Many commercial tenants went to court for a pandemic rent break. A Murray Hill law firm can now count itself among the few to have won one.

New York’s Appellate Division ruled that affiliates of landlord ABS Partners Real Estate must credit Wolf Haldenstein, a firm specializing in stocks and antitrust law, over $2 million in rent and legal fees after the office owner failed to complete renovations on the firm’s two floors of leased space.

The HVAC system roared like a “jet engine,” the landlord’s architect said, produced 90-degree temperatures in the summer and failed to circulate fresh air as Covid raged in New York.

The law firm, which has occupied 270 Madison Ave for nearly 100 years, agreed to move temporarily from the ninth and 10th floors to the 11th and 13th when it signed a 12-year lease in 2018.

ABS planned to revamp the heating and air conditioning systems on the two lower floors and agreed in the lease that its tenant would rent the upper floors until an architect deemed the work substantially complete.

The lease included four months of free rent once the firm moved back to the lower floors and a rent credit if renovations took too long. Wolf Haldenstein would receive a daily credit for each day that work continued after February 2020. The rate would jump to a day and a half after April.

Wolf Haldenstein moved back to the ninth and 10th floors in December 2019, ahead of schedule. But the firm immediately questioned whether work had been completed.

“We should have another construction meeting to discuss HVAC problems,” Mark Rifkin, managing partner at Wolf Haldenstein wrote in an email to the job’s contractor on Christmas Eve.

“I think some may have assumed substantial completion before it was done,” he continued. “Had this been summertime, when we need the AC, the space would be uninhabitable.”

In another email to ABS Partners, Rifkin described the floors as excessively hot and the HVAC system as excessively loud.

Those problems continued into 2020. In February, as Covid began spreading in the city, ABS’ construction manager acknowledged in an email that “many ‘existing condition’ items … need to be figured out and resolved.”

James Caseley, an executive at ABS, went so far as to describe the HVAC system as a “disaster” to the landlord’s construction manager in a memo.

The same month, the landlord started work on the 11th and 13th floors, making it impossible for Wolf Haldenstein to relocate to a more hospitable floor.

The HVAC issues lasted through the pandemic, forcing partners, associates, staff and clients, once they returned to the office, to deal with a system that failed to adequately circulate fresh air, according to Scott Mollen of Herrick Feinstein, attorney for the tenant.

In April 2021, Wolf Haldenstein sued ABS Partners, alleging that the landlord’s architect had not declared the work complete, meaning the firm had no obligation to pay rent.

ABS answered a month later, arguing that the law firm had defaulted on rent and owed $1.2 million on its roughly $145,000-per-month lease.

That November, a Supreme Court judge sided with Wolf Haldesstein, ruling the work was incomplete and the firm had no need to pay rent. The Appellate Division upheld the ruling that the landlord should pay a $1.2 million rent credit, $100,000 in moving expenses and $700 .00 in attorney’s fees.

“Much of the unnecessary fees were incurred as a result of landlords’ litigation tactics,” the court noted.

Rosenberg & Estis attorney Alex Estis, who represented ABS, said his legal team appreciated the Appellate Division reduced Wolf Aldenstein’s rent credit award. A lower court had granted the firm an additional $647,869, plus interest.

“We are considering further options in light of the ruling,” Estis added.

The firm’s late co-founder Warren Estis had represented ABS for most of the suit, one of his last. Estis died in April.

Kevin Mullin, a former South San Francisco mayor turned state assembly member, won his bid to represent much of San Mateo County in the House of Representatives, beating out Supervisor David Canepa for the seat being vacated by Jackie Speier.

“It’s an honor and a privilege and I’m thrilled at the opportunity to represent the area,” Assembly Speaker pro Tem Kevin Mullin said on election night while celebrating at Joseph A. Fernekes Recreation Building in South San Francisco.

Mullin captured 57% of the vote with 48,740 ballots cast for him on election night, making him the successor of US Rep. Jackie Speier, D-San Mateo, in California’s 15th district. The district was newly redrawn to replace the 14th District and encompasses the eastern Peninsula from Redwood City up to South San Francisco plus Daly City.

Meanwhile, Canepa, a lifelong Daly City resident who was elected to the Board of Supervisors in 2016 after serving on the Daly City Council, received 36,740 votes, or 43%, according to semiofficial results as of 11 pm Tuesday by the San Mateo County Elections Office.

On the campaign trail, Mullin and Canepa, both Democrats, backed similar platforms by voicing support for universal health care, the Green New Deal, forgiving student loan debt and other progressive policy stances.

