PLEASANTON (CBS SF) — A domestic violence call late Thursday morning at a Pleasanton apartment complex on the edge of the city’s Hacienda Business Park turned into an hours-long standoff between a man and police officers, eventually ending in the afternoon with an officer- involved shooting after the man exited the building armed with a knife.

Police said Thursday afternoon that the man was confirmed dead at the scene.

The incident began at 11:51 am when police received a call from a victim of domestic violence at 4899 Willow Rd. When officers arrived on the scene, they located the man who refused to come out of an apartment unit.

“We know the public wants to know more, which is why we’re moving quickly to gather the facts,” Pleasanton Police Lt. Erik Salacci said Thursday evening.

The suspect was barricaded inside a ground floor unit of The Galloway Apartments for several hours. Just after 3:30 pm, police officers were seen breaking a window, appearing to get ready to enter the unit. Moments later, as seen on a video taken by a neighbor, the suspect walked out of the apartment in front of officers. On the video, a shot is heard and the suspect turns toward an officer and appears to lunge as the officers open fire.

The neighbor who shot the video said a couple had recently moved into the apartment and the woman worked in the apartment complex leasing office.

“I was trying to make sure he was OK,” said neighbor Luis Castillo. “I heard he was crying over the phone and the other people, too, came out right away. That’s when I saw the commotion. There was people across the street, everyone was a little shaken by what happened.”

Speaking about the suspect, Castillo added: “I met him about a month ago. Usually I’ll walk my dog ​​and see him out with his girlfriend. He seemed like a nice guy.”

Another neighbor said that, after three-plus hours into the standoff, she heard flash-bang devices and saw police breaking the window before the man emerged and was shot.

Pleasanton police said the suspect came out of the apartment armed with a knife.

“Two officers were involved in that [officer-involved shooting] and are uninjured,” said police spokesman Lt. Eric Silacci. “We can confirm the suspect is deceased. We’re not releasing the officers’ names at this time. We are in the process of conducting our investigation. The Alameda County District Attorney’s Office is also on scene and conducting their investigation. We know the public wants to know more, which is why we’re moving quickly to gather facts.”

SAN FRANCISCO (BCN / CBS SF) – San Francisco regulator Catherine Stefani announced Tuesday a voting initiative for the June 2022 elections aimed at expanding services to victims of domestic violence and other crime.

The initiative would create the Office for Victims ‘and Witnesses’ Rights, as well as the right to civil assistance for victims of domestic violence.

Stefani said that given the rise in certain types of crime in the city, such as burglary and murder, the vote initiative is urgently needed as the options available to victims are often limited.

“We are here because we know that Crime victims of San Franciscans are not getting the help or assistance they need and deserve. Every week I get letters from voters who are in the worst circumstances of their lives and who do not know where to turn, ”Stefani said.

“Unfortunately, the city’s response was not as urgent as I think it should be. The victim services are divided into several departments, each with their own tasks and mandates. This leaves the task of navigating the complex urban bureaucracy to the victims when they are least able to, and that has to come to an end now, “she said.

According to Stefani, once established, the Office for Victims and Witnesses would be a “one-stop shop outside of law enforcement agencies where victims can get the help they need”.

In addition to comprehensive services, the office will also help identify service gaps and advocate new ways of helping victims.

The Office will also be tasked with exercising the right to civil law assistance for victims of domestic violence, helping victims to obtain full legal representation through grant funds on matters such as child support or custody, protection orders, housing, employment, and immigration issues said Stefani.

Several supervisors support Stefani’s initiative, including supervisors Ahsha Safai, Matt Haney, Myrna Melgar and Rafael Mandelman.

“Providing legal assistance to domestic violence survivors is an important tool that has been missing here in San Francisco,” said Safai. “This is an important initiative and I think it will do a tremendous service to the 90 percent of victims who are not eligible for victim assistance today. Having a single office to solidify this and to be the catch basin and guide people through the bureaucracy will be a tremendous help. “

“No victim should be alone with this,” said Haney. “Many of the victims of crime do not want to deal with the judiciary. They may have language barriers, they may have immigration status concerns and our city needs to support them 100 percent. ”

San Francisco is facing a worrying rise in family violence and growing disagreement over how to respond.

During the course of 2020, the number of jury trials in San Francisco fell sharply and was completely suspended for several months. Domestic violence incidents also fell as victims had fewer opportunities to seek help due to pandemic-related closures, according to a recent San Francisco Department report on the status of women.

