<p>Victims of the McKinney Fire that destroyed homes and killed four people in Siskiyou County have sued the Oregon-based utility company providing power in far Northern California, claiming PacifiCorp powerlines sparked the fire.</p>
<p>While fire investigators with the United States Forest Service remain tight-lipped about what caused the blaze, the lawsuit argues power equipment is to blame.  The fire ignited July 29 at a time of dangerous fire weather in a rural area by McKinney Creek near Klamath River, an unincorporated community on Highway 96 in Siskiyou County.</p>
<p>Tom Gauntt, a spokesperson for PacifiCorp, declined to answer questions about the McKinney Fire and said the lawsuit prevented the company from discussing the matter.</p>
<p>PacifiCorp, which operates as Pacific Power in California, filed a report with the California Public Utilities Commission six days after the fire started, alerting regulators that its equipment was in the area of ​​a fire.  The company did not report any problems with its equipment to state regulators.  Drew Hanson, another spokesman for PacifiCorp, told the Chronicle on Aug. 3 that “we are not aware of any equipment being collected for an investigation related to the McKinney Fire.”</p>
<p>Attorney Gerald Singleton said his firm&#8217;s investigator reported that overhead power lines were the only human infrastructure in the remote forested area where the fire started — no roads, structures or campsites.  His San Diego-based firm, Singleton Schreiber, is representing about 25 property owners with losses from the fire.</p>
<p>&#8220;There&#8217;s nothing anyone has seen that would lead us to believe that the McKinney Fire started with anything other than power lines,&#8221; Singleton said.</p>
<p>A 911 caller reported the first flames of the McKinney Fire just before 2:15 pm on July 29. Emergency dispatch audio from some of the first fire units on scene describe the early flames.  “About a quarter acre ….  right now putting water on it &#8230; it is underneath the power line right-of-way,” a firefighter reported over the radio at about 2:30 pm</p>
<p>Singleton said his firm&#8217;s investigator was informed that the Forest Service collected power equipment from the origin site as evidence.  He said they will request access to inspect the equipment in the course of civil litigation proceedings.</p>
<p>Adrienne Freeman, a spokesperson for the Forest Service, said the agency&#8217;s investigators were still determining how the fire started and were working with assistance from the Siskiyou County Sheriff&#8217;s Office.  Freeman declined to say whether any power equipment had been collected as potential evidence.</p>
<p>The lawsuit alleges PacifiCorp was negligent in its maintenance, operation and inspection of its power lines and names another 2020 wildfire in California that spurred a lawsuit blaming PacifiCorp for the destruction: the Slater Fire that burned 157,229 acres and killed two people in the Klamath National Forest .  The cause of that fire is still under investigation.  PacifiCorp did not immediately respond to a request for comment on the Slater Fire.</p>
<p>The McKinney Fire has burned 60,392 acres and is 95% contained.  The blaze destroyed at least 196 structures.  Those killed include longtime US Forest Service fire lookout Kathy Shoopman.

<p>SAN FRANCISCO — San Francisco supervisors voted Tuesday to put the brakes on a controversial policy that would let police use robots for deadly force.</p>
<p>The Board of Supervisors unanimously voted to explicitly ban the use of robots in such fashion for now.  But they sent the issue back to a committee for further discussion and could allow it in limited cases at another time.</p>
<p>It&#8217;s a reversal from last week&#8217;s vote allowing the use of robots in limited cases.  The police said they had no plans to arm the robots with guns but wanted the ability to put explosives on them in extraordinary circumstances.</p>
<p>Last week&#8217;s approval generated pushback and criticism about the potential to deploy robots that can kill people.</p>
<p>Some supervisors said they felt the public did not have enough time to engage in the discussion about whether robots could be used to kill people before the board first voted last week.</p>
<p>The vote was the result of a new state law that requires police departments to inventory military-grade equipment and seek approval for its use.</p>
<p>The approved policy does give the police power to use robots for situational awareness, such as going first into a dangerous situation so police can stay back.</p>

<p>SAN FRANCISCO (AP) — Two San Francisco gang members who opened fire during a funeral reception for a pimp, killing one person and wounding four innocent bystanders, were sentenced Wednesday to life in federal prison, prosecutors said.</p>
<p>Robert Manning, 31, and Jamare Coats, 29, were sentenced for a March 23, 2019 shooting that took place in front of the Fillmore Heritage Center and not far from a police station.</p>
<p>The men who belonged to a local street gang got into a shootout on a crowded sidewalk during which at least 24 shots were fired, the US attorney&#8217;s office for the Northern District of California said in a statement.</p>
<p>Prosecutors said the battle began with a confrontation between several gang members and associates attending a reception at the center for Ron Newt, who had died that month at 69. Newt was a well-known and flamboyant San Francisco pimp in the 1970s and 1980s.</p>
<p>The victim, 25-year-old Mister Dee Carnell Simmons III, &#8220;acted disrespectfully towards them, branding a firearm and threatening&#8221; them, the US attorney&#8217;s statement said.</p>
<p>Manning, Coats and others left the building and went to their parked cars where Manning and Coats armed themselves and got into the shootout with Simmons, who died of his wounds, authorities said.</p>
<p>Four other people were wounded in the crossfire, including a bystander who was shot in the back and paralyzed from the waist down as he tried to escape the shooting, prosecutors said.</p>
<p>Manning and Coats were convicted in August of murder in aid of racketeering and of being felons in possession of firearms.</p>