But Mullin raked in major endorsements early including from Speier, a fellow South San Francisco native and Mullin’s political mentor, US Rep. Anna Eshoo, D-Palo Alto; House Speaker Nancy Pelosi, D-San Francisco; gov. Gavin Newsom; and supervisors Dave Pine, Carole Groom and Warren Slocum.

Those endorsements, particularly that of Speier, paired with his career as a representative of the area contributed to his success, Mullin said. Looking ahead, Mullin said he has his eyes on the House Committee on Energy and Commerce and House Committee on Transportation and Infrastructure, two bodies tackling issues pertinent to Silicon Valley’s tech industry, while bracing for a potential Republican majority in the House.

“It’s been a long public service journey,” Mullin said, noting his first political job was with Speier. “Having her mentorship and longtime connection has been just invaluable. She’s a daughter of South San Francisco, so there’s a long history of public service in this community.”

Mullin was elected to the Assembly in 2012 and has served as the speaker per tem since 2014. Prior to that, he served on the South San Francisco City Council for five years. A South San Francisco native, he is the son of the late Gene Mullin, a former South San Francisco mayor and assembly member.

Canepa conceded early as results rolled out. In a statement, he shared his appreciation for his team and supporters while wishing Mullin well in Congress.

“Running for Congress has been the most exciting year of my life and I’m so proud of my team. We fought hard and we never gave up. Congratulations to Kevin Mullin, we wish him the very best of luck and look forward to working with him on the most pressing issues our nation faces,” Canepa said in a statement conceding the race.

Eshoo won her reelection campaign to represent California’s newly drawn 16th district, covering the Peninsula coast from Pescadero to Pacifica plus Palo Alto, Saratoga and a sliver of San Jose, with 74,000 votes or 58.6%. Eshoo beat out fellow Democrat and current Saratoga Council member Rishi Kumar who received 52,183 votes, or 41.4%. Kumar faced off against Eshoo for the first time in 2020 when he received 36% of the vote.

State Assemblymember Marc Berman, D-Palo Alto, beat out Republican Tim Dec, a small business owner from Mountain View, to reclaim his seat as a representative of the state’s 23rd district. Berman received 63,566 votes, or 72.4%, while Dec received 24,055 votes, or 27.5%, as of election night.

San Mateo Councilmember Diane Papan will be replacing Mullin as an assemblymember in the state’s 21st district, having received 41,568 votes or 73.9%. Papan was up against Redwood City Mayor Giselle Hale at the start of the campaign but Hale announced her departure from the race after citing the toll it’s taken on her and her family. Hale still received 14,669 votes, or 26.1%.

All results are according to semiofficial results from Tuesday, Nov. 8, which included votes by mail received by Friday, Nov. 4, and all ballots received at voting centers. Later results will include votes received after Saturday, Nov. 5. Post-election results will be released before 4:30 pm on Thursday, Nov. 10, Friday, Nov. 11, Monday, Nov. 14, Tuesday, Nov. 15, Wednesday, Nov. 16, Thursday, Nov. 17, Friday, Nov. 18, Monday, Nov. 21 and Wednesday, Nov. 23. Results will be certified Dec. 8th.

He knocked down Olorunsola to the canvas unconscious in the fourth round with a powerful right hook in the co-main event of Gamebred Boxing in Jackson, Mississippi.

Gore is an NFL veteran who played for five teams in 16 seasons. He last played with the New York Jets 2020. He was drafted by the San Francisco 49ers in the third round in 2005, and stayed with the team until 2014. All his Pro Bowl selections were made during his time with the Niners.

SAN FRANCISCO (AP) — San Francisco Supervisor Matt Haney declared victory Tuesday in a special election for the state Assembly but he will have to run again in June and November to keep the seat.

Haney received nearly 64% of the vote and former Supervisor David Campos had about 36%, according to mail-in ballot returns for the 17th Assembly District special election.

Campos conceded Tuesday evening, telling supporters that “big money has figured out how to win elections …and that’s what happened here.”

Haney significantly outraised Campos, who had pledged to avoid corporate contributions.

Both candidates are on the progressive end of the Democratic Party but Mayor London Breed endorsed Haney and will get to pick his replacement on the Board of Supervisors.

Assembly District 17 covers the eastern half of San Francisco and includes tourist-heavy neighborhoods such as Chinatown, Haight-Ashbury, downtown and the Mission. It also includes the tenderloin, which is a hot spot for homelessness and illicit drug use.

The special election was held because neither Matt Haney nor David Campos received more than 50% of the vote in February’s special election.

