<p>Grubhub and DoorDash have filed a lawsuit against San Francisco after capping delivery fees to 15% last month. </p>
<p>On Friday, the two food suppliers filed a lawsuit in the U.S. District Court for the Northern District of California arguing that the maximum fees are in violation of both the U.S. and California constitution.  Court documents show that DoorDash and Grubhub argued that the cap could potentially lead to higher prices for consumers and affect delivery couriers, among other things.</p>
<p>&#8220;The City of San Francisco has passed hasty, adverse and unconstitutional price controls that leave us no choice but to resolve this matter in court,&#8221; a DoorDash spokesman said in a statement shared with SFGATE.  “Constant price controls are not only against the US and California constitutions, but will likely harm the restaurants the city claims to support.  The introduction of permanent price controls is an unprecedented and dangerous exaggeration by the government and will limit the ways small businesses rely on to compete in an increasingly competitive marketplace. &#8220;</p>
<p>The delivery companies also said that the 15% fee cap could affect business as it would entail renegotiating or terminating existing contracts with local restaurants.  Part of their reasoning was based on marketing and other services that DoorDash and Grubhub said were unable to cover the costs.  </p>
<p>Supervisor Aaron Peskin, who co-sponsored the law in June, condemned both grocery companies in a tweet Friday following the complaint.  He wrote that he was not surprised at the lawsuit.</p>
<p>&#8220;Hardly surprising of giant corporations that have just spent over $ 200 million to deprive their own workers of basic services,&#8221; wrote Peskin on Twitter.  &#8220;I stand by small businesses and my legislation to stop the rampant exploitation of the San Francisco restaurant industry.&#8221;</p>

<p>Last April, Mayor London Breed announced a temporary fee cap to prevent grocery delivery apps from charging restaurants more than 15% to help local businesses stay afloat during the coronavirus pandemic.  At the time, it was said that the provisional order should remain in place until the remainder of the local emergency or until restaurants can reopen for dine-in service.</p>
<p>Court documents argue that with the advent of vaccinations, the local emergency has been &#8220;mitigated&#8221;.  San Francisco was summoned to court on Monday.</p>

<p>SAN FRANCISCO (KPIX) &#8211; Sunday is the last day for the public to ponder a plan to collect fees at some national parks in the Bay Area.</p>
<p>The Golden Gate National Recreation Area is part of the national park system that was built for the good of the people, but now it looks like the people who actually visit the parks need to help maintain them.</p>
<p>Saturday was National Public Lands Day, a day all national parks can be visited for free.  In San Francisco, Baker Beach, with its spectacular views of the Golden Gate Bridge, is always free, but that may not last long by the time you head there.  The GGNRA plans to charge $ 3 an hour up to $ 10 a day for parking.  That didn&#8217;t go over so well with those used to being free.</p>
<p>&#8220;Some people can&#8217;t afford to get out and just think parking is another place they can&#8217;t come and enjoy,&#8221; said Priscilla Haynes, who visited Baker Beach from home in San Jose.</p>
<p>“I don&#8217;t think it will hit the tourists that much,” said Gemma Southerington from Vallejo.  &#8220;I don&#8217;t think this would be a primary target so I think it would harm the locals more than anything.&#8221;</p>
<p>The fees would be charged for parking at Baker Beach, China Beach, Stinson Beach, Rodeo Beach, Lands End, Sutro Heights, Navy Memorial, and Fort Cronkhite.  The Golden Gate National Recreation Area was the second most-visited national park in America in 2020, and the park district says it needs the money for basic needs like garbage collection and janitorial services.</p>
<p>&#8220;We are viewing these fees as a last resort to cover some of the costs that have increased dramatically from the extreme visits to some areas of the park,&#8221; said Juan Espinoza, spokesman for the National Parks Service.</p>
<p>&#8220;I don&#8217;t believe you when you say that,&#8221; says Donel Haines, who spends a lot of time on Baker Beach.  &#8220;I think a lot of money is being wasted.&#8221;  He said much of the beach cleanup is done by volunteers and he thinks the government is simply not efficient with its spending.</p>
<p>&#8220;The cost of things has gotten out of hand,&#8221; he said.  &#8220;That bears no relation to the basic activities of the people.&#8221;</p>
<p>His opinions weren&#8217;t unique.  Many of the people we spoke to have wondered why the parks&#8217; budget doesn&#8217;t seem to be able to cover basic expenses.</p>
<p>&#8220;I&#8217;m not sure where the money is going,&#8221; said Shontre Jackson from Vallejo.  &#8220;I mean, I hope they have good intentions with it, but knowing what they&#8217;re actually doing is, he says, she says.&#8221;</p>
<p>&#8220;There are advantages and disadvantages, right?&#8221;  said John Strishak of Berkeley.  “On the one hand, you want to make sure that the park stays clean.  On the other hand, you want to make sure that everyone can use it.  Where do you draw this line? &#8220;</p>
<p>But Susan Mah, visiting from Burlingame, thinks it&#8217;s important to pay to keep things nice.</p>
<p>“Change is hard when people aren&#8217;t used to paying,” she said, “but at the end of the day it&#8217;s worth it.  The low price &#8211; $ 5.10 &#8211; would be worth it to me. &#8220;</p>

