. atty Chesa Boudin said Monday that the San Francisco Police Department crime lab had been using the database to “attempt to subsequently incriminate” victims of rape and sexual assault in connection with unrelated cases, a practice he called “legally and ethically wrong.”

The district attorney called for an immediate end to the alleged practice, committed to working with police to address the allegations and urged changes to local and state laws, his office said in a statement.

“I am disturbed that victims who have the courage to undergo an invasive examination to help identify their perpetrators are being treated like criminals rather than supported as crime victims,” ​​Boudin said. “We should encourage survivors to come forward — not collect evidence to use against them in the future. This practice treats victims like evidence, not human beings.”

Boudin alleged DNA evidence collected from a rape victim was later used to identify and arrest her as a suspect in an unrelated crime, according to a police statement Monday.

A source with knowledge of the case told The Times on Tuesday that Boudin dismissed it due to a possible violation of the 4th Amendment, which protects against unreasonable searches and seizures.

The case involved a recent property crime, according to the district attorney’s office.

Police officials and Boudin’s office have largely kept mum about the specifics.

Neither police nor prosecutors would provide further details about the alleged property crime, including what specific kind of crime is suspected to have occurred and when it occurred.

Police spokespeople provided a statement issued Monday by Chief Bill Scott but declined to answer questions.

The chief said that if DNA collected from a victim of rape or sexual assault was used to identify and arrest a person as a suspect in another crime, he was “committed to ending the practice.”

Existing DNA collection policies have been legally vetted and are in line with state and national forensic standards, Scott said.

“However, there are many important principles for which the San Francisco Police Department stands that go beyond state and national standards,” he said. “We have long embraced sanctuary for our undocumented immigrant communities, for example, and we years ago ended the practice of using condoms as evidence in prostitution cases.”

The chief said the department will immediately start reviewing DNA collection practices and policies and that he has consulted with San Francisco City Atty. David Chiu.

There is a possibility the suspect was identified through a DNA match to evidence in a “nonvictim DNA database,” Scott said.

But Boudin’s questions were “sufficiently concerning” that the chief said he asked his assistant chief of operations to conduct a thorough review.

“Whatever disagreements Dist. Atty. Boudin and I may have, we agree that this issue needs to be addressed,” Scott said. “At the end of the day, our respective departments exist to do justice for victims of crime. The last thing we should ever do is discourage their cooperation with us to accomplish that.”

State officials and organizations that work with victims of rape and sexual assault also spoke out Monday.

Pamela Tate, co-executive director of Black Women Revolt Against Domestic Violence, said the database cannot be considered a “blanket waiver” of victims’ rights to not self-incriminate.

“This type of misrepresentation will have a chilling effect on Black women and women of color in reporting crimes of sexual assault,” Tate said.

The legal system isn’t designed to support survivors of sexual violence, said KellyLou Densmore, director of the San Francisco Office of Sexual Harassment and Assault Response and Prevention.

“Many survivors already choose not to share their experiences, particularly transgender people and cisgender women of color, LGBT people and other marginalized groups who may distrust police and face other significant barriers to receiving support after sexual assault,” Densmore said.

Michael Risher, a civil rights attorney who works with the American Civil Liberties Union of Northern California, said the alleged practice violates victims’ privacy.

Federal law prohibits law enforcement from uploading sexual assault victims’ DNA samples into the national Combined DNA Index System, which is used to match DNA from crime scenes with samples taken from people convicted of or arrested for crimes, Risher said.

“Local agencies that maintain separate databases should follow this sensitive rule to ensure that victims’ DNA is not retained and used for unrelated purposes,” he said. “This is especially important for California law enforcement agencies like SFPD because, unlike the federal Constitution, the California Constitution expressly protects privacy rights and victims’ rights.”

After a sexual assault is reported, victims are asked to undergo an examination in which evidence is collected from bodily fluids, fingernail scrapings, and any bite or scratch marks, Boudin’s office said.

“The victim submits their own DNA sample in order to exclude DNA that comes from the victim, as opposed to the suspect,” according to the statement.

But research shows only a small percentage of victims go through sexual assault testing, an invasive and traumatic process for many survivors, prosecutors said.

“Victims of sexual assault consent to their DNA collection for this purpose, not so that their DNA will be retained in a local law enforcement database permanently to be searched years later,” prosecutors said. “Using victims’ DNA in order to potentially incriminate them in the future further dissuade sexual assault survivors from undergoing what is already a very difficult and emotional process.”

State Sen. Scott Wiener (D-San Francisco) and San Francisco Supervisor Hillary Ronen also condemned the alleged practice.

Wiener said he was working with Boudin’s office to address the issue with state legislation “if needed.”

Ronen said she asked Chiu to draft legislation to prevent any kind of evidence from a victim’s rape kit, including DNA, from being used for anything other than investigating that case.