Haney will have to run again in the statewide June primary and November general elections to keep the seat for another two-year term, meaning residents of the district could vote on the race up to four separate times this year.

The seat became vacant last year after David Chiu resigned to become San Francisco’s city attorney, a job that became available when Breed appointed then-city attorney Dennis Herrera to head the San Francisco Public Utilities Commission after Harlan Kelly resigned in 2020.

Kelly left after federal prosecutors charged him with fraud for allegedly accepting bribes from a permit expediter in exchange for insider information. Kelly is fighting the charge and is just one of several city officials and contractors ensnared in a public corruption scandal involving former public works director Mohammed Nuru.

NEW ORLEANS — Naismith Memorial Basketball Hall of Famer Bill Self at age 59 has won his second NCAA Tournament title at Kansas, one more than any other Jayhawks men’s coach in the tradition-rich program’s history.

In directing the Jayhawks, the no. 1 seed in the Midwest Regional, to a 72-69 victory over North Carolina, the No. 8 seed in the East Regional, in Monday night’s 2022 title game, Self became the third active men’s coach with multiple national titles. Self’s Jayhawks also won it all in 2008.

The victory at the Caesars Superdome also moved Kansas, which passed Kentucky for the most all-time victories in Division I men’s basketball during the 2021-22 season, past Villanova and into a tie with UConn for sixth in all-time men’s NCAA championships with four.

UCLA remains no. 1 with 11 titles, followed by Kentucky (8), North Carolina (6), Duke (5) and Indiana (5). KU and UConn have four titles, followed by Nova (3).

Cincinnati, Florida, Louisville, Michigan State, North Carolina State, Oklahoma State and San Francisco have won two titles apiece.

The Jayhawks have now won national titles in 2022, 2008, 1988 and 1952. KU also was retroactively awarded Helms Foundation national titles for the 1922 and ’23 seasons. The NCAA Tournament began in 1939.

With the victory, Self joins Villanova’s Jay Wright and Iona’s Rick Pitino, who each led their teams to two NCAA crowns. Pitino, who won a title at both Louisville and Kentucky, had to forfeit the 2013 crown at Louisville because of NCAA sanctions, thus officially has just one title.

Self is now tied for seventh in most men’s national titles by a coach. UCLA’s John Wooden leads the way with 10, followed by Duke’s Mike Krzyzewski, who is retiring with five. Kentucky’s Adolph Rupp has four, followed by Roy Williams (three, all at North Carolina), UConn’s Jim Calhoun (three) and Indiana’s Bob Knight (three).

Mike Yastrzemski hit a triple homer, one of four long balls from San Francisco to help the National League West top Giants beat the Colorado Rockies 7-2 on Friday night and become the first 100-win team to become of the season.

The Giants have achieved 100 wins in 154 games in their fewest games in the live ball era (since 1920). It’s the first time they’ve been the first team in the MLB to win 100 since moving to San Francisco in 1958.

San Francisco leads the Los Angeles Dodgers by 1 game. The Giants won 16 out of 21.

Kervin Castro (1-0) threw two innings for his first major league win, and the Giants hit 100 for the first time since 100-62 in 2003.

“It’s a great achievement, but we’re looking for more,” said San Francisco pitcher Alex Wood.

The Giants haven’t won NL West since 2012 when they won the second of three World Series titles in five years. They were lightly viewed at the start of the season, with the Dodgers and San Diego Padres getting the most attention but surprising many.

“It’s a big deal,” said manager Gabe Kapler of winning 100 games. “We know our division is exceptionally talented, but we also know that we are talented. Our goal was to win the division, not just sneak into the playoffs.”

San Francisco blew the game in seventh place. Yastrzemski was followed individually by Brandon Crawford and Evan Longoria with his 25th homer off reliever Ashton Goudeau (1-1). The Giants put another run on Buster Posey’s RBI single.

Tommy La Stella, Crawford and Brandon Belt had solo home runs to take San Francisco 3-2 ahead after six. La Stella and Crawford had three hits each and Belt ended with two.

San Francisco has 234 home runs, one less than the club’s record in 2001 when Barry Bonds hit 73. The Giants lead the NL in the homers and are second in the majors after Toronto’s 241, although no player has scored more than 27 this season.

Three players – Belt, Crawford and Yastrzemski – have 22 or more players, and seven other players have made double-digit home runs.

“So many of the home runs have been meaningful,” said Kapler. “I can’t help but think of those who changed a game for us. We get contributions from everyone in our squad.”
