Government lawyers used airline executives’ own words in trying Tuesday to persuade a federal judge to kill a partnership between American Airlines and JetBlue Airways.

The government argued that the deal is, in effect, a merger that will cost consumers $700 million a year in higher fares. It said JetBlue’s pending purchase of Spirit Airlines will make matters even worse for travelers.

JetBlue CEO Robin Hayes was the first witness in the trial in federal district court in Boston over the federal government’s antitrust lawsuit against American and JetBlue. The airlines are coordinating schedules and sharing revenue from flights in the Northeast, including New York-area airports.

Hayes was quizzed about his own previous statements criticizing joint ventures involving other airlines and a 2019 comment that the airline industry “has never been more concentrated than it is today,” which he said led to higher fares and poor service.

Hayes testified that regulators had not imposed enough limits on those deals. He contrasted them with the pact between American and JetBlue, which he said involved no cooperation on setting prices.

In another 2019 memo, an American Airlines executive vowed that his company would fight JetBlue for supremacy in Boston — even using a metaphor of swinging baseball bats.

“We know how the story ends,” said William Jones, the lead attorney for the Justice Department. “Rather than continuing to slug it out, American and JetBlue decided to collaborate rather than to continue competing.”

Lawyers for American and JetBlue countered that the government has presented no evidence that their alliance — in place for 18 months now, since it was blessed by the outgoing Trump administration — has harmed consumers or resulted in higher fares. They said that it has allowed the airlines to add 50 new routes and create a stronger competitor to Delta and United.

The airlines’ lawyers said that the Justice Department sued prematurely instead of taking a wait-and-see approach.

“Most cases don’t get brought until there is some tangible evidence that the practices are doing harm,” said Daniel Wall, a San Francisco lawyer who is leading American’s defense.

Wall challenged the government’s claim that previous airline mergers — about a half dozen over the last two decades — have led to higher prices.

Transportation Department data from the first quarter shows that the national average fare declined 29% in the last 10 years and 36% in the last 20 years, after adjusting for inflation. While consolidation has eliminated famous aviation names such as TWA, Continental and Northwest, new low-fare airlines — including JetBlue — have pushed fares lower over that period.

The Justice Department and six states that have joined its lawsuit plan to call a Georgetown University economist who will testify that the American-JetBlue deal will reduce competition and cost consumers $700 million a year.

“And it stands potentially to get worse with JetBlue’s announced acquisition of Spirit Airlines,” Jones said.

The Justice Department is currently examining JetBlue’s proposed $3.8 billion purchase of Spirit. Jones’ comments indicate that regulators could take a dim view of the acquisition, which would mean the end of Spirit, the nation’s biggest discount airline.

The Biden administration has pushed to aggressively enforce antitrust laws, but it lost two major cases last week. The Justice Department failed in bids to block a merger of two big sugar refiners and an acquisition by health insurer UnitedHealth Group.

Associated Press writer Marcy Gordon in Washington, DC, contributed to this report.

With a storied, celebrity past and almost a century of careful preservation paired with with high-end, careful renovation, 2500 Divisadero is a San Francisco legend. You could write the next chapter for this historic mansion, on the market now for $15.995 million.

This 9,125 square-foot home was built in 1933 by locally renowned architect Angus McSweeny, a partner in Willis, Polk, and Company, an architectural partnership that produced hundreds of significant commercial and residential buildings in the Bay Area, including the Palace of Fine Arts .

The home’s current owners have enhanced the Tudor drama with glossy black paint and artistic design elements.

Jacob Elliot

Later McSweeny would go on to form his own firm. Along with this home, other notable buildings to McSweeny’s credit are 1200 California and St Mary’s Cathedral on Gough, the latter of which he served as part of collaborative team to create and construct.

Jacob Elliot

The grandeur of those buildings is clearly present in 2500 Divisadero, with its classic Tudor craftsmanship. hand-carved woodwork; hand-laid stone and brick; dramatic arches, peaks, beams, built-ins and embellishments; all of these features are still present.

The kitchen is large and equipped with high-end appliances. French doors open to patio.

Jacob Elliot

But the plethora of famous owners have kept the six-bedroom, five full bathoom and three half-bathroom abode current with modern day luxury.

Jacob Elliot

The home has illustrious history. Before it was built, its location was a backdrop for the 1924 the Buster Keaton silent movie, “The Navigator.” Once the home was built, its original owners were the Bissinger family: Marjorie Walter Bissinger was the founder of the Asian Art Museum.