However, the decline in coverage has been accompanied by myriad research showing that incidents of domestic violence increased during the pandemic. The United Nations Population Fund estimates that intimate partner violence has increased by 20% worldwide due to quarantines and lockdowns.

The trend was a living reality for Lennette who managed to escape a violent and abusive relationship that began in 2015. (She declined to give her last name for privacy reasons.)

Last November, her abuser was convicted of incidents involving burning his girlfriend’s face and neck with a lighted cigarette, stabbing her thigh and abdomen with scissors, and handcuffing and gagging her last November when he gave her one electric drill held to his temple.

“There is too much in life to remain in a relationship that no longer serves any of you. Happiness means realizing that you’ve broken a toxic cycle. I know a traumatic bond is real, but once you break your bond with an abuser, you begin to see all of these possibilities and you can be successful, ”Lennette told about 30 prosecutors, law enforcement officers and community members at one of them The San Francisco District Attorney’s Office held an event honoring domestic violence survivors.

Lennette’s story is one of hope and bravery, but it’s also rare, especially in the wake of the San Francisco pandemic.

“In San Francisco we have an amazing number of vendors offering services,” said Catherine Stefani, District 2 supervisor, who previously served as a district attorney in Contra Costa County. “But in my opinion we fail to hold the perpetrators accountable and provide them with the services they need to take responsibility and leave the cycle of violence so that they no longer abuse their partner.”

In 2020, around 24% of total domestic violence cases filed with prosecutors were prosecuted and prosecuted, a significant decrease from 2019 (32%), 2018 (35%) and even 2017 (27%). on the data provided by the office.

Earlier this year, Stefani requested data on domestic violence-related arrests and charges, which revealed that 131 aggravated domestic violence arrests were made and 113 of them were released in the last three months of 2020.

“When I got those numbers back, I have to tell you that I was absolutely shocked,” said Stefani.

In 2021, the percentage of indictable cases has already risen back to 31%. But at a San Francisco Public Safety Committee hearing Thursday held to investigate the city’s response to domestic violence, it was clear that some have no confidence in the system designed to hold perpetrators accountable.

San Francisco District Attorney Chesa Boudin told The Examiner that during the pandemic it would be more difficult to gather evidence to prove domestic violence cases. Other DA officials described the numbers as “selected”.

“If you see any differences in fee rates, it reflects the quality of the research we are receiving,” said Boudin. “Often times survivors are unwilling to attend law enforcement, and that means we have witnesses or other evidence to use in court. And unfortunately we didn’t have that much of it during the pandemic. “

Stefani and other lawyers for domestic violence victims do not accept the argument. Instead, they fear prosecutors will drop cases and let repeat offenders off the hook, citing examples like in April 2021 when a 7-month-old boy in San Francisco was murdered by his carer arrested twice earlier on suspicion of the crime at home Violence. Both times he was released without charge.

“Domestic violence cases are difficult, but any good prosecutor knows how to prosecute a DV case and you don’t have to rely on a victim’s testimony,” Stefani said. “These cases can be prosecuted. End of the story.”

Still, domestic violence cases are among the most difficult crimes to prosecute. Victims can be afraid to testify because retaliation is possible. And because of the intimate nature of the crimes, it is often difficult to confirm stories or find witnesses.

“We recognize that not every survivor wants to continue criminal proceedings. But we certainly hear from survivors facing severe domestic violence that their cases are not moving forward. We have to find a balance, ”said Beverly Upton, executive director of the San Francisco Domestic Violence Consortium. “I don’t see prosecutors as an enemy, but the criminal justice system is there to protect the survivors and to protect the public.”

Evanthia Pappas, Senior Attorney for the Domestic Violence Division of the Prosecutor’s Office, understands the challenge she faces.

“The pandemic has undoubtedly impacted domestic violence law enforcement,” Pappas told The Examiner. “Anecdotally, I can tell you that once the restrictions were lifted in June 2021 and more vaccines became available in the spring, we had an immediate spike in coverage and there were more cases of SFPD and we are indicting more cases.”

Pappas, a national expert on prosecuting domestic violence cases, said the likelihood of a case being prosecuted often depends on what happens when law enforcement officers arrive on the ground. She is currently focused on providing new training and recommendations to the San Francisco Police Department on how to safely assist victims and gather vital information that can later be used in court, even if the witness later decides not to testify.

Even if the charges appear to be rising back to pre-pandemic levels, attorneys at the hearing on Thursday said there was room for improvement, including investing in alternative approaches to assisting victims and offenders outside of law enforcement.