“Unfortunately, the city’s response was not as urgent as I think it should be. The victim services are divided into several departments, each with their own tasks and mandates. Sanchez also allegedly claimed to be a drafted immigration adviser with the California State Department office and showed an expired note deed in her office.

According to state records, Sanchez did not have approval from the Secretary of State or the State of California. Sanchez received a cease and desist letter from state officials in 2018.

On Saturday, Sanchez turned himself in to a bail officer. She is charged with aggravated theft, theft on false pretenses, and violations of the Immigration Consultant Act.

At first it was not known when Sanchez would appear in court.

MPs said the alleged victims of Sanchez are working with immigration lawyers to gain citizenship.

According to the sheriff’s office, an immigration officer must have a $ 100,000 bond, undergo a background check, and file a disclosure statement with the Secretary of State. Immigration advisors are not lawyers, cannot provide legal advice, and are required to notify clients.

CARLISLE, Pennsylvania (WHTM) – A Carlisle man was arrested after multiple fraud victims came forward saying they paid him to do handyman services and did not show up, according to Pennsylvania State Police.

Mike C. Kalinich was arrested for theft and contractor fraud for incidents dating back to 2019. The victims said they paid him for services including repairing roofs and tiles, mowing grass, repairing lawn mowers and cars in Cumberland County, among others. They said he never showed up to do these services.

The police mentioned that Kalinich had been sued by people in a civil court and sentenced to pay, but refused to do so.

According to police, Kalinich did not have a contractor license and operated small businesses in the area, including RCK Enterprise and K&M.

The complex of five two-bedroom apartments is the result of years of advocacy from survivors of intimate partner violence and organizations that work with them. Their efforts enabled women like Dyer to obtain their release through grace or by retrospectively presenting evidence of their abuse to the state probation board or the courts.

“The fact that women subjected to unspeakable violence were not allowed to produce evidence of abuse is the essence of injustice,” said Sunny Schwartz, founder of Five Keys. “Our goal was to create a living, dignified and safe home, a place that says, ‘You are worth it.’ ”

Previous transitional housing options for women were largely limited to addicts. Home Free on Treasure Island, a former naval base in San Francisco Bay, was forged with a tight starting budget of $ 750,000 including staff during last year’s pandemic. The formerly dirty apartments were renovated with the help of almost 100 volunteers – architects and landscape architects, floor and furniture installers, plumbers, freight forwarders, electricians and urban construction apprentices. The landscape itself was designed by Hyunch Sung from Mithun, who selected 10 different tree species. Sung said she approached her work there like designing for high-end customers. “The idea of ​​beauty is underestimated for disadvantaged communities,” she said.

Nilda Palacios, 38, who lives upstairs, said it was “emotionally moving” to join the complex. She grew up with a history of abuse: she was abused by an uncle and stepfather as a child and then raped by a high school teacher when she was 15. The stressful trial against the teacher led her to rely on drugs and alcohol (“I’ve tried to sleep through my life,” she said). Palacios became desperate and suicidal. One day when a beggar cornered her, she said she thought he was going to attack her and “whipped” him and strangled him. She was convicted of second degree murder. She was incarcerated for 17 years and benefited from therapists in prison who helped her understand “how the depth of my crime was related to my story,” she said. “I mistook someone who wasn’t a threat for someone who was.”

Palacios was released on parole. She has benefited from a broader vision for Home Free that now welcomes women like her whose crimes have been directly linked to their abuse.

When she moved in, she was “shocked” at the prospect of a private bedroom after years of sharing a 2 x 3 meter cell and stuffing all her belongings into a six cubic foot box, as one current inmate puts it , “Your panties right against the noodles and peanut butter.”

“No way, is this my room?” Palacios reminds me. “It felt like a real home to me.”

A way to decent living

The idea for Home Free came about during a conversation between Schwartz, its founder, and the Californian treasurer Fiona Ma, then a state representative. Ma’s law, signed by Governor Jerry Brown in 2012, allowed women who had suffered domestic violence and were convicted of violent crimes related to their abuse to have their cases reported using Battered Women Syndrome (as it was then called) as To have the defense heard. The law also gave them the right to produce evidence of intimate partner abuse during the probation process. It applied to those convicted before August 1996.

The number of Rosemary Dyers still behind bars is unknown. Despite increasing public awareness, “there are still large numbers of defense lawyers who fail to understand how intimate partner violence creates the context for a crime,” said Leigh Goodmark, director of the Clinic on Gender-Based Violence at the University of Maryland School of Law.

In New York state, the 2019 Domestic Violence Survivors Justice Act was put to the test in the high-profile case of Nicole Addimando, a young mother of two in Poughkeepsie who fatally shot her living friend and father, after years of harrowing children in 2017 Abuse (the case is captured dramatically in the documentary “And So I Stayed”).

Sentenced to 19 years of life for second degree murder, Addimando was entitled to a subsequent law hearing at which her allegations of abuse could result in a reduced sentence. The district court judge denied these allegations, believing she had “had the opportunity to leave her perpetrator safely”. In July, the Appeals Division of the State Supreme Court overturned this decision and reduced Ms. Addimando’s term to 7 ½ years.

