<p>It is with great pride that Chancellor &#038; Dean David Faigman formally announces that as of January 1, 2023, the former UC Hastings College of the Law has a new name—<strong>University of California College of the Law, San Francisco</strong>.</p>
<p>“Our new name accurately reflects our law school through its geographic location and recognizes it as an anchor institution in the City of San Francisco, where we&#8217;ve proudly made our home since its founding in 1878,” Faigman said.</p>
<p>Starting Jan. 1, the law school will be called <strong>UC College of the Law, San Francisco</strong>or <strong>UC Law SF</strong>.  Its signs, official seal, and other branded materials will begin to reflect the new name at the start of the new year.  A full transition for all building signs and additional renaming needs is expected to be completed within six months.</p>
<p>On September 23, 2022, California Gov.  Gavin Newsom signed a bill into law to change the state Education Code to adopt the College&#8217;s new name.</p>
<p>On December 30, 2022, State Superior Court Judge Richard Ulmer ruled that a lawsuit filed by a small group of alumni and descendants of the law school&#8217;s founder could not enjoin the law school from using its new name.</p>
<p>Since 2017, the College has studied the actions of its founder, Serranus Hastings, and the harms he committed against the Round Valley Tribes and Yuki People.  As a result of the findings and several hearings with affected Indigenous People, alumni, students, staff, and faculty, in the fall of 2021, the College&#8217;s Board of Directors voted to rename the school.  In July 2022, the Board unanimously chose UC College of the Law, San Francisco as its new name.  This was followed by a vote by the state Legislature that overwhelmingly approved Assembly Bill 1936 that changed the state Education Code to adopt the College&#8217;s new name.</p>
<p>Chancellor &#038; Dean David Faigman has told the law school community that the renaming of the law school is an integral part of restorative justice efforts that have included opening an Indigenous Law Center and providing legal assistance to California tribes through law school fellowships.  He said, &#8220;Renaming our school is an important component of the College&#8217;s efforts towards addressing the impact of our founder and first dean, especially the harms committed against the Yuki People.&#8221;</p>
<p>UC College of the Law, San Francisco, remains a law school dedicated to academic excellence, experiential learning, social justice, and its students continue to succeed as attorneys and are found in all areas of public service, private law firms, government, leadership, and education.  We are proud of our many notable graduates, including Vice President Kamala Harris and former San Francisco Mayor Willie Brown.</p>