<p>Amid the COVID-19 pandemic, when many people turned outdoors to flee their homes, the resort area recorded 12.4 million people in its locations in 2020.  The large crowds lead to higher costs for increased garbage collection, beach cleaning and traffic control.</p>
<p>The valet said the fees would also help pay for visitor protection services including marine safety operations.</p>
<p>&#8220;The park plans to use fee money to fund, for example, the replacement of the Stinson Beach lifeguard tower and the removal of sand on Ocean Beach to maintain access for visitors and rescue vehicles,&#8221; the agency said.</p>
<p>If the fees are approved, they would be phased in over several years and should come into effect as early as mid-2022.</p>
<p>The National Park Service is calling for comments on the fees until September 26th.  Email comments to goga_business@nps.gov or call 415-561-4700.</p>

<p>SAN FRANCISCO (CBS SF) &#8211; Congestion prices would force drivers to pay a fee to get to the busiest areas of San Francisco during rush hour.</p>
<p>The program, which is currently under investigation, could get traffic moving, increase safety for drivers and pedestrians, purify the air, and promote justice, according to the San Francisco County Transportation Authority.</p>

<p>&#8220;As a visitor and as someone who comes here regularly to see the sights, eat in restaurants and just wander around and have fun, knowing that I have to spend money on everything else &#8230;&#8221; said Ben Flores of Manteca.  &#8220;And if not me, other families are sure to be.&#8221;</p>
<p>According to the city, planning a congestion price program will take at least 3 to 5 years. </p>
<p>Two zones are considered.  The most important ones include the Financial District, Chinatown, and SoMa.  The larger one is to be expanded to include North Beach, Russian Hill and Fisherman&#8217;s Wharf.</p>

<p>SAN JOSE (CBS SF) &#8211; In a unanimous vote Tuesday evening, San Jose City Council approved the first gun control measure of its kind.</p>
<p>The first would require that every gun owner have liability insurance for their firearms.  The insurance could not legally cover intentional damage caused by a gun owner.</p>

<p>The second requires gun owners to pay an annual fee to reimburse taxpayers for public costs of responding to gun-related injuries and deaths, including police and medical services.</p>
<p>San Jose is the first city in the country to adopt such measures.  The new laws are part of a gun control plan proposed by Mayor Sam Liccardo earlier this month after the mass shooting of a disgruntled Santa Clara Valley Transportation Authority (VTA) employee at a light rail station in San Jose.</p>
<p>&#8220;It is also the case that the Second Amendment, while securing the right to own a weapon, does not require that we as taxpayers subsidize the possession of these weapons,&#8221; Liccardo said during the virtual meeting.</p>
<p>According to Liccardo, gun liability insurance is comparable to car insurance in that it encourages responsible ownership, storage and use of guns.  He said the fees would be modest &#8211; possibly between $ 25 and $ 30.</p>