Jacob Elliot

The home has also housed the Canadian Consulate, and has featured in San Francisco’s Decorator Showcase. Previous owners and philanthropists Jeff and Laurie Ubben used the home to host fund raisers for a variety of causes. At one point, Martha Stewart stayed in the upper floor guest room while she and Jeff Ubben worked together.

The current sellers are Mike Depatie, financier and former CEO of Kimpton Hotels and his wife Holly, an interior designer. Holly Depatie’s design sensibilities adorn the home’s interior.

Jacob Elliot

“The house itself inspired me with its rich history, grand entrance, extraordinary hand-carved wood, custom ironwork, and gorgeously proportioned rooms,” Holly Depatie told SFGATE. “Because of the house’s connection to the visual arts I wanted it to exude a sense of dignified drama, a grown-up modern aesthetic that embraced both its glorious past and its most relevant place in the present as one of the great San Francisco houses. “

In the Depatie family’s hands, this home has continued to serve philanthropic causes as well as play host to a plethora of distinguished guests. Whoever buys the property next will enjoy almost a hundred years of history included with the sale.

Medallia’s Leslie Stretch with 2626 Larkin (Medallia, Lunghi Studios)

This week, Leslie Stretch, CEO of customer experience software company Medallia, will list the Russian Hill home he bought with his wife Heather just before the pandemic for exactly what they paid for it: $20 million.

Listing agent Nina Hatvany of Compass gave TRD an exclusive first peek of the five-bedroom house, which includes a separate guest apartment one level below the main entrance. The home’s centerpiece is a floating helix-shaped limestone staircase with hand-forged railings circling a three-story Venetian glass light fixture hanging from a central skylight. There’s also a walnut-clad elevator that services all floors.

(Lunghi Studios)

The chandelier alone was rumored to cost $1 million and is an indication of the high-end finishes throughout the home, Hatvany said.

The house was built in 2013 by hedge fund manager Chris Hansen, according to public records. It has six floors plus a bay view roof deck just around the corner from Lombard’s “crookedest” street. The 10,000-square-foot home at 2626 Larkin Street was the biggest residential sale in the neighborhood when it sold at the end of January in 2020 for $2,000 a square foot, according to Redfin. It would be the biggest Russian Hill single-family sale of 2022 thus far if it sells for anywhere close to that amount, although the combined $29 million paid for a pair of penthouse suites owned by former secretary of state George Shultz in July is the bigger overall neighborhood residential sale.

Hatvany, who also represented the Stretches when they bought the home from Hansen in 2020, said her clients are selling now because the youngest of their four children has gone off to college and they are moving to a smaller pied a terre in the city. They also purchased several “spectacular” secondary homes during the pandemic, she said.

They made only minor decorative changes to the property during their two-plus years there, but spent hundreds of thousands of dollars upgrading the smart home features of the property, such as the AV system and light switches, she said. They also added two car lifts to make room for five cars in the three-car garage.

Otherwise the home is much as it appeared when they bought it in January 2020, she said, with “glowing” lime plaster walls, french white oak floors and a glass wall off the kitchen-family room that leads out to a backyard with a pizza oven, quartz stone patio and a fireplace bookended by two bronze fountains. The back of the home overlooks the garden, while the front, including the fourth-floor primary suite and fifth-floor family room, has northwest views of the bay. Both have decks to take in the views, and there’s also a panoramic view roof deck with a fire pit.

Even with the SF luxury market seeing millions in price cuts, Hatvany said the home is priced to bring in high-end buyers who she said are still actively house hunting despite the slower market.

“We have other houses on the market in the $18 [million] to $25 million range, and not one of them is as done as this house is,” she said.

Most of those properties are in Pacific and Presidio Heights, which Hatvany said are still tops for high-net-worth individuals with young families, given the proximity to parks and prestigious private schools. The Larkin home’s buyer may not be someone with “masses of children,” since it has a “more sophisticated feel,” Hatvany said, but otherwise she expects it to draw the same well-heeled crowd of house hunters to its “Pacific Heights- ish” location.

“It’s as close to Pacific Heights as you can be on Russian Hill,” she said.

The grandeur of those buildings is clearly present in 2500 Divisadero, with its classic Tudor craftsmanship. hand-carved woodwork; hand-laid stone and brick; dramatic arches, peaks, beams, built-ins and embellishments; all of these features are still present.