<p>Many commercial tenants went to court for a pandemic rent break.  A Murray Hill law firm can now count itself among the few to have won one.</p>
<p>New York&#8217;s Appellate Division ruled that affiliates of landlord ABS Partners Real Estate must credit Wolf Haldenstein, a firm specializing in stocks and antitrust law, over $2 million in rent and legal fees after the office owner failed to complete renovations on the firm&#8217;s two floors of leased space.</p>
<p>The HVAC system roared like a “jet engine,” the landlord&#8217;s architect said, produced 90-degree temperatures in the summer and failed to circulate fresh air as Covid raged in New York.</p>
<p>The law firm, which has occupied 270 Madison Ave for nearly 100 years, agreed to move temporarily from the ninth and 10th floors to the 11th and 13th when it signed a 12-year lease in 2018.</p>
<p>ABS planned to revamp the heating and air conditioning systems on the two lower floors and agreed in the lease that its tenant would rent the upper floors until an architect deemed the work substantially complete.</p>
<p>The lease included four months of free rent once the firm moved back to the lower floors and a rent credit if renovations took too long.  Wolf Haldenstein would receive a daily credit for each day that work continued after February 2020. The rate would jump to a day and a half after April.</p>
<p>Wolf Haldenstein moved back to the ninth and 10th floors in December 2019, ahead of schedule.  But the firm immediately questioned whether work had been completed.</p>
<p>“We should have another construction meeting to discuss HVAC problems,” Mark Rifkin, managing partner at Wolf Haldenstein wrote in an email to the job&#8217;s contractor on Christmas Eve.</p>
<p>&#8220;I think some may have assumed substantial completion before it was done,&#8221; he continued.  &#8220;Had this been summertime, when we need the AC, the space would be uninhabitable.&#8221;</p>
<p>In another email to ABS Partners, Rifkin described the floors as excessively hot and the HVAC system as excessively loud.</p>
<p>Those problems continued into 2020. In February, as Covid began spreading in the city, ABS&#8217; construction manager acknowledged in an email that &#8220;many &#8216;existing condition&#8217; items &#8230; need to be figured out and resolved.&#8221;</p>
<p>James Caseley, an executive at ABS, went so far as to describe the HVAC system as a &#8220;disaster&#8221; to the landlord&#8217;s construction manager in a memo.</p>
<p>The same month, the landlord started work on the 11th and 13th floors, making it impossible for Wolf Haldenstein to relocate to a more hospitable floor.</p>
<p>The HVAC issues lasted through the pandemic, forcing partners, associates, staff and clients, once they returned to the office, to deal with a system that failed to adequately circulate fresh air, according to Scott Mollen of Herrick Feinstein, attorney for the tenant.</p>
<p>In April 2021, Wolf Haldenstein sued ABS Partners, alleging that the landlord&#8217;s architect had not declared the work complete, meaning the firm had no obligation to pay rent.</p>
<p>ABS answered a month later, arguing that the law firm had defaulted on rent and owed $1.2 million on its roughly $145,000-per-month lease.</p>
<p>That November, a Supreme Court judge sided with Wolf Haldesstein, ruling the work was incomplete and the firm had no need to pay rent. The Appellate Division upheld the ruling that the landlord should pay a $1.2 million rent credit, $100,000 in moving expenses and $700 .00 in attorney&#8217;s fees.</p>
<p>&#8220;Much of the unnecessary fees were incurred as a result of landlords&#8217; litigation tactics,&#8221; the court noted.</p>
<p>Rosenberg &#038; Estis attorney Alex Estis, who represented ABS, said his legal team appreciated the Appellate Division reduced Wolf Aldenstein&#8217;s rent credit award.  A lower court had granted the firm an additional $647,869, plus interest.</p>
<p>&#8220;We are considering further options in light of the ruling,&#8221; Estis added.</p>
<p>The firm&#8217;s late co-founder Warren Estis had represented ABS for most of the suit, one of his last.  Estis died in April.</p>