For Kate Mogulescu, associate professor at Brooklyn Law School and director of the Survivors Justice Project, the case illustrates “the impossible burdens we put on survivors to prove their victimization.” Women are tested very differently in court than men, she added. “Women are bad mothers or promiscuous. Tropics are carried out on women and the penalties reflect this. ”However, 16 women have been convicted again in New York so far.

By far the most common reason why women who have been abused by intimate partners end up in jail are so-called complicity laws, which force a victim to be at the scene of an offender’s violence, for example while driving the getaway car, said Colby Lenz, Co-founder of Survived and Punished, a national advocacy group.

That was the case with Tammy Cooper Garvin, who was sexually trafficked at the age of 14 and jailed for 28 years for sitting in the car while her pimp murdered a customer. Her sentence has been commuted and she has been hired as a housing coordinator by Home Free.

Another advocate – and a driving force behind the founding of Home Free – is a fellow survivor named Brenda Clubine, who founded a weekly support group at the California Institution for Women. About 72 women soon joined. Dyer was one of the original members, though until Clubine encouraged her she was so afraid of life that she could barely speak.

Clubine herself was ill-treated for years, including fractures and stab wounds, by her husband, a former police detective. She hit him on the head with a wine bottle and he died of a blunt violent trauma. She served 26 years of a 16 year prison sentence. Her violent retelling of the stories of the women in the prison squad – which she sent to state lawmakers and governors – led to public hearings and the 2009 documentary, Sin by Silence, which in turn inspired California law.

Clubine’s close friendship with Dyer has continued and is critical to Dyer’s self-confidence. At Home Free, Dyer now indulges in making homemade chicken pasta based on her grandmother’s recipe. Clubine, her best friend, found that a safe and empowering place for her “sisters” has been a long time coming. “I can’t tell how full my heart is that it is available to you now,” she said.

Gee, 23, of Sacramento was one of four Californians killed in the bombing of Kabul airport, where people were evacuated during the Taliban takeover. The blast killed 169 Afghans and 13 US soldiers, including 11 Marines.

FREMONT (CBS SF) – Police are still looking for a run over driver who killed an elderly Livermore man on June 30, leaving his family heartbroken.

The victim’s only child, Howard Sham, 24, said he was struggling with a great loss and an enormous financial burden. He asks the driver to report.

Allen Sham was a 69-year-old father and husband who died a week after being hit by a car on Peralta Avenue near Dusterberry Way before 10:30 p.m.

Police need public help to locate the suspect’s dark limousine, which can be seen in a surveillance photo. The front bumper, hood, or windshield area can be moderately damaged.

“I think I’m more angry than sad because someone just hit you and ran, you know?” Said Shame. “What kind of person does that … that’s my question, what if it were your father?”

Howard Sham lives in San Diego, where he takes a year off to work while studying. He says that before his father lost his job years ago, he was a craftsman and mechanic.

“He was hardworking,” said Sham. “I mean, even when he was out of work, he was still trying to find ways to make money and help. I just know that he did his best. “

At the time of the crash, Sham was pushing a cart full of recyclables and personal items, according to Fremont Police. After the collision, the car stopped briefly, but the driver did not try to look at Sham after hitting him from behind.

Sham said his father may have been collecting cans for cash.

Sham’s mother suffered a stroke at the beginning of the pandemic and is now in a nursing home. He started a GoFundMe page to pay for his father’s funeral and to pay his mother’s medical bills.

While police are still looking for clues to the investigation, a Fremont resident said it is not uncommon to see accidents on this stretch of road.

“The top speed is 25, nobody drives 35,” said Thillaivel Ranganathan. “The average speed is 45-55 mph.”

San Francisco District Attorney Chesa Boudin and the Mayor of London Breed support efforts to fund crime victims and their families.

On Wednesday, The Crime Survivors for Safety and Justice announced a $ 100,000 grant program.

“These are persons on both sides of crime and punishment, by healing those who have been harmed, we can prevent the next crime,” he said.

The announcement comes as another program aimed at breaking the cycle of crime is under scrutiny.

A new report found that more than half of customers re-offend on the pre-trial distraction program that monitors people released from prison while they wait for their day in court.

San Francisco Regulatory Authority Catherine Stefani is calling for more frequent updates to the program and more thorough reports on why high-risk inmates are being released.

She began asking for dates after people in the program committed high-profile violent crimes.

Stefani recently voted against an extension of the million dollar contract.

“What I find so alarming and frustrating is that the pre-trial derivative program had this information and refused to give it to this office when I asked for it,” she said.

Boudin supports the program but says there is room for improvement.

“While this number is worrying and we would like to improve it, it is actually lower than the state prison and if the prison could do as well as the pre-trial distraction we would be moving in the right direction,” he said.