<p>KPIX 5 has learned that Caltrans has decided that the massive encampment beneath Interstate 880 must be cleared, and soon.</p>
<p>The agency said the deadly RV fire Tuesday was one of more than 100 fires in recent years.  Planning is now underway for a large-scale intervention.</p>
<p>The Wood Street encampment starts just north of the old 16th Street Train Station and stretches almost to the 580 interchange.  That&#8217;s about three quarters of a mile.</p>
<p>For the hundreds of people living in the camp, the fatal fire might be what leads to their next move.</p>
<p>&#8220;You know, I knew a life would be lost sooner or later,&#8221; said camp resident Dearlean Bailey.  &#8220;I told people that was coming.&#8221;</p>
<p>Bailey lives about 100 yards from the scene of Tuesday&#8217;s fire.  It did not come as a surprise to her, nor is she surprised to hear that Caltrans is now talking about taking action.</p>
<p>&#8220;There are several different entities down there,&#8221; said Caltrans Deputy District Director for External Affairs Cheryl Chambers.  “East Bay MUD, Union Pacific, Burlington Northern, City of Oakland, ourselves.  So we all<br />need to get together and talk about what needs to happen in a short timeframe.”</p>
<p>Caltrans told KPIX all of those parties will meet before the week is over to begin discussing some kind of resolution for the encampment.  The agency said it will involve moving everyone out.</p>

<p>&#8220;The goal is to clear the area out of a lot of abandoned cars and debris, and to relocate the people to safer conditions, yes,&#8221; Chambers explained.</p>
<p>By the agency&#8217;s estimate, that could mean relocating more than 100 people.</p>
<p>&#8220;It will be a mixed bag,&#8221; said Richard, an off-and-on resident of the camp.  “Some people are ready for it.  Some people are going to say &#8216;No!&#8217;  forever.”</p>
<p>&#8220;A lot of people would rather be out here, being free, and I have to pay bills,&#8221; Bailey said.  “I&#8217;d rather pay bills and we broke in a spot myself.  yes  I would take it.&#8221;</p>
<p>&#8220;There have been people in that area for years,&#8221; Chambers said.  “They have a sense of place, and we have been mindful of that.  But at the same time, we just need to look at the reality.  What happened yesterday needs to be prevented.”</p>
<p>&#8220;I feel that we have been very patient here,&#8221; said nearby business owner Terry Caughell.  “Beyond patient.  And I think it&#8217;s really time to do something.  This fire yesterday was significant.”</p>
<p>Area business owners like Caughell are ready for changes.</p>
<p>“It really is beyond description,” Caughell said.  “You know, I&#8217;ve had people visit from out of state, vendors.  Even after I tell them about what&#8217;s going on and give them, if you will, fair warning, when they get here, they still can&#8217;t believe what&#8217;s going on here.  And it&#8217;s been going for about 4 to 5 years.&#8221;</p>

<p>Caltrans says meetings will be held in the next few days.  They&#8217;re hoping for some kind of formal strategy in the next couple of weeks.</p>

<p>The agency said the deadly RV fire Tuesday was one of more than 100 fires in recent years.  Planning is now underway for a large-scale intervention.</p>
<p>The Wood Street encampment starts just north of the old 16th Street Train Station and stretches almost to the 580 interchange.  That&#8217;s about three quarters of a mile.</p>
<p>For the hundreds of people living in the camp, the fatal fire might be what leads to their next move.</p>
<p>&#8220;You know, I knew a life would be lost sooner or later,&#8221; said camp resident Dearlean Bailey.  &#8220;I told people that was coming.&#8221;</p>
<p>Bailey lives about 100 yards from the scene of Tuesday&#8217;s fire.  It did not come as a surprise to her, nor is she surprised to hear that Caltrans is now talking about taking action.</p>
<p>&#8220;There are several different entities down there,&#8221; said Caltrans Deputy District Director for External Affairs Cheryl Chambers.  “East Bay MUD, Union Pacific, Burlington Northern, City of Oakland, ourselves.  So we all<br />need to get together and talk about what needs to happen in a short timeframe.”</p>
<p>Caltrans told KPIX all of those parties will meet before the week is over to begin discussing some kind of resolution for the encampment.  The agency said it will involve moving everyone out.</p>