<p>I think we have to go back to holding repeat offenses and repeat violent offenses accountable.  I think that has been lost in this system and that cost us many lives over the past two years, having repeat offenders go out and reoffend in lethal ways.  And so I am committed to making sure that those who decide to live a life of crime and chronically commit crime in this city [are held] accountable.  As well as, as I said, balancing that need for reform.</p>
<p><strong>So would it be fair then to say one metric by which the public should judge you would be to see if police arrest rates go up?</strong></p>
<p>I wouldn&#8217;t necessarily say that.  I think a lot of it is how people feel.  If people start to see more action on the part of the police and more action within the DA&#8217;s office to hold offenders accountable, I think they should hopefully start feeling different as they walk about the streets.  There will also be data, of course, they can look to.</p>
<p><strong>How do you measure that feeling?</strong></p>
<p>Can you walk outside and not be robbed?  Right.  Repeatedly, because I think that&#8217;s a part of what&#8217;s happening.  Can we get the number of hate crimes to decline in this city?  Can we stop people from feeling that this is a place where you can come and walk out with bags of goods from our convenience stores with no consequence?  And I&#8217;m hoping that we can see numbers of those situations decline.</p>
<p><strong>By when?  We&#8217;ve got a few months until November, when you&#8217;re going to be up [for election].  Potentially, former DA Boudin would run against you.  We don&#8217;t know who else may.  Do you expect that people should be able to see the effect of your work by November?</strong></p>
<p>Myself and the attorneys in my office are going to work tirelessly to make sure that we start seeing those effects immediately, and we&#8217;ve already begun that work.  And so I am hoping that each and every day people see slow progress in that respect. </p>
<h2>Political Breakdown</h2>
<p>SCOTT SHAFER: <strong>We were talking about what drew you into working in the DA&#8217;s office.  And you quit last year.  You were a prosecutor in the homicide unit, and then you helped lead this recall of Boudin.  Is it fair to say that as it became clear that he was going to lose, maybe post-June 7th, you lobbied for the job?  Did you want it?</strong></p>
<p>BROOKE JENKINS: No, I wouldn&#8217;t say that&#8217;s fair at the time that the recall was going on.</p>
<p>SCOTT SHAFER: <strong>What about after?</strong></p>
<p>BROOKE JENKINS: After it passed, I did express interest in the job, in part because I wanted to make sure that whoever took over what somebody who was truly passionate and dedicated to this work.  Who didn&#8217;t see it as a stepping stone to something else political, had experience doing the work.  And so that meant a lot to me.</p>
<p>MARISA LAGOS: <strong>What was the interview process like?  My understanding is that the mayor made pretty specific demands of all the folks she talked to about what she wanted to see done.  Did you make promises to the mayor and how did you present yourself?</strong></p>
<p>BROOKE JENKINS: It was a very intense process.  I will say that.  I think I had three interviews with her.  I would not say she made demands of me during that interview, but she did have a laundry list of questions about certain topics, certain issues, I assume, based on conversations she had had with members of the public and what was significant to them.  And so she wanted to make sure that whoever took over, it appeared to me, had a concrete understanding of the office and of what it was going to take to help get this city turned around. </p>
<p>MARISA LAGOS: <strong>I&#8217;m curious, though.  You&#8217;ve talked about people needing to be patient.  That one prosecutor, one DA, isn&#8217;t going to change crime trends overnight.  And yet the construct of the recall was very much putting the problems of the city on one person&#8217;s back.  Why should voters give you a different sort of opportunity to prove yourself?  And how much time do you think we should give?</strong></p>
<p>BROOKE JENKINS: I think what I was saying was that I can&#8217;t snap my fingers and make crime disappear.  And I made that clear every time that I talked about the recall that I didn&#8217;t think everything was Chesa&#8217;s fault.  I never could have put that through.</p>
<p>MARISA LAGOS: <strong>A lot of the people who supported the recall did, though.</strong></p>

<p>WOODSIDE (KPIX 5) – The town of Woodside began accepting Senate Bill 9 housing applications Monday, just one day after Attorney General Rob Bonta chastised town officials, accusing them of using the idea of ​​a mountain lion habitat to skirt the new housing law.</p>
<p>SB 9 allows homeowners to build up to four residential units on a single family lot.</p>

<p>Kara Cox is in the process of getting permits in San Mateo.</p>
<p>&#8220;It&#8217;s carbon neutral to provide housing on the Peninsula, so everyone&#8217;s not driving back-and-forth from Concord and Fairfield and all these outlying places where housing is more reasonable,&#8221; Cox told KPIX 5.</p>
<p>Terry Szeczyk owns a planning services company for homeowners and said a permitting process that used to take two years will be cut down to four months under the new rules.</p>
<p>“It&#8217;s much more streamlined and much easier.  It&#8217;s refreshing to roll back the standards that may have existed in 1970,” said Szeczyk.</p>
<p>Cities like Woodside insist they&#8217;re doing their part.</p>

<p>&#8220;The town of Woodside has consistently exceeded its state mandated low and moderate income housing commitments,&#8221; said Woodside Assistant Attorney Kai Ruess.</p>
<p>For middle-income earners, finding a home to buy in the San Jose metro areas is much harder than in San Diego, Los Angeles, and Seattle.  The National Association of Realtors says there&#8217;s only 1 listing for about every 3,500 households.</p>
<p>“SB9 is just one part of a larger puzzle for how to solve the housing crisis.  SB9 is very limited in terms of the kinds of parcels and places where it makes sense,” said Matt Gelfand of Californians for Homeownership.</p>
<p>The Terner Center for Housing Innovation at UC Berkeley estimates SB9 would create as many as 700,000 new units on California&#8217;s 7.5 million single-family home lots.</p>
<p>“Across the state where the cities and counties and towns have to plan for where they&#8217;re going to put housing for the next eight years, that&#8217;s going to be really critical in terms of determining whether we actually solve this crisis,” said Gelfand.</p>