But the plethora of famous owners have kept the six-bedroom, five full bathoom and three half-bathroom abode current with modern day luxury.

The number of people leaving the Bay Area jumped 21% from March 2020 and September 2021, according to a report from University of California researchers. We talk to one man who left about why he did it. (Thinking of ditching your pricey city too? Check out the lowest mortgage rates you can get here now.)

Life as a CEO in San Francisco became increasingly stressful for Phil Libin, founder of the app mmhmm and former CEO and executive chairman of software company Evernote. After 15 years of city living, Libin decided it was time to wait out COVID-19 somewhere peaceful. So he packed his bags, told all of his employees they could work virtually forever and headed east to Bentonville, Arkansas — a place he’d passed through once or twice before, that’s known for its artsy vibe, beautiful outdoors and as the headquarters of Walmart.

“I thought I’d go somewhere for a few months, so I got an Airbnb and then decided to stay,” says Libin, who hasn’t looked back on leaving the tech capital. The thing he misses the least? Traffic. “In San Francisco, I was Ubering everywhere. I looked back at my calendar and realized I was spending almost three hours every day in a car, going to the office or from meeting to meeting,” says Libin. Now, he works from home, or a few local places within walking distance. “My life here feels much more integrated. Things are much cheaper and money goes much further,” says Libin.

He has a point: According to Realtor.com, the median sales price of a home is just over $400,000, compared to $1.5 million in San Francisco. And overall San Francisco is 147% more expensive than Bentonville, according to Sperling’s Best Places, with home prices being the biggest factor in that.

            Phil Libin

While in San Francisco, Libin thought he had a high standard of living – “I was the CEO and I had a pretty good quality of life because I spent a lot of money,” he says – but he says his standard of living in Bentonville is actually much higher. “I have a higher quality of life and 100% of the people that work with me could afford to live the way I am,” says Libin. (Libin lets all of the mmhmm employees live wherever they want, and he says that about half of them who were in the Bay Area ended up moving.) “They can afford to eat at the same restaurants and be members of the same clubs, says Libin.

Dreaming of moving to a less pricey city, too?

Here are some resources to help you make that decision:

      • Housing: See what kind of a mortgage you can qualify for here, and look up what you might pay in rent here.

      • Crime, education and other lifestyle factors: Look these up on niche.

Now, instead of living in an overpriced condominium, Libin has bought land and is planning to build a house. “I was in SF a few weeks ago for the first time in a year and I was shocked by what I used to put up with. I had forgotten about sitting in traffic. I would sit in the car for 90 minutes all the time and I thought it was okay. I never want to ask someone to do that,” says Libin.

Of course, the restaurants and culture of San Francisco are hard to beat, but it’s easy enough to travel from Bentonville, Libin says. “There are direct flights … It’s actually easier to fly domestically from here than SF because the airport is smaller and there’s no traffic. If I have to fly internationally to Asia or Europe, it adds a hop, but it’s worth it,” says Libin.

            Matthew Ros

→ The ouster of former Immunomedics exec Usama Malik created a CEO opening at Fore Biotherapeutics, which is taking aim at BRAF mutations following a rebrand last year. Matthew Ros has now stepped up to the tee box as CEO and a member of the board after Malik was embroiled in an insider trading scandal during his time at Immunomedics that he chose to address in a rather cryptic LinkedIn post in December. A 17-year Bristol Myers Squibb vet, Ros left Sanofi Genzyme in 2016 to become COO of Epizyme, where he had since been chief strategy and business officer. Fore Bio, once known as diagnostics company NovellusDx and chaired by former Sanofi exec Dieter Weinand, is in a Phase I/IIa trial with its lead candidate FORE8394.

Brad Margus

→ Brad Margus is out as CEO of Takeda CNS spinout Cerevance, and Craig Thompson stands at the ready to take his place. Margus will slide into the executive chairman post at the end of this month and hand the reins to Thompson, the Pfizer and Merck alum who got out of Dodge as chief executive of Neurana Pharmaceuticals, where a recent Phase III bellyflop with tolperisone cast a bleak outlook on the company’s future. Before his turn as Neurana’s chief, Thompson was president and CEO of Anthera Pharmaceuticals and the COO at Tetraphase.