<p>“We know crooks won&#8217;t buy insurance.  Of course not, ”said Liccardo.  “So when a police officer answers a domestic violence call and asks the question every officer asks, &#8216;Are there guns in the house?&#8217;  at this point the officer can determine whether this person has followed the law to take out insurance. &#8220;</p>
<p>Gun lawyers said the measures will punish law-abiding gun owners and will challenge the city&#8217;s decision in court.  They doubt that they have much influence on gun violence and are likely to come into conflict with the second amendment.</p>
<p>&#8220;We believe it is clearly unconstitutional for the government at any level to charge some kind of fee before someone can exercise an enumerated constitutional right,&#8221; said Sam Paredes of Gun Owners of California.</p>
<p>Two weeks ago, the city council passed law requiring retailers to videotape all gun purchases, making it the largest city in California with such a rule.</p>

<li id="KsMypo">The San Francisco board of directors met on Thursday June 10th to discuss introducing a permanent cap on which third-party delivery apps &#8211; like Grubhub, DoorDash, and Uber Eats &#8211; can charge restaurants, and it goes on, with a vote expected next week.  The law would put a permanent fee cap of 15 percent, a measure temporarily passed in 2020, while allowing restaurants to sign a separate marketing agreement with businesses for other services.  However, the manager behind the proposal, Aaron Peskin, was absent from the meeting &#8211; on the same day he announced that he was going into alcohol treatment after complaints about his behavior and allegations that he was under the influence during recent board meetings.  Peskin, the longest-serving member of the board, has also added changes and delayed the permanent rollout of parklets, which was discussed earlier this week and will be voted on June 22nd. <li id="lt0hLL">The chefs behind the pan-African ghost kitchen, The Bussdown in Oakland, are working on a new concept with a series of monthly supper club dinners starting on Sunday June 27th.  OKO, by chefs Solomon Johnson and Mike Woods, will serve an eight-course tasting menu highlighting the African and Afro-Latin American diaspora in a loft in Oakland&#8217;s Melrose neighborhood, before moving on to the monthly series on the way to Napa, Los Angeles and Washington, DC (so far) does.  .  Johnson and Woods have plans beyond the Supper Club &#8211; they plan to open OKO as a fine-dining restaurant in 2022.  The first dinner will have two seats for 25 guests each at 3 p.m. and 7 p.m., with tickets starting at $ 165 per person.  Tickets can be purchased through Tock. </li>
<li id="mh6CZV">Cafe Ohlone, the world&#8217;s first and only Ohlone restaurant, lost its former place in Berkeley last July when the bookstore it was located in closed, but a full-service restaurant is now occupying the campus UC Berkeley take shape.  During a webinar on Thursday with Professor Kent Lightfoot of UC Berkeley, owners Vincent Medina and Louis Trevino confirmed that the new Café Ohlone is due to open in November 2021 at the Phoebe A. <p>AUSTIN, Texas &#8211; On Thursday, Austin City Council passed two ordinances to expedite repairs due to last week&#8217;s freezing weather.</p>
<p>The ordinances waive housing permit and development fees as well as certain requirements for sanitary permits.</p>
<p>The fees covered by the first waiver include permit, plan review, inspection, demolition, and deviation fees for repairing existing structures only and do not include re-inspection fees.</p>
<p>The second ordinance allows construction officials to exempt certain <a class="wpil_keyword_link" href="https://losgatosnewsandevents.com/san-francisco-recycled-water-program-is-performative-environmentalism/"   title="plumbing" data-wpil-keyword-link="linked">plumbing</a> work from the permit requirements normally required by the city&#8217;s sanitary code.  In addition, the deadline for submitting a permit application will be extended from one business day to five business days from the date of the start of the activity, and the registration requirements for work set out in the Sanitary Code will be waived.</p>

<p>The Development Services Department has set up a dedicated website for emergency repairs and permits, including a live chat facility for quick responses and a hotline (512-974-1500) that operates Monday through Friday from 8 a.m. to 5 p.m.</p>
<p>In addition, the city of Austin launched a new website to help residents repair winter storms.  The website contains information related to the safety of repairs, plumbers, electricians and other contractors.  Code compliance and service requests;  the city&#8217;s emergency approval process;  Financial aid from the homeowner;  as well as federal and local aid programs.</p>