<p>SAN FRANCISCO (CBS SF / AP) &#8211; Foiled by a federal court backlash, Governor Gavin Newsom ordered staff to use Texas’s successful legal arguments in the Supreme Court to defend its ban on abortion to draft law that it would prohibit possession of assault weapons in California.</p>
<p>In a statement released Saturday night, Newsom expressed outrage over the Supreme Court&#8217;s decision on the Texas case.</p>

<p>“I am outraged by yesterday&#8217;s Supreme Court ruling allowing the ban on most abortion services in Texas to be upheld, and I broadly support Texas’s plan to amend its Roe v. Basic Protection Act.  Isolate Wade, ”he said.  &#8220;But if states can now protect their laws from scrutiny by federal courts that liken assault weapons to Swiss Army knives, then California will use that authority to protect people&#8217;s lives while Texas has used them to put women at risk. &#8220;</p>
<p>&#8220;I have directed my associates to work with the Legislature and Attorney General on a bill that will create a right of action that allows individuals to seek injunctive relief and legal damages of at least $ 10,000 per violation, plus costs and attorney&#8217;s fees assert anyone. ”Who manufactures, distributes or sells an assault weapon or ghost gun kit or parts thereof in the US state of California.  If the most efficient way to keep these devastating weapons off our streets is to add the threat of private lawsuits, that&#8217;s exactly what we should be doing. &#8220;</p>
<p>California has banned the manufacture and sale of many assault weapons for decades.  A federal judge lifted the ban in June, ruling it unconstitutional and drew the wrath of the state&#8217;s democratic leaders by comparing the popular AR-15 rifle to a Swiss Army knife as &#8220;good for home and combat&#8221;. </p>
<p>The state ban remained in place while the verdict is being appealed.</p>
<p>Meanwhile, Republican lawmakers in Texas passed law earlier this year banning abortion after a fetal heartbeat is detected, which usually occurs about six weeks after pregnancy.  Texas law allows private individuals to enforce the ban and gives them the power to sue abortion clinics and anyone else who “helps and assists” with the process.</p>
<p>On Friday, the US Supreme Court allowed Texas law to remain in effect while abortion clinics block it. </p>

<p>The Texas Abortion Act litigation has centered on its unusual structure and whether it inappropriately limits the ability to challenge the law in court.  Texan lawmakers left responsibility for enforcing the law to private individuals, not state officials.</p>
<p>The case raised a complex set of questions about who, if any, can sue in federal court, the typical avenue for contesting abortion restrictions.</p>
<p>Newsom&#8217;s gun proposal would have to pass California lawmakers before it could become law.  The legislature is currently not in session and is due to meet again in January.  It usually takes around eight months for new bills to pass through lawmakers, unless there are special circumstances.</p>
<p>Senator Brian Dahle, a Republican from Bieber, would oppose the plan but predicted it could likely pass California&#8217;s Democrat-dominated legislature.  He said the proposal was most likely a stunt for Newsom to attract its progressive electorate ahead of a possible future presidential run.</p>
<p>“The right to bear arms is different from the right to have an abortion.  The right to abortion is not a constitutional change.  So I think he&#8217;s far from the base, ”said Dahle.  &#8220;I think he&#8217;s just using it as an opportunity to be in the stands.&#8221;</p>
<p>But Newsom&#8217;s Saturday night statement is a fulfilled prophecy for some gun rights groups who had predicted that progressive states would try to use Texas&#8217; abortion law to restrict access to guns.  Because of this, the Firearms Policy Coalition, a nonprofit group that campaigns for gun rights, has filed a lawsuit against Texas law in the US Supreme Court.</p>

<p>&#8220;If Texas is successful in its move here, New York, California, New Jersey and others will not be far behind making equally aggressive moves to not only deter but to freeze the right to keep and carry weapons,&#8221; Lawyer Erik Jaffe wrote on behalf of the Arms Policy Coalition.</p>