<p>&#8220;The goal is to clear the area out of a lot of abandoned cars and debris, and to relocate the people to safer conditions, yes,&#8221; Chambers explained.</p>
<p>By the agency&#8217;s estimate, that could mean relocating more than 100 people.</p>
<p>&#8220;It will be a mixed bag,&#8221; said Richard, an off-and-on resident of the camp.  “Some people are ready for it.  Some people are going to say &#8216;No!&#8217;  forever.”</p>
<p>&#8220;A lot of people would rather be out here, being free, and I have to pay bills,&#8221; Bailey said.  “I&#8217;d rather pay bills and we broke in a spot myself.  yes  I would take it.&#8221;</p>
<p>&#8220;There have been people in that area for years,&#8221; Chambers said.  “They have a sense of place, and we have been mindful of that.  But at the same time, we just need to look at the reality.  What happened yesterday needs to be prevented.”</p>
<p>&#8220;I feel that we have been very patient here,&#8221; said nearby business owner Terry Caughell.  “Beyond patient.  And I think it&#8217;s really time to do something.  This fire yesterday was significant.”</p>
<p>Area business owners like Caughell are ready for changes.</p>
<p>“It really is beyond description,” Caughell said.  “You know, I&#8217;ve had people visit from out of state, vendors.  Even after I tell them about what&#8217;s going on and give them, if you will, fair warning, when they get here, they still can&#8217;t believe what&#8217;s going on here.  And it&#8217;s been going for about 4 to 5 years.&#8221;</p>