The San Francisco District Attorney has launched a handful of emergency shelters and transportation for victims of domestic violence, including partnering with Lyft to offer free rides and another with Airbnb, which opened 20 furnished apartments for survivors for 90-day stays. It also introduced a text service so that victims can discreetly try to get help.

“At the start of the pandemic, we were immediately concerned about what local shelter would mean for domestic violence survivors. It is one thing to have shelter on the spot, it is another thing to have shelter with a perpetrator, ”said Boudin.

However, looking back over the past two years, some proponents say it wasn’t enough.

In 2020, 79% of clients seeking shelter because of domestic violence were turned away, according to the report by the San Francisco Department on the Status of Women. 70% of domestic violence victims were women, to whom the police responded, and black and Latin American communities were over-represented among the victims, the report shows.

Stefani is now introducing a law requiring quarterly reporting on incidents, arrests and domestic violence charges on the ground. Without such data, Upton and groups like the San Francisco Women’s Political Committee say it is difficult to understand the full extent of the problem.

Some proponents say an increased focus on law enforcement isn’t the answer either. Instead, they promote approaches that focus on improving access to basic needs such as housing and food, and promote community-based violence prevention and recreation programs such as Men In Progress, a peer-counseling program run by the Glide Foundation.

“The most common reason patients didn’t seek help in our emergency department because of medical emergencies was fear of the police,” said Leigh Kimberg, San Francisco Department of Public Health’s Interpersonal Violence Prevention Coordinator and professor of medicine at UC San Francisco. “We invest heavily in police work and not in structural security measures such as housing, food and income.”

The different approaches, protracted debates and calls for political change underline the complexity surrounding the issue of domestic violence.

For survivors like Lennette, however, the personal rather than the political is more in the foreground.

“It is brave to walk away from something unhealthy, even if you stumble on the way out. Not everyone will understand what it’s like to walk in your shoes, but you do, ”she said. “Take care.”

ACTION: Get help with violence, assault, and abuse at home

Stefani says there is evidence that victims of domestic violence are kept short in the criminal justice system. It introduced a law in May that, if passed, would require the SFPD and the prosecutor’s office to provide quarterly reports on domestic violence cases to the board of directors, the mayor and other city departments.

“Reporting requires how many calls to 911 are made that are related to domestic violence and how many of those calls involve a child or a gun,” Stefani said.

Legislation would also require that the number of domestic violence cases submitted to prosecutors be disclosed along with the charges filed and the outcome of those cases.

The bill’s hearing follows a report recently released by the Family Violence Council that found that 79 percent of people fleeing abuse and / or seeking protection were turned away during the pandemic due to capacity constraints and increased demand.

“It is very difficult for domestic violence survivors to leave the country,” said Jenny Pearlman, who works with Safe and Sound, a children’s aid organization. “If a family that has experienced violence has no shelter, the family will most likely have to return to the home where the abuse takes place.”

There were 131 arrests for domestic violence crimes in San Francisco in the fourth quarter of 2020, according to SFPD. 86 percent of these cases were dismissed, only nine percent were charged.

ABC7 reached out to the prosecutor’s office and asked for a larger sample of this data to see how many domestic violence cases were indicted throughout the year. Our team did not receive this information before our deadline, but received the following statement:

“Numbers declined during the pandemic, especially during detention periods, which particularly affected cases of domestic violence. As a result, our office has also allocated significant resources to expanding support for domestic violence victims to provide shelter and transportation during the pandemic. ”

The prosecutor’s office also told ABC7 that filing and fee rates for domestic violence cases in San Francisco rose from 24 percent in 2020 to 31 percent this year. By comparison, over the past five years, the highest fee rate reported for this type of case was 35 percent in 2018.

“I just think we have to do better,” said Stefani.

The draft law will be presented to the Supervisory Board for the first full vote in two weeks.

San Francisco officials and community groups continue to work to reduce hatred, prejudice and related violence, including a march along the Upper Great Highway scheduled for Sunday.

On Saturday, Mayor London Breed, the city’s human rights commission and community leaders launched the Solidarity Campaign to unite Asian-American and Pacific Islanders, Blacks, Latinx, Indians and multiracial communities.

“San Francisco is stronger when we are united and work together,” Breed said in a statement. “We must continue to come together to denounce all forms of hatred, bias and discrimination.”

