Swimmer sues Archdiocese of San Francisco, Faculty of Marin over head damage

A Greenbrae man who claims he was injured by Marin Catholic High School’s water polo program has filed a negligence lawsuit against the Archdiocese of San Francisco and the College of Marin.

According to the lawsuit, David Steinberg used the Novato college pool during a session with the Marin Aquatics Masters swimming club on September 12. Steinberg claims that someone on the water polo team misplaced some “back swimmer flags” warning club swimmers that they were nearing the end of the lane. The complaint alleges that the flags have been moved closer to the pool edge “in violation of national and international standards on where the flags should be displayed”.

“Mister. Steinberg relied on the flag position and swam headlong into the concrete side of the pool at full speed and suffered a concussion,” said his attorney Matt White.

The lawsuit, filed in the Marin County Superior Court, seeks damages for medical expenses and lost profits. A case management conference is scheduled for September 24th.

The college said in a statement released by a spokesperson, “College of Marin is committed to providing a safe environment for users of all of its facilities, including the Indian Valley Campus Pool.”

Jon Heaberlin, an attorney for the archdiocese that runs Marin Catholic High School, declined to comment on the pending litigation.