<p>SANTA ROSA (AP) &#8211; The country&#8217;s largest utility company has long vowed to change its ruthless ways.  After leaving a trail of death and destruction through Northern California in less than three years, the fifth CEO of Pacific Gas &#038; Electric has renewed promises that the future will be &#8220;easier&#8221; and &#8220;brighter&#8221;.</p>
<p>But the promises CEO Patricia “Patti” Poppe made in her first letter to shareholders sound a year after PG&#038;E emerged from one of the most complex bankruptcies in US history, an act of desperation followed by a series of devastating forest fires that was triggered by its long-neglected power grid.</p>
<p>The bankruptcy, PG &#038; E&#8217;s second in less than 20 years, was billed as an opportunity for a utility company that powers 16 million people &#8211; a population larger than all but a handful of states &#8211; to finally reset Button to press.</p>
<p>So far, however, it has looked more like a reminder of problems that have led to tragedy after tragedy over the past six years, including a 2018 wildfire that killed 85 people and the town of Paradise, about 274 kilometers northeast of, San Francisco was destroyed.</p>
<p>PG&#038;E is already a twice convicted felon and has been charged with another round of arson crimes which it denies commission.  The utility was also reprimanded by California regulators and a federal judge overseeing his parole for breaking promises to reduce the dangers of trees near his power lines.</p>
<p>And most of the 70,000 or so victims who have made claims of devastation from PG &#038; E&#8217;s past misdeeds are still awaiting payment from a $ 13.5 billion trust created during bankruptcy.  The Trust faces a deficit of nearly $ 2 billion because half of its funding comes from company stocks, though critics say it&#8217;s foolhardy to hold an interest in a utility company with such a poor record.</p>
<p>These stocks have slumped in a rising stock market.  A stroke of luck could still come if PG &#038; E&#8217;s shares rebound, as several analysts have forecast, but confidence would find itself in an even deeper hole if the stock fell any further.</p>
<p>There are legitimate concerns that if the utility stirs another deadly wildfire in the next four months, stocks will collapse as most of PG &#038; E’s sprawling service area has sunk into extreme drought and climate change, worsening fire conditions in western America USA contributes.</p>
<p>“Of course I&#8217;m nervous.  My biggest fear is what will happen to the stock, ”said John Trotter, head of the Forest Fire Victims Trust, which owns almost one in four PG&#038;E shares &#8211; far more than any other investor.</p>
<p>Trotter, a retired federal judge who serves as a trustee on $ 1,500 an hour, has other headaches as well.  He and over 300 workers have come under heavy criticism for slow payments to victims who lost their families, homes and other property nearly three to six years ago.</p>
<p>In the first six months of its operation last year, the Trust paid out just $ 7.2 million to victims while incurring nearly $ 39 million in operating expenses, which, according to its financial records, reduced the amount available for disbursement .</p>
<p>&#8220;I look at it like a locomotive that starts slowly, but we&#8217;re blowing the steam off now and we&#8217;re starting to roll now,&#8221; Trotter said in an interview with The Associated Press.  “I just wish I had a wand and could make it go faster, but I can&#8217;t.  We do everything we can. &#8220;</p>
<p>Trotter said he has a plan to eventually sell the stock without paying taxes on potential gains but would not disclose his price target.  Stocks, which last hovered around $ 10, must rise to about $ 14 per share for the trust to hit $ 13.5 billion.</p>
<p>Wall Street analysts predict that PG &#038; E&#8217;s stock could hit $ 13-17 in the next 12 months, which would mark a dramatic turnaround.  The stock is down 17% so far this year, while the S&#038;P 500 is up 14%.</p>
<p>The trust has made some progress.  By June 30, it had paid out $ 436.4 million.  That&#8217;s still only 3.2% of the $ 13.5 billion earmarked for fire victims, a sign of &#8220;designed dysfunction&#8221; built into the utility&#8217;s bankruptcy regimes, said Will Abrams, a victim of a PG&#038;E caused wildfire that terrorized his hometown of Santa Rosa in 2017.</p>
<p>&#8220;I was really disappointed,&#8221; said Abrams.  “The bankruptcy was being sold as something that would hold PG&#038;E accountable, and it wasn&#8217;t.  Bankruptcy is not a reorganization process.  It is a process of dividing the dollars. &#8220;</p>
<p>But nearly 45,000 victims voted for the plan, with only 6,109 opposed to it according to court documents, paving the way for US bankruptcy judge Dennis Montali approval.</p>
<p>Many victims were influenced by attorneys who participated in settlement negotiations, arguing that the plan was the best option.  Eight of those attorneys are now part of a nine-member supervisory committee on the victim&#8217;s trust, an arrangement that Abrams believes was a conflict of interest.</p>
<p>Amy Bach, the only member of the Fiduciary Committee who was not involved in PG &#038; E&#8217;s bankruptcy negotiations, insists that everyone tries to ensure that all forest fire victims receive money as soon as possible.  The attorneys involved are motivated to achieve this because their fees are dependent on their clients being paid.</p>
<p>&#8220;We put as much pressure on the claims team as possible,&#8221; said Bach, executive director of United Policeholders, a nonprofit group she founded nearly 30 years ago to fight insurers on behalf of fire victims.  &#8220;You seem to be hearing us, it feels like things are speeding up.&#8221;</p>
<p>Frank Pitre, another member of the oversight committee and one of the attorneys representing burn victims, admitted that things have turned out more slowly than he had hoped.  That is one of the reasons why he rates Trotter and his team with a “B” for their commitment to date.</p>
<p>&#8220;There is a lot of room for improvement,&#8221; said Pitre, but added that &#8220;I have no doubt that the effort is there.&#8221;</p>
<p>PG&#038;E believes it has already done its part in helping fire victims.</p>
<p>&#8220;We financed the trust according to our reorganization plan,&#8221; the utility company said in a statement to the AP.  &#8220;PG&#038;E is not involved in the distribution of trust funds.&#8221;</p>
<p>PG &#038; E&#8217;s Chief Risk Officer, Sumeet Singh, enumerated a wide range of improvements, including using more advanced technology to prevent forest fires from starting and detect them more quickly.</p>
<p>Although PG&#038;E did not live up to expectations, Singh said, “I am very encouraged by the new leadership, (a) new playbook, rigor and discipline that we are on the right track.  We know we can do better and we will do better. &#8220;</p>
<p>Trotter, meanwhile, holds his breath as the weather warms and the Northern California landscape dries up.</p>
<p>&#8220;We are dealing with the hand that was dealt to us,&#8221; said Trotter.  “(PG&#038;E) says the right things.  Now we just have to see if they are doing the right things. &#8220;</p>

<p>SAN FRANCISCO (AP) &#8211; A San Francisco man was charged with an unprovoked attack on a BART station that killed one person and seriously injured another.</p>
<p>20-year-old Keshon Wilson first appeared in court on Tuesday and should be charged with murder, attempted murder and assault in two weeks, which could result in a potential life sentence if convicted, the San Francisco Examiner reported.</p>
<p>A lawyer who represented him did not immediately respond to a request for comment, the newspaper said.</p>
<p>Wilson, who worked for a private company, was washing the mission station with electricity on the night of March 29 when he walked up to a group of people and opened fire, authorities claim.</p>
<p>Isaiah Cardenas, 26, was shot three times in the back and died on the scene.  A second man was beaten five times in the stomach and shoulder but was able to log off the police and was taken to a hospital, the investigator said.</p>
<p>Wilson drove off in his work truck and was arrested at his home last Friday after returning from a trip to Las Vegas, prosecutors said.</p>
<p>The authorities did not mention any possible motive for the attack.</p>