Launched at the Civic Center Plaza, the campaign featured intergenerational discussions, storytelling, and sharing successful examples of allies and why it’s important to stand together.

Event attendees put together “solidarity packs” that included children’s books, family cards for the Asian Art Museum, mental health resources, and information on public and personal safety.

The kits will be distributed to residents in Chinatown, Bayview Hunters Point, Tenderloin and other areas.

San Francisco’s efforts to reduce racially motivated violence come because crimes against members of the Asian-American and Pacific islander communities have increased since the pandemic began.

According to Chinese for Affirmative Action, there have been 3,795 reports of such crimes in the US as of March 2020, 43% of them in California. And approximately 24% of all racially motivated violence reported in California occurred in San Francisco.

“When we stand together in solidarity, we have strength,” said Jon Osaki, executive director of the Japanese Community Youth Council, in a statement. “It is more important than ever that we stop pointing and the violence that is tearing us apart.”

Regional and community leaders also hosted an event in Millbrae Saturday in support of communities of Asia-American and Pacific islanders. The organizers of the United in Action with Asians rally and march said their goal was to improve the overall safety, awareness and protection of Asian Americans and Pacific Islanders or AAPI communities and communities in general.

The Sunday event in San Francisco, which seeks safety for AAPI communities, is scheduled for 1 p.m. Participants will meet at the junction of the Upper Great Highway on Sloat Boulevard. In addition to the march, there will be speeches, performances and resource tables.

A woman accused of stabbing her boyfriend with a large kitchen knife during an argument outside the couple’s trailer park in South San Francisco was found guilty of second degree murder on Wednesday, the San Mateo County District Attorney said.

A jury on the eighth day of the trial found Victoria Soledad Garcia, 30, guilty of second-degree murder and deterring witnesses, prosecutors said. She was accused of killing Christhian Alderete on October 17, 2019 after a woman contacted Alderete on Facebook. Garcia stabbed her boyfriend in the chest and he was bleeding to death, prosecutors said. Prosecutors said she faces 20 years in prison, not less than 15 years. Her judgment date is November 30th.

– – The heart of San Francisco’s Chinatown, a major rally held early this morning to show solidarity with the city’s Asian residents. KPIX 5 John Ramos was there showing us that amid calls to healing, there were signs of how deeply affected the community was.

JOHN RAMOS: The population was strong today as hundreds of people showed up in San Francisco’s Chinatown to denounce the violent attacks on Asians. If the definition of terrorism is the use of force to create fear in a larger population, then the attacks on the Asian population certainly did.

– – I’m injured. I had nightmares, people broke into my house and held a gun against me.

– – The rally in Portsmouth Square in San Francisco’s Chinatown was intended to remember the victims of anti-Asian violence from here in the Bay Area to the horrific murder of eight people in Atlanta. But Xing Yu says that even though his parents were not physically attacked, they are still victims.

XING YU: My parents just don’t want to go out anymore. Because they just like being scared, like walking on the street, and being attacked by random people.

– – The video of the elderly Asian woman using a stick to defend herself against an attacker on Market Street has become a symbol of how vulnerable people currently feel.

WILL LEE: He didn’t go around, you know, attacking white people. He saw two Asian – and Asian men and an Asian woman – and he attacked them. This is a hate crime.

SHAW SAN LIU: And we’re here to say grandma shouldn’t use a stick to defend herself. We as a society must offer security to all members of the community. And you know it is clear that the current systems are not working.

– – Today’s rally was organized by the San Francisco Chinese Progressive Association.

– – And another strong show of support in Daly City today. Dozens heard speeches from community leaders urging people to stop the hatred of Asian-American and Pacific islanders. They also held signs that said Asian Lives Matter. The rally was sparked by another horrific attack on an elderly Asian person. The surveillance video shows a suspect knocking a 76-year-old woman to the ground as she strolls on Sierra Vista Avenue on Thursday. But it doesn’t end there. The suspect then dragged the woman into the street and robbed her.

– – We know that the anti-Asian sentiment and violence are not new. When the United States needed workers, it flooded its doors and opened its doors to workers from Asia. But as soon as America felt threatened, exclusion laws were put in place and passed.

– – We are experiencing a collective trauma, a racial trauma on both an individual and a community level, which means that it requires more opportunities to heal together. I find consolation in [? chances ?] today to address those emotions and think critically about how to create an anti-racist community.

– – And in a support demonstration in San Jose, Police Sergeant Christian Canario was walking alongside a group of Asian seniors as he made his rounds today.