Christopher Slapak

→ Vor Bio CMO Christopher Slapak intends to retire with enrollment in progress in its Phase I/IIa trial for acute myeloid leukemia patients with high risk of relapse. The biotech from scientific founder Siddhartha Mukherjee is searching for candidates to succeed Slapak, the longtime Eli Lilly exec who shed the interim medical chief label at Vor in July 2020. “Our plan has always been for Dr. Slapak to build a team and infrastructure to successfully initiate the VBP101 clinical trial,” Vor chief Robert Ang said in a statement. “Now that we are actively recruiting with data expected in the second half of 2022, we are moving into an execution phase of the study. We have expanded our clinical operations capability and expertise to support this activity and now is a natural time for this transition.”

Joseph Romanelli

→ Back in February, Merck announced that three people would replace Frank Clyburn as the exec left to serve as CEO at DuPont-majority owned International Flavors & Fragrances (IFF). At the time, Merck plucked up two execs from within, Arpa Garay (chief marketing officer, human health) and Jannie Oosthuizen (president, Merck Human Health). And now, a former Merck exec is coming back to take the third spot. Joseph Romanelli was with Merck for 25 years before he took off less than a year ago to become CEO at Shanghai-based Ji Xing Pharmaceuticals. During his time at Ji Xing, Romanelli helped lead the company to ink its licensing deal with LENZ Therapeutics for its two presbyopia candidates.

Now, in his new role, Romanelli will manage Merck’s $22 billion international Human Health business and a team of 14,000 staffers. All three execs will report directly to CEO Robert Davis.

Meanwhile, the founding CEO at Ji Xing, Peter Fong, will be retaking the reins at the company after Romanelli’s departure.

For the last two weeks, Andy Kurtzig’s days have been punctuated by emergency phone calls and urgent email updates from his team in Ukraine. Kurtzig is CEO of the San Francisco-based tech company JustAnswer, and 252 of its approximately 1,000 employees are based in offices throughout Lviv, Uzhgorod and Kyiv.

“My top priority right now is to keep them all safe,” Kurtzig says.

Ukraine is home to 44 million people, including a community of roughly 200,000 software developers who work remotely for companies in the US and Europe. According to one industry estimate, 20% of Fortune 500 companies have their remote development teams in Ukraine.

Since Russian President Vladimir Putin ordered troops into Ukraine on Feb. 21, Kurtzig says that “every morning when I wake up and every night when I go to bed, I’m thinking about how to keep our people safe. This is a war. This is a crisis. This is an emergency.”

Supporting colleagues in Ukraine

JustAnswer has had a presence in Ukraine since 2010 and has spent years anticipating a Russian invasion and ratcheting up employee safety measures since the Maidan Revolution in 2014.

Over the last two weeks, JustAnswer has worked to relocate employees and their families to safer locations in Lviv and Uzhgorod, paying for moving fees, rent on new leases, hotel stays and bus fare.

The company also committed to continue paying the salaries of any employee who gets drafted or chooses to volunteer to join the Ukrainian military during the war.

JustAnswer has employees in the US, India and Manila. Non-Ukrainian employees receive a daily update from their colleagues and are encouraged to donate to Ukrainian army and volunteer organizations through the business group Lviv IT Cluster. As of Tuesday, the donation page surpassed its $100,000 goal.

Kurtzig is also encouraging employees to write to their elected representatives to support the people of Ukraine through military efforts, financing, medical aid and refugee housing.

Kurtzig, who spent six months living in Ukraine with his family in 2019, sees his stance as beyond political: “It doesn’t just affect people in Ukraine or Russia or Eastern Europe. This affects all of us globally. This is about democracy, Freedom and opportunity. What we’re doing is not just about JustAnswer or a few employees. This is personal.”

People expect businesses to take a stand for Ukraine

As for resuming business in Ukraine, department heads take stock of their team’s location, availability and internet connection every day to coordinate how to execute and back up their work. Kurtzig says it’s important that business can continue to function and support the Ukrainian economy through the war.

People are watching executives and expecting action in the business world. In recent weeks, Yale University professor Jeffrey Sonnenfeld and his research team compiled a spreadsheet detailing which companies have pulled out of Russia amid its attack on Ukraine, and which ones have stayed put.

“We have a history of seeing the value of business leaders affirming the truth and taking a stand,” Sonnenfeld told The Washington Post. CEOs need peer approval and often try to avoid standing alone on issues or policies, he added.

For his part, Kurtzig remains committed to maintaining and growing a presence in Ukraine and encourages other business leaders to do the same. JustAnswer hired 87 people in Ukraine in 2021 and has plans to hire 180 in 2022. They’ve even extended three job offers since the Russian invasion.