<p>IT giant Salesforce has offered to relocate its Texas employees after the conservative state passed a restrictive abortion law.</p>
<p>&#8220;If you want to move, we&#8217;ll help you get out of TX,&#8221; said Marc Benioff, CEO of Salesforce, in a tweet Friday, adding a link to a CBNC article that first covered the move.</p>
<p>The law banning abortions after six weeks has sparked outrage among suffragettes, and the Biden government is looking for legal ways to prevent it.</p>
<p>Salesforce, a San Francisco-based software company, told its employees that it respects &#8220;that we are all ingrained and have different perspectives,&#8221; said an internal statement quoted by CNBC.</p>
<p>&#8220;If you have concerns about access to reproductive health care in your state, Salesforce will help you relocate you and your immediate family,&#8221; the memo said.</p>
<p>Texas law, passed this month, prohibits abortions once a heartbeat can be detected before many women even know they are pregnant &#8211; except in the event of a medical emergency.</p>
<p>Other tech companies have also taken action in response to the law.  Texas-based online dating giants Bumble and Match Group have announced plans to create funds to support women.</p>
<p>The new law encourages Texans to report anyone involved in illegal abortion, including anyone who takes a woman to a clinic to have the procedure done.  In response, car sharing companies Uber and Lyft have announced that they will pay drivers legal fees if exposed. </p>
<p>Web hosting company GoDaddy refused to host a website that was set up by a Texas anti-abortion group to gather guidance on how to enforce the new law.</p>

<p>NEW YORK (AP) &#8211; Major League Baseball announced Friday that this summer&#8217;s All-Star game would be relocated from Truist Park in Atlanta.  This is in response to Georgia enacted a new law restricting voting rights last month.</p>
<p>MLB had awarded the game to Atlanta in May 2019, and the game was scheduled for July 13th as part of baseball&#8217;s midsummer break, which includes the futures game on July 11th and the home run derby the following night.</p>

<p>Commissioner Rob Manfred made the decision to postpone the All-Star events and the amateur draft, which was to be held in Atlanta for the first time.  A new baseball field for this year&#8217;s events was not immediately revealed.</p>
<p>MLB&#8217;s announcement came eight days after Georgia Governor Brian Kemp signed a major Republican-sponsored revision of the state election that included new restrictions on postal voting and increased legislative control over the conduct of elections.</p>
<p>Manfred made the decision after talking to the Major League Baseball Players Association, individual players, and the Players Alliance, a black player organization founded after George Floyd&#8217;s death last year.</p>
<p>&#8220;I&#8217;ve decided that the best way to demonstrate our values ​​as a sport is to move this year&#8217;s All-Star Game and MLB draft,&#8221; Manfred said in a statement.  &#8220;Major League Baseball fundamentally supports the voting rights of all Americans and opposes ballot box restrictions.&#8221;</p>
<p>&#8220;Fair access to voting continues to be steadfastly supported by our game,&#8221; said Manfred.</p>
<p>Other sports have postponed high profile events due to social issues.</p>

<p>The NBA moved the 2017 All-Star Game out of Charlotte, North Carolina when the league challenged a state law restricting anti-discrimination protection for lesbian, gay, bisexual, and transgender people.</p>
<p>For years, the NCAA did not hold championships in states that officially recognized the Confederate flag.</p>
<p>This year&#8217;s All-Star Game includes honoring Hank Aaron, the Braves&#8217; Hall of Famer and former career home run champion, who passed away on January 22nd at the age of 86.</p>
<p>&#8220;We will continue our plans to celebrate the memory of Hank Aaron during this season&#8217;s All-Star Celebrations,&#8221; said Manfred.  Additionally, MLB&#8217;s planned investments to support local communities in Atlanta will continue as part of our All-Star Legacy projects.  We are completing a new host city and details of these events will be announced shortly.  &#8220;</p>
<p>MLB has canceled last year&#8217;s All-Star Game, which was scheduled for Dodger Stadium in Los Angeles, due to the late and shortened season due to the novel coronavirus pandemic.  The 2022 game will be played at Dodger Stadium.</p>
<p>MLB has awarded Philadelphia the All-Star Game 2026 as part of the celebration of the 250th Anniversary of the Declaration of Independence.</p>