It can seem like a tough balance, keeping a business running in order to provide employees a source of income and sense of stability through crisis. But at the end of the day, Kurtzig says, “The business will still be here. I have to make sure that the people are still here.”

SAN FRANCISCO (KGO) — As tensions rise along the Russian border with Ukraine, this is not a wait and see situation for Bay Area companies who have employees working in Ukraine. Some are being moved away from the Russian border.

Ukraine’s 41 and a half million people are well aware of the military buildup along its eastern border with Russia. The threat is a big concern for San Francisco’s JustAnswer. One-third of its workforce — 252 people — live in Ukraine.

“A lot of our engineering, a lot of our critical functions are done there,” said CEO Andy Kurtzig. “So it’s very scary, and even more scary on a personal level because these are all our friends.”

We connected with Nadya Semen, JustAnswer’s country manager based in Lviv near the border with Poland. She believes Russia has already initiated cyberattacks.

If you’re on the ABC7 News app, click here to watch live

“We are experiencing a set of cyberattacks on different websites and banking system and some governmental websites were down. So it’s weird,” she said.

She has an 18-year-old son and an 11-year-old daughter. Their safety has already been threatened.

“Two times during class for weeks, I had to pick up my kid from school because someone called that there is a bomb in the school,” she said.

JustAnswer has developed its own action plan. It puts the current threat level at moderate to high because of some military activities. As the threat rises to high and to realized threat, that will initiate more action to protect its workers.

RELATED: Biden says US has reason to believe Russia ‘intends to attack’ Ukraine: ‘I’m convinced’

“We are moving people from the east to the west as we speak and give them time of and putting them up in hotels and then actively helping them move across the country from the more dangerous parts of Ukraine,” CEO Kurtzig said.

Stress levels are rising. School children are drilled about evacuating to shelters, which frightened Nadya’s daughter.

VIDEO: Bay Area Ukrainians worried about Russian invasion, many praying for peace

“She was stressed by that, so she was asking me, ‘When are we supposed to expect the real worst to come here? So why are Russians doing this? Why people are starting to worry? I really can be killed now?'”

Andy Kurtzig and his family lived in Ukraine for six months in 2019, prior to the Russian threat. The people and the culture of Ukraine captivated them.

“We love them,” he said. “We’ve been working with them for a long time, and we’re committed to them.”

As part of that commitment, Kurtzig said he has made arrangements to be able to pay them from Poland, even with cryptocurrency if necessary. He is also supplying them with satellite phones and alternatives if the internet or electricity is lost.

SAN FRANCISCO, Oct 07, 2021 (GLOBE NEWSWIRE) – The Federal Home Loan Bank of San Francisco (FHLBank San Francisco) congratulates President and CEO Teresa Bryce Bazemore on her recognition as one of the most influential women in the Bay Area economy for 2021 by the San Francisco Business Times. Bazemore and the other honorees will be celebrated at a virtual event today.

The annual list recognizes the leadership and accomplishments of women in a wide cross-section of industries, and Bazemore has wasted no time driving change in her industry since joining FHLBank San Francisco last March. “I want to thank the San Francisco Business Times for this recognition,” said Bazemore. “And to extend my congratulations to all of the amazing, inspiring women on the Influential Women list in 2021. I feel honored to be in such a company. “

Bazemore is a pioneer in the financial industry and a seasoned executive with over 25 years of leadership experience building and running mortgage insurance and service companies. Bazemore was appointed to her role at FHLBank San Francisco, effective March 15, and has been a driving force in responding to the economic impact of the pandemic and the differences it highlighted. With a passion for creating wealth for all, Bazemore is focused on leveraging the bank’s existing affordable housing, first home buyers and economic development grant programs, as well as brand new initiatives to serve in the communities of the bank and its member financial institutions.

“I am thrilled to come to work every day and work with my team to empower our members to best serve their customers and communities,” said Bazemore. “With the economic shocks and upheavals of the pandemic behind us, the bank’s business operations and community support initiatives need to be even more resilient to fulfill our mission to make all of our communities more equitable and resilient.”

To that end, Bazemore followed the recently announced collaboration between FHLBank San Francisco and the Urban Institute that focused on the home ownership gap between black and white. The two-year, $ 1.5 million research and product development initiative called Racial Equity Accelerator for Homeownership aims to address some of the most persistent challenges in closing racial home ownership and wealth accumulation challenges.
